HomeMy WebLinkAbout1980-07-29 - City Commission Public Hearing Meeting MinutesCITY OF TAMARAC, FLORIDA PUBLIC HEARING COMPREHENSIVE PLAN JULY 29, 1980 CALL TO ORDER: Mayor Falck called the meeting to order on Tuesday, July 29, 1980, at 7:00 P.M. ROLL CALL: PRESENT: Mayor Walter W. Falck Councilman Irving M. Disraelly Councilman Irving zemel Councilwoman Marjorie Kelch ABSENT & EXCUSED: Vice-P7ayor Helen Massaro ALSO PRESENT: Carol Evans, Ass't. City Clerk Evan Cross, City Planner Arthur M. Birken, City Attorney (in attendance at 7:20 P.M.) Mayor Falck explained that this was the last Public Hearing on the Compre- hensive Plan for the City of Tamarac, in order to be in compliance with State Statutes. He requested Evan Cross, City Planner, to call up each element for Council discussion, after which a Public Hearing would be held. 1. Review, public input and action on the City of Tamarac Comprehensive Plan, Temp. Ord #786 - Second Reading SYNOPSIS OF ACTION:(See page 3) Mr. Cross read Temp. Ord. #786, by title only. TRAFFIC CIRCULATION ELEMENT APPROVED Mr. Cross indicated that all the comments from the First Reading of the Ordinance have been incorporated, and Council advised that they had no questions regarding these changes. C/M Disraelly stated that there will be a new cover identical to the other. He questioned the revised Map 3 on page 12, stating the volume/ capacity ratio was not shown, as it was on Map 8. Mr. Pinder, repre- senting Mid --South Engineering, stated that Map 3 was revised to show existing volumes only. Mayor Falck said each element would be adopted individually, after which, action would be taken on Temp. Ord. #726, adopting the Compre- hensive Plan. C/M Disraelly MOVED that the Traffic Circulation Element of the Compre- hensive Plan, as presented, with the July cover, be approved as re- ceived on final reading,and C/W Kelch SECONDED. VOTE: ALL VOTED AYE. HOUSING ELEMENT r.110,Zi]ti�i7 Mr. Cross called the Housing Element next and said the major change appears on page 24, paragraph 3, as required by the City Attorney. Mr. Birken, the City Attorney, was in attendance at this time. C/M Disraelly said that on page 22, a figure of 2.2 persons were given per household. However, on page 19, a figure of 1.78 was used. Mr. Cross explained that the 1.78 figure on page 19 was based on the 1975 population, and the figure of 2.2 was based on the City's Land Use Plan adopted last year. C/M Disraelly MOVED for the adoption of the Tamarac Housing Element of the Comprehensive Plan, as dated June 1980, on final reading, and C/W Kelch SECONDED. VOTE: ALL VOTED AYE. -1- 7/29/80 mr/ UTILITY ELEMENT C/M Disraelly indicated there is a on page 7, which shows the existing that area. But, he said, it is not equivalent table. APPROVED, WITH CHANGES table in Tamarac Utilities East, and ultimate Land Use Plan for shown for Tamarac West, or an Mr. Cross said that a comparison chart was being shown on page 7, which reviews the present data versus the future data, which does not have much differential. On Tamarac Utilities West, there is a detailed discussion of future needs. Mr. Wohlfarth was reiterating, he said, what the Land Use Plan states on page 7, and was showing the close proximity to capacity that the East side utility services. C/M Disraelly called attention to page 29, where the word "recently" was misspelled; also, on page 3 in the new Water Availability, the aquifer extension to the ground surface is shown to the depth of 400 feet, but the old one indicated 200 feet, to which Mr. Cross said it was corrected to 400 feet. He also noted that it does not show who serves Shaker Village for water and sewer, on Exhibit 1, to which Mr. Birken said that the City does serve them with water. Mr. Cross indicated that he will check the 200 feet, because the Con- servation Element also contains the same information, and page 3 does state 200 feet. C/M Disraelly MOVED for the adoption of the Utility Element of the Land Use Plan, on final reading, with the three potential changes, and C/W Kelch SECONDED. VOTE: ALL VOTED AYE. OPEN SPACE APPROVED, WITH CORRECTIONS C/M Disraelly inquired about the fact that the 8% acreage density being insufficient, to which Mr. Cross responded that there is an ordinance pending for several months, regarding that section of the Code, changing the 8% to 9%. C/M Disraelly requested that the sentence previously used at the bottom of page 13, be restored, for clarification„ to which Mr. Cross concurred. _May_o_r- Falck indicated_tha-t_on paqe 8,---.where _school .-courses..