HomeMy WebLinkAbout2018-11-14 - City Commission Regular Meeting MinutesCITY OF TAMARAC CITY COMMISSION MEETING WEDNESDAY, NOVEMBER 14, 2018 CALL TO ORDER: Mayor Harry Dressler called the Commission Meeting of the City of Tamarac to order at 7.13 p.m. on Wednesday, November 14, 2018, in City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321. ROLL CALL: Mayor Harry Dressler, Vice Mayor Michelle J. Gomez, Commissioner Marlon Bolton, Commissioner Julie Fishman (via phone) and Commissioner Debra Placko were in attendance. Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren and City Clerk Patricia A. Teufel. PLEDGE OF ALLEGIANCE: Commissioner Bolton led the Pledge of Allegiance. 1. PROCLAMATIONS AND PRESENTATIONS: Mayor Dressler advised that Quasi -Judicial items 11 (a) T02388 and 11 (b) T02387 are being deferred to the December 12, 2018 Commission Meeting at the request of the applicant. City Attorney Goren noted for the record that these items have been posted and advertised. City Attorney Goren read T02388 and T02387 by title into the record and reiterated that they are being deferred to the December 12, 2018 Commission Meeting at the request of the applicant. City Manager Cernech said we have a secret Proclamation for Mayor Dressler from the Mayor Elect. Vice Mayor Gomez read the Proclamation into the record and the Commission presented a ceremonial gavel to Mayor Dressler. 2. CITY COMMISSION REPORTS: a. Commissioner Bolton: Commissioner Bolton said the last two weeks have been very interesting and culminated with the Veterans Day Ceremony. Commissioner Bolton said he goes out and knocks on doors, and when he knocks on a Veteran's door it changes his perspective on why he does this. Commissioner Bolton said he is proud to be an American. Commissioner Bolton said he met a Veteran who brought him to his bedroom and showed him a whole wall that was dedicated to his service in the military. Commissioner Bolton talked about the sacrifices Veterans and military families make. Commissioner Bolton said today is the last meeting that he will serve with Mayor Dressler and talked about how his experience was serving with Mayor Dressler for the last two years and his respect for Mayor Dressler. Commissioner Bolton talked about Mayor Dressler's contribution and leadership for the City of Tamarac and added that he looked up to Mayor Dressler. Vice Mayor Gomez: Vice Mayor Gomez said despite the early voting and election day itself, she spent approximately 146 hours at the polls since the last Commission Meeting of October 24, 2018 and there were still other meetings and events that she attended. Vice Mayor Gomez said she attended the Kings Point African American Club's function; the Mayor's Chess Challenge; was at City Hall to see the Veterans off for their Honor Flight to Washington, D.C.; the Veterans Day Ceremony; the first Annual Kings Point Annual Veteran's Day Event where she received plaques appointing both her and Commissioner Fishman as Honorary Members of the Kings Points Veterans Club. Vice Mayor Gomez said she looks forward to seeing people at the Turkey Page 1 of 6 COMMISSION MEETING November 14, 2018 Trot and talked about things she is grateful for in her life and wished everyone a Happy Thanksgiving. c. Commissioner Fishman: Commissioner Fishman thanked Vice Mayor Gomez for accepting and letting her know about the Plaques from the Kings Point Veteran's Club. Commissioner Fishman thanked Mayor Dressler for the last two years of him teaching her how to be a good public servant for the City of Tamarac. d. Commissioner Placko: Commissioner Placko said she spent 180 hours talking with residents and heard a lot of good things about City staff. She also learned of issues that she did not know about. Commissioner Placko thanked everyone who came out and voted. Commissioner Placko attended the Veterans Day Ceremony and invited people to come out for the Turkey Trot. Commissioner Placko thanked everyone who she reached out to for Thanksgiving baskets as this is the most we have collected to date so far. This proves how caring Tamarac residents are and who provide for people who are not as well off. e. Mayor Dressler: Mayor Dressler congratulated Mike Gelin on his election as Commissioner for District 2 and noted that his experience will be a benefit to the City of Tamarac. Mayor Dressler talked about Bob Hope and his song "Thanks for the Memories" when he visited the troops. Mayor Dressler thanked everyone for allowing him to serve the City of Tamarac. 