HomeMy WebLinkAbout2018-01-10 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, JANUARY 10, 2018 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7:15 p.m. on Wednesday, January 10, 2018, in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Michelle J. Gomez, Commissioner Marlon Bolton, Commissioner Julie Fishman and Commissioner Debra Placko were in attendance. Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Commissioner Fishman led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation of a proclamation by Mayor Harry Dressler proclaiming January 19, 2018 as "Arbor Day". (Requested by Public Services Director Jack Strain) 2. CITY COMMISSION REPORTS: a. Commissioner Bolton: Commissioner Bolton wished everyone a Happy New Year and said he is looking forward to a good year in 2018. Commissioner Bolton said he spent the holidays working and went to a few events. Commissioner Bolton reported that he was very impressed with the Little Library concept that was recently unveiled at the Sports Complex and thanked Commissioner Fishman for bringing that idea forward and added that he looks forward to the for the unveiling of the Little Library at Caporella Park on January 29th. Commissioner Bolton said he took the opportunity to have an HOA meet and greet with the Presidents of those associations at a lunch where they exchanged ideas and gifts. Commissioner Bolton said he met with the President of the Central Parc HOA and tomorrow night they will have an HOA meeting and invited Mayor Dressler to attend. Commissioner Bolton announced he has been appointed to the Broward League of Cities Youth Leadership Committee and the National League of Cities Public Safety and Crime Prevention Committee and said he looks forward to serving of these committees and bringing back information for the Commission. b. Vice Mayor Gomez: Vice Mayor Gomez wished everyone a Happy New Year and noted she is looking forward to a good 2018. Vice Mayor Gomez thanked everyone for their emails and texts congratulating her for being appointed Vice Mayor. Vice Mayor Gomez said she attended the Jewish Federation Annual Breakfast and the Paws With Claus Holiday Paw-ty. Vice Mayor Gomez announced that she has been reappointed to the National League of Cities Transportation Infrastructure & Services Policy and Advocacy Committee. c. Commissioner Fishman: Commissioner Fishman wished everyone a Happy New Year and said she is looking forward to a wonderful 2018. Commissioner Fishman thanked everyone who reached out to her and her family on the passing of her father. Commissioner Fishman said she attended the unveiling of the Little Library at the Sports Complex, is looking forward to the second unveiling at Caporella Park and talked about the concept of the Little Library ensuring that children have access to books. Commissioner Fishman said she also attended Page 1 of 6 COMMISSION MEETING January 10, 2018 the African American Club Holiday Party, the Snow Birds Club meeting, Men's Club After Holiday Party, met with the new President of Kings Point, several HOA meetings, the Jewish Federation Annual Breakfast, the Human Rights Board meeting and met with Eric Gomez, the Manager of the Tamarac Library. Commissioner Fishman said she is very impressed with what the Tamarac Library offers and noted that 28,000 to 30, 000 people use the library every month which makes it the fifth busiest library in Broward County. Commissioner Fishman noted that this is the 15th Anniversary for the library and is looking forward to some of the other things we can do with the library. d. Commissioner Placko: Commissioner Placko said she hoped everyone had a lovely holiday season and Happy New Year. Commissioner Placko said she attended a lot of HOA meetings where new board members were elected and congratulated everyone elected or who served on a board. Commissioner Placko said she will be attending more HOA meetings next week. Commissioner Placko said she is a large supporter of Family Central and recently County Commissioner Udine sponsored a pizza party for 82 children and their families where Commissioner Udine's children handed out gifts for the children. Commissioner Placko noted she and a group of women went to a day care center and distributed gifts to the children. Commissioner Placko reported that she is honored to have been appointed to the ADRC Advisory Board which was formerly chaired by former Vice Mayor Diane Glasser. Vice Mayor Gomez asked if HOA boards are changing to contact the Community Development with the updated information. e. Mayor Dressler: Mayor Dressler said he tries to attend all the meetings in Tamarac but unfortunately he cannot. Mayor Dressler said he attended the ribbon cutting ceremony for the new 7-Eleven and the African American Club meeting in Kings Point. Mayor Dressler said one of the things he does as Mayor is to have a initiative that will help a lot of people in 2018 and he will introduce Tamarac's Hispanic Unity Citizenship program to other cities in Broward County. Mayor Dressler talked about his mother's experience as an immigrant and the contribution that immigrants have made to this country. Mayor Dressler reported that tomorrow he will be swearing in the new board for the Tamarac — North Lauderdale Chamber of Commerce. 