ROLL CALL: PLEDGE OF ALLEGIANCE: Vice Mayor Marc L. Sultanof INTRODUCTION 1. PROCLAMATIONS AND PRESENTATIONS: a. Presentation by Mayor Schreiber of a proclamation proclaiming November 12, 2004 as "A Day Against Human Trafficking". 2. City Commission 3. City Attorney 4. City Manager REPORTS November 10, 2004 1 PUBLIC PARTICIPATION 5. PUBLIC PARTICIPATION - Any member of the public may speak to any issue which is not agendized for public hearing at this meeting. Speakers will be limited to three minutes during this item and at public hearings. There will be a thirty (30) minute aggregate time limit for this item, and speakers are encouraged to sign up in advance with the City Clerk prior to their participation. When an issue has been designated as quasi-judicial, public remarks shall only be heard during a quasi-judicial hearing that has been properly noticed for that matter. ANNOUNCEMENT OF TIME ALLOCATIONS -MOTIONS TO TABLE - The Chair at this time will announce those items which have been given a specific time to be heard, and will entertain motions from the Commission members to table those items which require research. The Commission may agendize by majority consent matters of an urgent nature which have come to the Commission's attention after publication. CONSENT AGENDA 6. Motion to adopt items 6(a) through 6(f). Items listed under Consent Agenda are viewed to be routine and the recommendation will be enacted by ONE MOTION in the form listed below. If discussion is desired, then, in accordance with Resolution 2003-15, Sec. 4.5, the item(s) will be removed from the Consent Agenda and will be considered separately. a. APPROVE the minutes of the October 27, 2004 Regular City Commission meeting. b. APPROVING LEGISLATIVE AGENDA FOR THE 2005 LEGISLATIVE SESSION: (TR10583) Approving the City of Tamarac Legislative Agenda for the 2005 Legislative Session; directing the City Clerk to send a copy of the City of Tamarac Legislative Agenda for the 2005 Legislative Session to the Broward County Legislative Delegation and the Broward County Board of County Commissioners for consideration. C. BSO PERMIT APPLICATION — SPECIAL DETAILS FOR POLICE SERVICES: (TR10574) Executing a Broward Sheriffs Office permit application for special details for police services to be used by the Parks and Recreation Department in an amount not to exceed $62,000 in FY 05; approving funding from the appropriate Parks and Recreation accounts. November 10, 2004 2 d. BID AWARD AND AGREEMENT - DUNBAR ARMORED INC.: (TR10569) Awarding Bid 04-26B, "Armored Car Services", and executing an agreement with Dunbar Armored, Inc. for a three-year term effective nunc pro tunc to 10/01/2004 through 9/30/2007, at a cost of $13,200 per year, not to exceed $39,600 for the three year term. e. INTERLOCAL AGREEMENT FOR MUTUAL BUILDING INSPECTION PLAN REVIEW BUILDING OFFICIAL OR OTHER SERVICES: (TR10580) Executing the Interlocal Agreement for Mutual Assistance between the City of Tamarac and the City of Margate for Building Inspection, Plan Review, Building Official, or other Services to be performed by the City of Margate Building Department or the City of Tamarac Building Department, services to be performed by either the City of Margate or the City of Tamarac in the event there is a staff shortage at a rate of forty dollars ($40.00) per hour for building code inspector, forty dollars ($40.00) per hour for plans examiner, fifty dollars ($50.00) per hour for temporary building official services, thirty dollars ($30.00) per hour for other building department services staff. BID AWARD AND AGREEMENT -- TAMARAC COMMONS PARK FOUNTAIN AND POOL: (TR10575) Awarding Bid No. 04-29B and executing an agreement with Superior Pools, Spas & Waterfalls, Inc., for the fountain and pool for Tamarac Commons Park for a total cost not to exceed $47,838.00; approving funding from the appropriate Parks and Recreation account. END OF CONSENT AGENDA REGULAR AGENDA ORDINANCE - FIRST READING 7. RE -DESIGNATING SPECIAL MASTER TO SPECIAL MAGISTRATE: (T02068) Motion to adopt Ordinance on first reading re -designating Special Master to Special Magistrate pursuant to Chapter 2004-11 Laws of Florida and providing that all references to Special Master in Tamarac Ordinances and Resolutions are changed to Special Magistrate. PUBLIC HEARINGS 7:00 P.M. OR THEREAFTER ORDINANCES - SECOND READINGS 8. AMENDING CHAPTER 7 OF THE TAMARAC CODE — ADOPTING FLORIDA FIRE PREVENTION CODE: (T02047) Motion to adopt Ordinance on second reading amending Chapter 7 of the City Code entitled, "Fire Prevention and Protection", Article III, "Standards", Section 7-48, "Fire Prevention Code — Adoption" and