3. CITY ATTORNEY REPORT: City Attorney Goren thanked everyone for giving him the opportunity earlier today to say a few words about Mayor Dressler. City Attorney Goren said Mayor Dressler was the first non -lawyer Florida Supreme Court Mediator to become a Certified Mediator and talked about his experience when he attended a mediation with Mayor Dressler. City Attorney Goren said there were 11 Charter Review Amendments on the November 6, 2018 ballot and all passed over the 60% that is required. One Amendment received almost 80% relative to the posting of Notices, Agenda and Backup Materials no later than 48 hours prior to a meeting. City Attorney Goren read the Amendment by title into the record. City Attorney Goren said Tamarac already complies with the Amendment and we will talk more about this in the future. City Attorney Goren wished everyone a Happy and Healthy Thanksgiving. City Attorney Goren wished Mayor Dressler the best of good luck and health and hopes he enjoys his retirement. 4. CITY MANAGER REPORT: City Manager Cernech said he echoes the sentiments expressed by the Commission and said it was a pleasure to serve with Mayor Dressler and he appreciates Mayor Dressler's support over the last 12 years. Upcoming Events: City Manager Cernech said registration for the Tamarac Turkey Trot 5K is underway. The Race happens on Thanksgiving morning, Thursday, November 22nd at 7:30 a.m., beginning at Tamarac City Hall. Commemorative T-shirts are guaranteed to the first 1,800 participants who pick up their packets with finish medals to all race finishers. This year's registration is online at www.active.com. Early registration ends November 9th: $25; late registration is November 10th — November 21 st - $30; and race day registration on November 22nd - $50. City Manager Cernech invited people to the Holiday Lighting Festival on Wednesday, December 5, 2018 at the Community Center starting at 6:00 p.m. This free event includes the lighting of the Christmas Tree and Menorah, Holiday Programs, a Magician and a special appearance by Santa Claus, Olaf and Friends. Page 2 of 6 COMMISSION MEETING November 14, 2018 City Manager Cernech reported there were 500 guests in attendance at the Veteran's Day Ceremony on Sunday November 11tn at Veterans' Memorial Park and a new panel of the Veteran's Honor Wall was unveiled. City Manager Cernech said Public Services has reported that the Dog Park Project started on Monday, November 12, 2018 and the Park will be closed until December 14, 2018. The Park will be reopened on Saturday, December 15, 2018 for the Holiday (Santa) event in the Dog Park. Tamarac will be hosting a Household Hazardous Waste/Electronics drop-off event on Saturday, December 1st at the Public Services Complex from 9:00 a.m. to 2:00 p.m. Tamarac partners with Coconut Creek, Coral Springs, Fort Lauderdale, Lauderdale -by -the -Sea, Lauderdale Lakes, No. Lauderdale and Pompano Beach for Hazardous Household Waste and E-Waste collection and proper disposal and recycling. City Manager Cernech reported that as part of the comprehensive signage program, the City is moving forward with the placement of the following two neighborhood signs (Pineapple Park and Westwood 5). Pineapple park will start on November 26th and will be completed on November 30tn. Westwood 5 will start on December 3rd and will be completed on December 7tn 5. PUBLIC PARTICIPATION: Mayor Dressler opened Public Participation and the following individuals spoke: Jeffrey Shapiro, 6104 Orchard Tree Lane, talked about problems he was having on his block with delivery of mail and Mayor Dressler suggested he contact his Congressman. Ron Wasserman, 8577 Jade Lane, talked about various items. Bissan Abuadieh, 8302 NW 80tn PI., talked about a rumor she heard about replacing city employees with private contractors and her experience during the recent election. 6. CONSENT AGENDA: Mayor Dressler asked City Manager Cernech if there were any changes/additions to the Consent Agenda and City Manager Cernech said there were no changes/additions to the Consent Agenda. Vice Mayor Gomez seconded by Commissioner Bolton moved approval of the Consent Agenda as presented. Motion passed unanimously (5-0). a. TR13204 - Resolution in Support of the City of Sunrise 94th Avenue Bike Path — CSLIP Project: A Resolution of the City Commission of the City of Tamarac, Florida, in support of the City of Sunrise's Complete Streets and Other Localized Initiatives Program Application to add bike lanes, sidewalks, curbs and gutters along NW 94th Avenue within the City of Sunrise's right of way and the City of Tamarac Right of Way, between Commercial Boulevard and NW 57th Street; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-147 b. TR13203 -Amendment No. 1 to the Landscape MMOA for the 7-Eleven property at Commercial / 441: A Resolution of the City Commission of the City of Tamarac, Florida approving Amendment No. 1 to the Landscape Maintenance Memorandum of Agreement (MMOA) between the City of Tamarac and the State of Florida Department of Transportation (FDOT) for the section of State Road 870 Commercial Boulevard