HomeMy WebLinkAbout2005-03-29 - City Commission Neighborhood Homeowner Association Meeting Meeting MinutesVice Mayor Beth Flansbaum-Talabisco District 2 Homeowner Association Meeting Tuesday, March 29, 2005 Vice Mayor Beth Flansbaum-Talabisco opened the District 2 Homeowner Association meeting on Tuesdg, March 29, 2005, at 9:30 a.m. in Room 105 of Tamarac City Hall, 7525 NW 88t Avenue, Tamarac, Florida. Present: Vice Mayor Flansbaum-Talabisco, Deputy City Manager Michael C. Cernech, Community Development Director J. Christopher King, City Attorney Mitchell S. Kraft, and City Clerk Marion Swenson. Vice Mayor Talabisco introduced Administrative Coordinator Marie Abbandando. Present and representing the Homeowner Associations: Russell Morrison, Plum Harbor Sonya L. Brown, Plum Harbor/Plum Master Marian Tenner, Woodlands Homeowner Association Tony Vick, Woodlands Homeowner Association Jack Talabisco, Woodlands Homeowner Association Ellie Petardi, Fairhaven 11 Clarice Smith, Fairhaven 11 Mary Maguire, Mainlands Section 8 Joanne Boggus, Mainlands Section 8 Ronn Hornsby, Mainlands Section 9 Juan A. Serrano, Mainlands Section 10 John S. Zangara, Green Haven 12 Irene Persico, Green Haven 12 Jeannette Eschenbrenner, Mainlands Section 9 Dolly Dellon, Woodlands Homeowner Association Section 7 Vice Mayor Flansbaum-Talabisco's opened the session and stated: • Today's meeting is the second "think tank" session • District 2 leaders, as well as other community leaders are community patriots • Vice Mayor Talabisco read excerpts from a "Little Blue Book of Big Ideas", a book she obtained while in attendance at a seminar in Savannah, Georgia • It is expected that this meeting will bring together people who care about and whose desire it is to maintain and sustain the community • Vice Mayor Talabisco suggested these meetings be held quarterly • At the first session in September it was decided among those in attendance to split future meetings between Homeowner and Condominium Associations District 2 Meeting Tuesday, March 29, 2005 Page 1 of 5 At Vice Mayor Flansbaum-Talab isco's request, the District 2 attendees introduced themselves. (The attached sign -in sheet is indicative of those in attendance.) Vice Mayor Flansbaum-Talabisco made the following comments: • The purpose of today's meeting is to share and exchange ideas • Those in attendance are the community leaders • It is important for the community leaders to use each other as resources • Vice Mayor Talabisco is available seven days a week. Vice Mayor Flansbaum-Talabisco gave a project update for District 2: • Washington Mutual Plaza • Cheddars Casual Cafe • Main Stay Suites expansion • Woodlands Villas • Cypress Walk • University Landings • Riverwalk • Hampton Hills Vice Mayor Talabisco gave an update on citywide projects • Southgate Linear Park • Veterans Park Improvements • Tamarac Commons • Shather property purchase • Cummings property purchase • Aquatic Center • Public art dedication May 7th — Tamarac Community Center Jack Talabisco, Woodlands Homeowners Association, and John Zangara, Green Haven 12 spoke about Comcast Cablevision and the problems encountered with regard to contract negotiations. There was discussion about the cost of cablevision and the fact that the cable company wanted 100% of the community to sign up. If all homes in the community do not choose Comcast Cablevision, those selecting Comcast Cablevision will have to bear the cost of those not utilizing Comcast. Ellie Petardi, Fairhaven 11 said some can not afford cable vision and some do not stay in South Florida all year. Dolly Dellon, Woodlands Section 7 said the group rate is still cheaper in the long run. District 2 Meeting Tuesday, March 29, 2005 Page 2 of 5 Jack Talabisco, Woodlands Homeowners Association added that some people in the Woodlands have Comcast and do not pay for it but Comcast refused to disconnect those homes. This may be occurring in other communities also. John Zangara, Green Haven 12 added if a property goes into foreclosure, the cable bill must still be paid. Russell Morrison, Plum Harbor said many in his community have satellite dishes. Sonya Brown, Plum Harbor/Plum Master spoke about the cost for Comcast Cablevision. Joanne Boggus, Mainlands 8 said her community rejected Comcast Cablevision; then the cable company lowered the price for installation and finally offered to install at no cost, but the community stood firm. Mary Maguire, Mainlands Section 8 said with satellite dishes there are more options — more companies to choose from and better, less costly service. John Zangara, Green Haven 12 said he believes the wires belong to the cable company. Vice Mayor Talabisco said many communities are in various stages of negotiations with Comcast, and the communities should keep each other informed of their progress. Juan Serrano, Mainlands 10, spoke of parking concerns in his community. Mr. Serrano said parking on the grass brings