The City Attorney indicated he spoke with Mr. Tralins, Attorney for
Leadership. He said Mr Tralins is meeting with Mr. Yehuda Ben:..Arieh
President of Leadership Housing, and no final decision has been made.
Mr. Tralins has recommended that the taxes be paid on the canal parcels
and the right-of-way parcels. In addition, Mr. Tralins said parcel 18
and parcel 4, which are on a canal, are scheduled for a tax sale on
Wednesday. This recommendation is for all parcels.where there is a
canal or road right--of-way. (4,8,11,12,14,15,18,23 and 26) Mr. Birken
explained there was a question about some of the pump stations and that
the city expects #36, if there was a lift station there, to be paid and
dedicated to the city. There was a question about #34.
The City Manager indicated there is no lift station on #36. It is an
F.P.L. transformer, and there are also some irrigation meters for some of the
homes in the area. On #28 there is a lift station and a pump. (Mainlands #3)
The City Attorney said he expects Leadership is going to pay the taxes on the
Parcels mentioned above. They are obligated to accept, by virtue of that
agreement of July 31st, 1979, wherein they say they will give the city the
canals, and the city would accept the responsibility for the canals and the
roads. He further said assuming they do this, then it is incumbent upon the
city to see that those monies are paid tomorrow. (at least on the property
that is up for tax sale) If Leadership does not agree, then Mr. Birken
reccm-nended authority be given to him to try to go into Circuit Court and
obtain a declaratory judgment and an injunction against the sale on Wednesday.
He added if he is not successful, then he would recommend that the city
authorize the staff to bid on the property Wednesday and that the city
endeavored to offset any cost that they have to Leadership at some point in
time. The Vice Mayor said she would like to see Councilman Disraelly go with
the City Attorney.
Mr. Birken added there are certain parcels which the city contracted for which
the City has agreed to take and Leadership has agreed to give us. Those need
be resolved.
The Vice Mayor explained #24 and #25 are not the entrances to the Mainlands.
They are at the other side of the canal and they are part of the person's
property.
Councilwoman Kelch indicated that the City does not need (24 & 25)
for canal easement for maintenance purposes because the City
owns the property on the other side of the canal.
The City Attorney recommended the property owners get in touch with Mr. Tralins
and if they are willing to pay the taxes so Leadership pays it to the county
Leadership would probably give them a quit claim deed.
In response to a question raised by Councilwoman Kelch the City Manager responded
someone will be going out to parcel #22 where the road was built.
The Vice Mayor requested a motion be made to recess the meeting until tomorrow.
The City Attorney advised if they are going to pay the taxes it would not be
necessary to reconvene the meeting. If he hears from them tonight, he would
aet in touch with all councilttwmlPrs and notifv them as to whether or not they

The Vice Mayor spoke about the developers having problems
financing utility hook-ups. She stated the developers would
prefer to pay for the hook-ups phase by phase as the buildings
go up.
Mr. Gross recommended that a developer borrow money from the
City at 1°; above the prime rate and that would be for a
3 month period, which would be renewable.
C/M Zemel clarified the situation by stating that for instance -
a six phase development would pay in advance for the first phase
plus interest that would be set for 3 months on the balance
of the phases.
The meeting was recessed until 8:00 A.M. the next morning.