from Milepost 3.150 to Milepost 3.221, to amend the limits to include State Road 7 (US 441) from Milepost 14.748 to Milepost 14.796; authorizing the appropriate City Officials to execute said Amendment No. 1 to the Landscape Memorandum of Agreement, pending legal review between FDOT and the City of Tamarac, for landscape improvements on State Road 7 (US 441) between Milepost 14.748 and Milepost 14.796; providing for conflicts; providing for severability, and providing for an effective date. RESOLUTION R-2018-148 Page 3 of 6 COMMISSION MEETING November 14, 2018 c. TR13202 - Award of Bid No. 18-25B for the NW 51st Court Road Construction Project: A Resolution of the City Commission of the City of Tamarac, Florida, awarding Bid No. 18-25B to and approving an Agreement with FG Construction, LLC for the NW 51 st Court Resurfacing Project, in accordance with Bid No. 18-25B for a contract amount of $114,236.90; a contingency in the amount of $11,423.69 will be added to the project account for a total project budget of $125,660.59; authorizing an expenditure from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-149 d. TR13163 - WTP WELLS 9, 15,16 & 17: A Resolution of the City Commission of the City of Tamarac, Florida, approves awarding a contract to AMPS, Inc. utilizing the Martin County Utilities Contract RFB Number 2017-2969 and authorizing the appropriate City Officials to execute a Purchase Order Agreement between the City of Tamarac and Aquifer Maintenance & Performance Systems, Inc. (AMPS, Inc.), utilizing pricing from an Agreement obtained through a formal competitive process by Martin County Utilities, Contract RFB Number 2017-2969 for an amount not to exceed $147,176.90 for the rehabilitation of four (4) raw water wells for the Water Treatment Plant; a contingency of 10% or $14,717.69 will be added to the project account for a total amount of $161,894.59; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-150 e. TR13205 - Fitness Court and National Fitness Campaign Resources: A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate City Officials to accept a grant from the National Fitness Campaign, LLC, in the amount of $15,000.00 and approve the purchase of a Fitness Court and National Fitness Campaign Resources from National Fitness Campaign, LLC, in an amount not to exceed $80,700.00; approving funding from the Capital Improvement Account; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2018-151 f. TR13210 2017 - 18 Justice Assistance Grant (JAG) Award and Memorandum of Understanding with BSO A Resolution of The City Commission of The City Of Tamarac, Florida accepting The 2017-2018 Edward Byrne Memorial Justice Assistance Grant (Jag) award in the amount of $14,108.00; authorizing the execution of the documents necessary to effectuate such acceptance; further authorizing the appropriate City Officials to execute A Memorandum Of Understanding between The City Of Tamarac and The Broward Sheriffs Office pending legal review; authorizing The Broward Sheriff's Office to continue to serve as the Lead Agency providing for the Administration of the 2017-18 Jag Grant Award; Providing For Conflicts; Providing For Severability; And Providing For An Effective Date. RESOLUTION R-2018-152 g. TR13208 - Amending Resolution R-2016-78-Auditing Services Agreement: A Resolution of the City Commission of the City of Tamarac, Florida, Amending Resolution R-2016-78 by approving a two thousand dollar ($2,000) increase to the annual expenditure authority for Financial Auditing Services awarded by the City Commission to RSM US LLP to one hundred five thousand five hundred dollars ($105,500) for year two (2), Nunc Pro Tunc, and one hundred eight thousand five hundred dollars ($108,500) per year for years three (3), four (4) and five (5) of the existing agreement for an amended aggregate amount of five hundred thirty-four thousand five hundred dollars ($534,500); authorizing the City Manager to authorize and approve any renewal options and adjustments in pricing not to exceed ten thousand dollars ($10,000) for the life of the agreement in accordance with the terms of the agreement awarded by the City Commission by Page 4 of 6 COMMISSION MEETING November 14, 2018 Resolution R-2016-78; providing for conflicts; providing for severability; and providing an effective date. RESOLUTION R-2018-153 7. REGULAR AGENDA: 8. ORDINANCE(S) - FIRST READING: Mayor Dressler said after a discussion on Monday at the Workshop there was a consensus to allow the City of Tamarac to provide an additional $25,000 Long-term Low -Income Senior Exemption. City Attorney Goren said we need a Motion and a second to add T02389 to the agenda for first reading. Commissioner Placko seconded by Commissioner Fishman moved approval of adding T02389 to the Agenda. City Attorney Goren read T02389 by