3. CITY ATTORNEY REPORT: City Attorney Goren talked about the 2,d edition of his office's report regarding pending legislation which is in a more readable format and more accessible. City Attorney Goren said everyone has been provided a link for the document as it is currently at 102 pages. City Attorney Goren highlighted several bills, many of which have an impact on home rule; i.e., vacation rentals, drone regulation, tree removal, texting while driving, red light cameras and municipal officials filing a Form 6 in lieu of a Form 1 which they currently file. City Attorney Goren said there is one bill that is OK relative to allowing imminent litigation shade sessions. There are also several bills sunsetting CRA's; private property rights and a Comprehensive Plan and some public records bills that are onerous. City Attorney Goren said he welcomes comments and questions from the Commission. City Attorney Goren said there are more bills filed this year than last session. City Attorney Goren said this year's session began yesterday and his office will continue to monitor what is going on. City Attorney Goren suggested that the Commission make their voices heard in Tallahassee because there are bills that are scary. 4. CITY MANAGER REPORT: City Manager Cernech wished everyone a Happy New Year. City Manager Cernech reported that Assistant Chief Jeff Moral has been chosen to receive Page 2 of 6 COMMISSION MEETING January 10, 2018 the Fire Marshal of the year award which will be presented at the opening ceremony at Fire - Rescue East in Daytona Beach on January 17, 2018. City Manager Cernech added that Assistant Fire Chief Moral has worked for Tamarac for a long time and has worked on succession planning. Assistant Fire Chief Moral took a division of Fire Rescue and transferred that area by recruiting people in the department as inspectors. City Manager Cernech, invited people to the Meet the Artist Reception for Terri A. Meredith, in honor of Dr. Martin Luther King Day on January 11th from 6:30 p.m. to 8.00 p.m. There will also be a special performance featuring the Ashanti Cultural Arts and light refreshments will be served. City Manager Cernech invited everyone to the ribbon cutting ceremony celebrating the new Public Art Fence at Sunset Point Park on January 16th at 3.30 p.m. Light refreshments will be served. City Manager Cernech said the Tamarac Park Playground will undergo renovations beginning later this fall. The project includes the demolition and replacement of the existing playground, safety surfacing and shade structure along with new benches and a large hexagon shelter located outside the playground area. Commissioner Placko asked if anyone has information relative to Tamarac residents that are 100 years old to contact the Historical Society and let them know as there will be a luncheon honoring the Centennial individuals. 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and with no one wishing to speak, closed Public Participation. 6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any changes/additions to the Consent Agenda and City Manager Cernech said there were no changes/additions to the Consent Agenda. Commissioner Fishman asked that item 6 (i) TR13051 be pulled from the Consent Agenda for discussion. City Attorney Goren read TR13051 by title into the record. Commissioner Fishman asked the Commission to add "Friends of Tamarac Library" to the list of Charitable Entities. Vice Mayor Gomez seconded by Commissioner Fishman moved approval to add "Friends of Tamarac Library" to the list of Charitable Entities. Motion passed unanimously (5-0). Vice Mayor Gomez seconded by Commissioner Placko moved approval of the Consent Agenda with TR13051 as amended. Motion passed unanimously (5-0). a. Approval of the December 13, 2017 Regular Commission Meeting Minutes - APPROVED b. TR13053 - Supporting and Adopting the Broward County December 2017 Multi - Jurisdictional Local Mitigation Strategy A Resolution of the City Commission of the City of Tamarac, Florida supporting and adopting the Broward County December 2017 Multi - Jurisdictional Enhanced Local Mitigation Strategy (ELMS) Plan (Exhibit A); providing for conflicts; providing severability; and providing for an effective date. RESOLUTION R-2018-01 c. TR13054 - Pine Island Pedestrian Crossings Design (TA No. 18-07D): A Resolution of the City Commission of the City of Tamarac, Florida, approving execution of Task Authorization No. 18-07D with McMahon Associates, Inc. to provide Transportation Engineering Services for the Pine Island Pedestrian/Golf Cart Crossings Design, in accordance with the City's Continuing Service Agreement as authorized by Resolution R-2016-80; authorizing an Page 3 of 6 COMMISSION MEETING January 10, 2018 expenditure for said purpose in an amount not to exceed $71,820.00 per the Task Authorization No. 18-07D, a contingency in the amount of $14,364.00 (20%) will be added to the account for a project total of $86,184.00; providing for conflict; providing for severability; and providing for an effective date. RESOLUTION R-2018-02 d. TR13036 - Authorize Purchase of New and Replacement Vehicles for FY 2018: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the purchase of new and replacement vehicles and equipment utilizing competitive procurement methods and current Agreements available for cooperative purchase at the time of purchase, including the Agreement awarded by the Florida Sheriff's Association, the National IPA Contract No. 120535, and REV Technical Center, in the best interest of the City; authorizing the appropriate City Officials to select, approve, and award the purchase of said equipment