Section 7-50, "Appeals from Decisions of Fire Chief', to remove conflicts with the Florida Fire Prevention Code; providing for codification. APPROVED ON FIRST READING OCTOBER 27, 2004 November 10, 2004 3 9. AMENDING CHAPTER 10 OF THE TAMARAC CODE — DELETING CONFLICTS WITH THE FLORIDA FIRE PREVENTION CODE: (T02048) Motion to adopt Ordinance on second reading amending Chapter 10 of the City Code entitled, "Land Development Regulations", Article IV, "Standards and Criteria", Section 10-128, "Fire Protection", deleting sections of the City Code in conflict with the Florida Fire Prevention Code; providing for codification. APPROVED ON FIRST READING OCTOBER 27, 2004 10. AMENDING CHAPTER 24 OF THE TAMARAC CODE — DELETING CONFLICTS WITH THE FLORIDA FIRE PREVENTION CODE: (T02049) Motion to adopt Ordinance on second reading amending Chapter 24 of the City Code entitled, "Zoning", Article V, "Off -Street Parking and Loading", Section 24- 580, "Specifications", deleting sections of the City Code in conflict with the Florida Fire Prevention Code; providing for codification. APPROVED ON FIRST READING OCTOBER 27, 2004 11. AMENDMENT TO LAND USE ELEMENT OF COMPREHENSIVE PLAN — "WOODLANDS COUNTRY CLUB" PLAT: (T02044) Motion to adopt Ordinance on second reading adopting an amendment to the Land Use Element of the City Comprehensive Plan in accordance with Chapter 163, Sections 163.3184 and 163.3187 of the Florida Statutes, concerning a Small -Scale Land Use Plan Amendment proposal by United Homes International, Inc. to change the use of land described as a portion of the "Woodlands Country Club" Plat, according to the Plat thereof as recorded in Plat Book 67, Page 30 of the Public Records of Broward County, Florida, located at the north side of NW 441" Street approximately 3400 feet west of Rock Island Road, from Commercial Recreation to Low -Medium (5-10 du/ac) Residential to allow the construction of thirty (30) residential town home units comprising approximately of 2.67 net acres and 3.02 gross acres (Case No. 02-LUA-04); providing for amendment to the Land Use Element to reflect such change. APPROVED ON FIRST READING MAY 12, 2004 12. AMENDMENT TO LAND USE ELEMENT OF COMPREHENSIVE PLAN — SECTION 6, TOWNSHIP 49 SOUTH, RANGE 41 EAST: (T02045) Motion to adopt Ordinance on second reading adopting an amendment to the Land Use Element of the City Comprehensive Plan in accordance with Chapter 163, Sections 163.3184 and 163.3187 of the Florida Statutes, concerning a Small - Scale Land Use Plan Amendment proposal by United Homes International, Inc. to change the use of land described as a parcel of land lying in Section 6, Township 49 South, Range 41 East, Broward County, Florida, being more particularly described in Exhibit "A", located near the west end of Southgate Boulevard on the south side, from Utility to Low -Medium (5-10 du/ac) Residential to allow the construction of forty-four (44) residential town home units comprising approximately of 4.0 net acres and 4.40 gross acres (Case No. 03-LUA-04); providing for amendment to the Land Use Element to reflect such change. APPROVED ON FIRST READING MAY 12, 2004 November 10, 2004 4 QUASI-JUDICIAL HEARING 13. REVISED DEVELOPMENT ORDER AND MAJOR REVISED SITE PLAN — TOSHIBA BUSINESS SOLUTIONS: (TR10578) Motion to approve Resolution issuing Revised Development Order No. 318.4 and granting Major Revised Site Plan approval for Toshiba Business Solutions to increase the water detention area in order to meet surface water management requirements and eliminate the future expansion area for the building, including a Parking Waiver request to allow the reduction in width of sixty-nine (69) of the required 151 parking spaces from 10' x 18' to 9' x 18' in order to accommodate storm water storage needs, located at 6401 Nob Hill Road, specifically a portion of Parcel "A" of the "S & N Plat No. 2", according to the Plat thereof as recorded in Plat Book 171, Pages 112 through 115 of the Public Records of Broward County, Florida (Case No. 29- SP-04); providing for conditions of approval. END OF QUASI-JUDICIAL HEARING END OF PUBLIC HEARINGS The City Commission may consider and act upon such other business as may come before it. In the event this agenda must be revised, such revised copies will be available to the public at the City Commission meeting. Pursuant to Chapter 286.0105, Florida Statutes, if a person decides to appeal any decision made by the City Commission with respect to any matter considered at such meeting or hearing, he may need to ensure that a verbatim record of the proceedings is made which record includes the testimony and evidence upon which the appeal is based.
