City Clerk, C.Evans In the abser.pe of Mayor Falck, V/M Massaro called the meting to order, statiug this has been reconvenedfrom March 13, 1980. ITEM #1. "TAMARAC UTILITIES - Status Report - Operations - Discussion and pcssible action Synopsis of Action.: Billing process to be reviewed, etc., and full discussion re: lifting of moratorium to be held 3/19/80. Mr. Gross, the City Manager, said he had been working diligently with the Engineering and Utility Departments to lower the infiltration into the sewer system and was pleased to report that although allowed to spend $52,000.00, only $10,000.00 has been spent to start the rehabilitation of the system. Mr. Gross said that as of last night the amount of in- filtration has been reduced. He went on to give statistics regarding the amount reduced. The contractor is now working in Section 23 of the City, he said, and explained that was where the lines were built so that they would go to a new plant to be built on Southgate Boulevard. Mr. Gross said that they expect to be able to reduce the infiltration further and with this knowledge, and the fact that the lines to the County have been tied in (but not in operation yet), Mr. Nolan recommends that the moratorium be lifted at this point. He said Mr. Nolan had also spoken to the County operation and they feel that the City should have no problem at this time in lifting the moratorium. Therefore,said Mr. Gross, it is his recommendation after speaking to the Engineering Department and the consultant engineers, that the moratorium be lifted. Questioned by C/M Disraelly as to what effect this would have on the agree- ments with developers currently developing, Mr. Gross replied that they would be asked to come in immediately to execute developers' agreements. C/M Disraelly then asked about availability charges. Mr. Birken said he would like to see the regulations in effect at the tim that the moratorium is lifted and whatever changes Council wants to make. Ordinance Temp. 726 should be in full force'and effect. C/M Disraelly mentioned a mem randm he had_written, wherein he stated that the system can function without Sec. 17 of the Ordinance which is the penalty provision. He said it may cost less in the long run to administer this, if that penalty provision of 10% is left out. C/M Disraelly added that he would suggest that no action be taken on this item regarding the moratorium until they pursue the rate case as the City Attorney had suggested, and then come back after they discuss the rates. V/M Massaro said she believes they should recess this meeting to get certain things straightened out and discuss rates that are applicable to developers, questions of the Sabal Palm agreement, etc. She felt the City should have certain things absolute regarding proper agree- ments, etc. V/M Massaro said she would not wish to take action until all aspects are discussed. Mr. Brinkley was recognized and said he wished to cooperate with the City, and had been here fairly often and there is no progress. He thought the City was to review the agreement and give comments back on it. They have made all the changes that the City has asked for, that are reasonable. V/M Massaro said they have been working diligently on this matter and asked if he could reappear tomorrow. Be 3/18/80 tz C/M Disraelly spoke of the billing process, adding that there seems to be three dates on the bills, one is the reading date, the second is the issuing date and the third date he was not sure about. Mr. Gross said that for expediency, they could pass this without the penalty date for present. C/W Kelch said she believes that time is of the eesence.