and vehicles utilizing current Agreements available for cooperative purchase at the time of purchase in the best interest of the City; authorizing an expenditure in an amount not to exceed $2,022,460.00 from the appropriate accounts for all vehicles and equipment; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-03 e. TR13009 - Temp Labor Extension: A Resolution of the City Commission of the City of Tamarac, Florida authorizing the appropriate City Staff to select, approve, and award the purchase of Temporary Labor Services utilizing the Southeast Florida Governmental Purchasing Cooperative (Bid Number 13-D-140f), through the City of Coral Springs including Tampa Service Co., Inc. D/B/A Pacesetter Personnel Services, Albion Staffing Solutions, and Alpha 1 Staffing; authorizing expenditures for Temporary Labor Services for canal maintenance workers, pressure cleaning, and temporary labor in an amount not to exceed $210,000.00 annually from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-04 f. TR13047 - FEMA Policy Changes: A Resolution of the City Commission of the City of Tamarac, Florida, urging the Federal Emergency Management Agency ("FEMA") to change FEMA's policy requiring pre -approval for disaster debris removal from private roads and treat disaster debris removal from private roads in residential communities in the same manner as public roads for the purpose of FEMA reimbursement for disaster debris removal costs; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-05 g. TR13041 - Buffer Wall Phase IV Design: A Resolution of the City Commission of the City of Tamarac, Florida, approving execution of Task Authorization No. 18-04D with Stantec Consulting Services Inc. To provide professional engineering services for the design and permitting of the Citywide Buffer Wall Project, Phase IV, which is generally located on the north side of NW 57th Street between NW 64th Avenue and Pine Island Road, and the west side of NW 64th Avenue between NW 57th Street and NW 58th Street, in accordance with the City's Continuing Service Agreement as authorized by Resolution R-2016-80; authorizing an appropriation in the amount of $18,619.00 which will be included in a Budget Amendment in April 2018 pursuant to F.S. 166.241(2); authorizing an expenditure for said purpose in an amount not to exceed $158,800.00-1 providing for conflict, providing for severability; and providing for an effective date. RESOLUTION R-2018-06 Page 4 of 6 COMMISSION MEETING January 10, 2018 h. TR13045 - Sunshine Plaza First Amendment to the Water and Sewer Developer's Agreement A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to accept and execute a First Amendment To The Water and Sewer Developer's Agreement with Sunshine MZL LLC, for the Sunshine Plaza, located at 4017 West Commercial Blvd., requiring an increase of 1 ERC for water and 1 ERC for sewer; requiring additional payment of $1,700.00 for water and $2,200.00 for sewer, in CIAC fees; authorizing and directing the City Clerk to record said agreement in the public records of Broward County; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-07 i. TR13051 - Amending Charitable Entities: A Resolution of the City Commission of the city of Tamarac, Florida, amending Resolution R-2017-91, by specifically adding to the list of charitable entities with whom the City of Tamarac recognizes a formally approved relationship; providing for an amended Exhibit "A", attached hereto and incorporated herein, as may be amended from time to time, for the expressed purpose of compliance with Section 1-19(c)(5)(a)(4) of the Broward County Code of Ordinances; providing for conflicts; providing for severability and providing for an effective date. RESOLUTION R-2018-08 7. REGULAR AGENDA: There were no Regular Agenda items scheduled for this meeting. 8. ORDINANCE(S) - FIRST READING: a. TO2372 - Safeguard Self -Storage Rezoning: An Ordinance of the City Commission of the City of Tamarac, Florida, amending the Official Zoning Map of the City Of Tamarac referenced in Section 24-3 of Chapter 24 of the City Of Tamarac Code Of Ordinances to reflect the rezoning of certain real estate property described as a portion of Tract 13 Section 11, Township 49 South, Range 41 East, of Fort Lauderdale Truck Farms, as recorded in Plat Book 4, page 31 of the Public Records Of Broward County, Florida and a portion of Parcel "A" and Parcel "B", the Fountains Corporate Center, as recorded in Plat Book 139, Page 44, of the Public Records Of Broward County, Florida, more legally described in Exhibit "A", from the current B-1 (Neighborhood Business District) and B-2 (Planned Community Business District) respectively to B-3 (General Business District) zoning classification, for the subject properties located at 6101 and 6203 W Commercial Blvd., in order to provide consistency with the land development regulations in accordance with the intent of the Comprehensive Plan of the City Of Tamarac; (Case No. 9-Z-17); providing for amendment to the Official Zoning Map to reflect such change; providing for conflicts; providing for severability; and providing for an effective date. City Attorney Goren read TO2372 by title into the record. Commissioner Placko seconded by Commissioner Bolton moved approval of TO2372 on first reading. Community Development Director Calloway appeared and gave a brief presentation, a copy of which is on file in the City Clerk's Office. Attorney Dennis Mele appeared on behalf of the applicant.