down the value of the community; people ignore Code Enforcement and renovate homes without permits. Jeannette Eschenbrenner, Mainlands 9 said there is nothing in the Tamarac Code with regard to parking on the grass; however, the individual associations may have rules about it. Dolly Dellon, Section 7 mentioned that she had called the Sheriff to cite residents who allowed parking on their lawns. Joanne Boggus, Mainlands 8, spoke about city codes not keeping pace with growth. There are quality of life issues, and she hoped with the reinstatement of the restrictive covenants things would change. Juan Serrano, Mainlands 10 added that in his section people are not to park on the grass, which brings up the issue of where are they to park? Ronn Hornsby, Mainlands Section 9 said a few years ago the rules and regulations were amended to include a fine for parking on the grass. Mr. District 2 Meeting Tuesday, March 29, 2005 Page 3 of 5 Hornsby said the city's code is good as it pertains to roof cleaning; however, the city needs to help with enforcement of deed restrictions. Joanne Boggus, Mainlands 8 and Ellie Petardi, Fairhaven 11 spoke of reinstatement of their restrictive covenants. Jack Talabisco, Woodlands Homeowners Association, spoke of the upcoming meeting in Tallahassee regarding the proposed House Bills and the fact that homeowner and condominium associations would be lumped together. City Attorney Kraft explained the proposed Bills are to prevent `fine foreclosures' which become emotional issues. John Zangara, Green Haven 12 said the new Ombudsman Bill is a nightmare. Vice Mayor Talabisco reminded everyone that Ari Porth is our State Representative and they should feel free to contact him. Community Development Director King spoke about parking on the grass and said the Tamarac code does not prohibit parking on grass unless the parking damages the lawn. If a Code officer is called and sees damage to the lawn procedures can be started; there is a process for remedy which can take several months before the matter comes before the Special Magistrate or Code Enforcement Board. Vice Mayor Talabisco explained the Code Department is now called Code Compliance, and they try to work with people to bring them into compliance. Joanne Boggus, Mainlands 8 asked what it takes to create an ordinance, and City Attorney Kraft explained it is an act of the Mayor and City Commission and the ordinance must go before the Mayor and City Commission for two readings. The impact to the community must be analyzed; what will work and what is the best solution for the community. Passing codes people can not live with does not solve the problem. Joanne Boggus, Mainlands 8 spoke of the dangers of leaving hurricane shutters on buildings and added that other cities have addressed this matter. Additionally, Ms. Boggus spoke of the fact that Tamarac Code does not direct that broken windows must be replaced with glass, and spoke of holiday ornaments left on buildings long after the holiday has passed. Sonya Brown, Plum Harbor/Plum Master said her community has rules and regulations that state the decorations and shutters must come down within a certain period of time. Mary Maguire, Mainlands 8 spoke of a vehicle parked in a resident's back yard and residents coming onto their property through the back over easements. District 2 Meeting Tuesday, March 29, 2005 Page 4 of 5 Deputy City Manager Cernech asked for the address of the property and added that Code Compliance, rather than BSO should be contacted. Deputy City Manager Cernech said he would have Code Compliance investigate the matter. Ellie Petardi, Fairhaven 11 and John Zangara, Green Haven 12 spoke of individual situations that occurred in their communities, and Vice Mayor Talabisco said she is available to discuss these matters individually with the representatives of the communities affected. Vice Mayor Talabisco stated that she wants to continue the type of dialogue that was held today again in July. Vice Mayor Talabisco added she would talk to staff about the various issues discussed, and she would research the matters and see what can be done. Vice Mayor Talabisco said she would like an update from the communities with regard to their progress with the covenants. Woodlands was the first community in Florida to work on its covenants and it took three years and much money to get it accomplished. Additionally, Woodlands pays a lot of money for special detail from 6:00 a.m. — 10:00 p.m. Vice Mayor Talabisco asked if there are any issues that the group would like to consider for discussion in July and Sonya Brown, Plum Harbor/Plum Master said she would like to have a listing of a local pool of craftsmen and asked if any other communities are having trouble with the U.S. Postal Service misdirecting mail. Vice Mayor Talabisco said all present would get a copy of the minutes and sign - in sheet to facilitate communication between communities.