-r-e-_di-sc_�s�ed-, it is noted that they offer two nights and 3 days a week, but felt it should be corrected to three afternoons per week, instead of days. C/M Disraelly MOVED that with the proposed changes on pages 8 and 14, as outlined, that the Open Space Recreation Element be adopted on second and final reading, and C/W Kelch SECONDED. C/M Disraelly additionally advised that on page 16 a #5 objective was eliminated, and should be inserted, and WITHDREW HIS MOTION, and the SECOND WITHDREW HERS. He then MOVED that on page 16, the #5 remark be inserted, and correc- tions made on pages 8 and 14, as discussed, and that the Open Space Recreation Element be approved on second and final reading, and C/W Kelch SECONDED. VOTE: ALL VOTED AYE. CONSERVATION ELEMENT APPROVED, AS AMENDED. Mr. Cross said that Council was in receipt of a memo from the City Attorney, as to additional language to be used for the Executive Airport, to this element and the Intergovernmental Coordination Element. C/M Disraelly said this referred to the July 28th memorandum, in the second paragraph on page 8, after the word ordinance, under noise; namely, "Combat reckless attempts by the City of Ft. Lauderdale to expand uses of Executive Airport which will increase noise levels." -2- 7/29/80 mr/ He also noted that on page 7, under Goals and Objectives, a new para- graph should be inserted; "Secure for the residents of Tamarac, a guarantee under the Florida Constitution that adequate provision shall be made by law for the abatement of the air and water pollution and of excessive and unnecessary noise." This was Article ART, II, Section 7, Fla. Cons.(1968) C/W Kelch discussed the insertion of language pertaining to air quality, due to gasoline dumping, to which the City Attorney recom- mended the following paragraph could be added; "Strive to discourage Tape the additional pollution of the air over the City caused by dumping Side of fuel by aircraft using the Ft. Lauderdale Executive Airport". #2 C/M Disraelly said that with the inclusion of the three new paragraphs, he would MOVE for the adoption of the Conservation Element of the Tamarac Comprehensive. Plan on second reading, and C/W Kelch SECONDED. VOTE: ALL VOTED AYE. INTERGOVERNMENTAL COORDINATION ELEMENT APPROVED, AS AMENDED. Mr. Cross said that in Mr. Gallop's memorandum to Mr. Birken, it was noted that additional language be inserted in two areas, as concerns the Executive Airport. C/W Kelch felt that the additional paragraph should be included after "relation of future growth", and before"regional and State coordination," to which Mr. Cross concurred, on page 3. (Mr. Cross advised that the Implementation Policies have been included on page 6, which is based on corrections from a previous meeting. C/M Disraelly said that based on an additional paragraph, as submitted by Mr. Gallop, on page 3, and the Implementation Policies on page, 6, he MOVED for the adoption of this Intergovernmental, Coordination Element on second reading, and C/W Kelch SECONDED. VOTE: ALL VOTED AYE. 1. Review, Public Input and Action on the City of Tamarac Comprehensive Plan - Temp. Ord. #786 - Second Reading. SYNOPSIS OF ACTION: Adopted, on 2nd and ORDINANCE NO.O- q'O--Ff PASSED. final reading.(See page 1) w' Mayor Falck opened the discussion to the public, and closed it because there were no comments received. C/M Disraelly MOVED to adopt Temp. Ord. #786, on second and final reading, which provides various land use elements for the City of Tamarac, and C/W Kelch SECONDED. Mayor Falck commended the manner in which Mr. Cross handled the input for this public hearing; also, the work involved by the City Attorney, in spending countless hours of reviewing the various elements; and the work accomplished by the City Council, which enabled the.City to submit their documents before other municipalities in Broward County. He also noted that two night meetings were held on the City's Compre- hensive Plan, on July 15th and 29th, which were important and vitally affect all the citizens of Tamarac, this day, and in the future. He further added that five people were in attendance at the July 15th, 1980 meeting, and no public attendance at the July 29th meeting. VOTE: ALL VOTED AYE. 2. Continuing Support of the Council for the F.O.P. - Temp. Reso.#1739. SYNOPSIS OF ACTION: AGENDIZED BY CONSENT RESOLUTION NO.R-PASSED. (See page 4) C/M Disraelly MOVED to AGENDIZE BY CONSENT, Temp. Reso. #1739, pro- claiming continuous support of the Council for the F.O.P., and C/W Kelch SECONDED. VOTE: ALL VOTED AYE. -3- 7/29/80 mr/ L C Mr. Birken read Temp. Reso. #1739, and indicated that on line 7, the word Proclamation should be changed to Resolution, and on line 18; also, correcting the NOW, THEREFORE, paragraph to read City Council of the City of Tamarac, and deleting the name of Walter W. Falck. C/M Disraelly MOVED for the adoption of Temp. Reso. #1739, as amended, and C/W Kelch SECONDED. VOTE: ALL VOTED AYE. Mr. Birken reviewed the item of the funeral home, by noting that a member of the Police Department took the Notice of Appeal to the court- house, and was brought to the Criminal Branch, rather than the Civil Branch. The pleading, he said, cannot be locatedf with Monday, July 28th, 1980, being the last day for the appeal to be filed, which will present a problem. MEETING WAS ADJOURNED AT 8:30 P.M.