title into the record a. An Ordinance of the City Commission of the City of Tamarac, Florida, amending the Tamarac Code of Ordinances by enacting Chapter 6, "Finance and Taxation", Article VII, to be entitled the "Senior Tax Exemption` providing for codification of Ordinance 0-2003-31 in Section 160(a); providing for codification; providing for conflicts; providing for severability; and providing for an effective date. Finance Director Mason gave a brief presentation, a copy of which is on file in the City Clerk's Office. Commissioner Bolton noted that one of the first things he asked about was this exemption because there are people that deserve this exemption. Motion passed unanimously (5-0) PASSED ON FIRST READING NOVEMBER 14, 2018 9. PUBLIC HEARING(S): There were no Public Hearing Items scheduled for this meeting. 10. ORDINANCE(S) - SECOND READING: a. T02386 - Amending Ordinance 2018-03 FY2018 Operating & Capital Budget: An Ordinance of the City Commission of the City of Tamarac, Florida, amending Ordinance 2018-03, which amended the City of Tamarac Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial Policies for the Fiscal Year 2018, by increasing the total revenues and expenditures by a total of $27,521,448, as detailed in Attachment A attached hereto and summarized in Attachment B; providing for conflicts; providing for severability; providing for an effective date. City Attorney Goren read T02386 by title into the record. Vice Mayor Gomez seconded by Commissioner Bolton moved approval of T02386 on second reading. Mayor Dressler opened the Public Hearing and with no one wishing to speak, closed the Public Hearing. Motion passed unanimously (5-0). PASSED ON FIRST READING OCTOBER 24, 2018 PASSED ON SECOND READING NOVEMBER 14, 2018 ORDINANCE NO. 0-2018-14 Commissioner Bolton said he would like to ask City Manager Cernech to put a workshop item together regarding the National League of Cities Prescription Discount Card which is given to residents of member cities. Commissioner Bolton asked City Manager Cernech to explore this and get more information from the National League of Cities. All were in agreement. 11. QUASI-JUDICIAL HEARING(S): Page 5 of 6 COMMISSION MEETING November 14, 2018 a. T02388 - Rock Island Self -Storage - Small Scale Land Use Plan Amendment An Ordinance of the City Commission of the City of Tamarac, Florida, adopting a Small Scale Local Land Use Plan Amendment to the City of Tamarac's Comprehensive Plan Future Land Use Map in accordance with Chapter 163, specifically Section 163.3187 of the Florida State Statutes, for an area of approximately 1.76 net acres in size, located on the northeast corner of West Commercial Boulevard and North Rock Island Road, originally addressed as 5101 West Commercial Boulevard, now referred to as 5602 North Rock Island Road, more specifically described as Tract "H" of "Saba) Palm by Prestige", according to the Plat thereof, as recorded in Plat Book 178, Page 71, of the public records of Broward County, and shown in Exhibit "A", to change the Future Land Use designation from "Medium -High Residential" to "Commercial" in order to allocate 3.02 gross Residential to Commercial Flex acres to facilitate the development of a self -storage facility, (Case No. 2-LUA-18) consistent with the intent of the City of Tamarac Comprehensive Plan; authorizing transmittal of the Small Scale Land Use Map Amendment to the Department of Economic Opportunity and the Broward County Planning Council for Recertification of the City of Tamarac Future Land Use Map; providing for amendment to the Future Land Use Map to reflect such change; providing for conflicts; providing for severability; and providing for an effective date. T02387 - Rock Island Self Storage — Rezoning: An Ordinance of the City Commission of the City of Tamarac, Florida, amending the Official Zoning Map of the City of Tamarac referenced in Section 10-2.1(b) of Chapter 10 of the City of Tamarac Code of Ordinances to reflect the Rezoning of certain real estate property described as Tract H of Sabal Palm by Prestige, as recorded in Plat Book 178, Pages 71 through 87 of the public records of Broward County, Florida more legally described in Exhibit "A", from the current RC (Recreation District) to MU-N (Mixed Use Neighborhood) zoning classification, for the subject property located at 5602 North Rock Island Road, in order to allocate 3.02 gross Residential to Commercial Flex Acres to facilitate the development of a self -storage facility and provide consistency with the Land Development Code in accordance with the intent of the Comprehensive Plan of the City of Tamarac; (Case No. 5-Z- 18); providing for amendment to the official zoning map to reflect such change; providing for conflicts; providing for severability; and providing for an effective date.
