R-2018- 0/ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA SUPPORTING AND ADOPTING THE REVISED BROWARD COUNTY DECEMBER 2017 MULTI -JURISDICTIONAL ENHANCED LOCAL MITIGATION STRATEGY (ELMS) PLAN AUTHORIZING THE CITY MANAGER TO APPOINT ONE PRIMARY AND ONE ALTERNATE CITY EMPLOYEE TO PARTICIPATE IN THE LOCAL MITIGATION STRATEGY WORKING GROUP; PROVIDING FOR CONFLICTS; PROVIDING SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac is located in an area that is vulnerable to natural and man-made disasters; and WHEREAS, the City supports reasonable efforts to make the community better prepared for future disasters and better able to recover after disaster strikes; and WHEREAS, pursuant to City of Tamarac Resolution No. R-2005-23 adopting the Broward County Local Mitigation Plan on February 23, 2005, Resolution No. R-2010-29 adopting the Broward County December 2009 revised Multi -Jurisdictional LMS on March 10, 2010, and Resolution No. R-2013-34 adopting the Broward County October 2012 revised Multi -Jurisdictional LMS on April 24, 2013 (copies on file in the City Clerk's Office); and WHEREAS, the State of Florida has stipulated that a Local Mitigation Strategy In Temp Reso #13053 December 27, 2017 01/03/18 Rev #1 Page 2 (LMS) is the first step in the process of making a community better prepared to manage disasters; and WHEREAS, by adopting the Broward County December 2017 Revision of the Multi -Jurisdictional Enhanced Local Mitigation Strategy (hereby attached as Exhibit A), the framework for future mitigation efforts and post -disaster recovery may be made easier and faster; and WHEREAS, the Broward County December 2017 Multi -Jurisdictional Enhanced Local Mitigation Strategy (ELMS) is in compliance with the local hazard mitigation requirements of Section 322 of the Disaster Mitigation Act of 2000 (DMA2K) as implemented in the Federal Emergency Management Agency (FEMA) regulation 44 C. F. R., Part 201.6(d)(3); and WHEREAS, approval and adoption of this Plan is necessary to maintain eligibility for hazard mitigation project grant funding; and WHEREAS, the City Commission of the City of Tamarac understands the need for Local Mitigation Strategy; and WHEREAS, it is the recommendation of the Chief Building Official that Tamarac continue to participate in the Local Mitigation Strategy program; and Temp Reso #13053 December 27, 2017 01/03/18 Rev #1 Page 3 WHEREAS, the City Commission of the City of Tamarac, Florida deems that the adoption of the Broward County Enhanced Local Mitigation Strategy Plan is in the best interest of the health, safety, and welfare of the City, its residents, citizens and visitors. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits referenced herein are incorporated and made a specific part of this Resolution. SECTION 2: That the City Commission of the City of Tamarac does hereby approve and adopt the Broward County December 2017 (Exhibit A) revision of the Multi - Jurisdictional Enhanced Local Mitigation Strategy as approved by the Federal Emergency Management Agency as meeting all current requirements for such a plan. SECTION 3: That the City Commission of the City of Tamarac hereby directs the City Manager to appoint one primary and one alternate City Employee to participate in the Local Mitigation Strategy Working Group to ensure the City of Tamarac is represented on all matters. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp Reso #13053 December 27, 2017 01/03/18 Rev #1 Page 4 SECTION 5: All If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. PLACKO TR#13053 December 27, 2017 Exhibit A Resolution No. 2017-650 1 2 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, 3 ADOPTING THE UPDATE OF THE MULTIJURISDICTIONAL ENHANCED LOCAL MITIGATION 4 STRATEGY ("ELMS") PLAN; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. 5 6 WHEREAS, Federal Emergency Management Agency (FEMA) regulation 7 44 C.F.R. § 201.6(d)(3) requires local jurisdictions to review and update their Local 8 Mitigation Strategy plans (LMS) every five (5) years to reflect changes in development, 9 progress in mitigation efforts, and changes in priorities in order to maintain eligibility for 10 mitigation project grant funding; and 11 WHEREAS, these plans serve as blueprints for mitigation planning to assist local 12 governments in reducing threats from natural and man-made hazards; and 13 WHEREAS, these plans are submitted to the Florida Division of Emergency 14 Management (FDEM) for initial review and coordination, then to the FEMA for review 15 and approval; and 16 WHEREAS, on 'January 5, 2010, the Broward County Board of County. 17 Commissioners (the "Board") adopted Resolution No. 2010-015, which approved the la . December 2009 LMS; and 19 WHEREAS, on February 5, 2013, the Board adopted Resolution No. 2013-034, 20 which approved an Enhanced Local Mitigation Strategy (ELMS) modifying and 21 improving the previous LMS; and 22 WHEREAS, on 'April 26, 2016, the Board approved an Agreement between 23 Broward County (the "County") and FDEM for the Pre -Disaster Mitigation Grant 24 Program in support of an enhanced mitigation planning program; and 1 WHEREAS, on June 12,.2017, and August 17, 2017, the County's Emergency 2 Management Division (EMD) held public meetings to gather public .comments prior to 3 submitting the proposed ELMS to the FDEM and FEMA for final review and 4 approval; and 5 WHEREAS, on October 18, 2017, the FDEM issued an approval of the proposed. 6 ELMS pending adoption by the County; and 7 WHEREAS, FEMA's approval of the County's current ELMS will expire on 8 March 18, 2018, NOW, THEREFORE, 9 10 BE IT RESOLVED BY THE. BOARD OF COUNTY COMMISSIONERS OF 11 BROWARD COUNTY, FLORIDA: 12 13 Section 1. That the foregoing clauses are hereby ratified and confirmed as 14 being true and correct and are hereby made a specific part of this Resolution upon 15 adoption hereof. 16 Section 2. That the Board hereby adopts the multijurisdictional ELMS plan 17 approved by FDEM as meeting all current requirements for such a plan. 18 Section 3. SEVERABILITY. 19 If any portion of this Resolution is determined by any Court to be invalid, the 20 invalid portion shall be stricken, and such striking shall not affect the validity, of the 21 remainder of this Resolution. If any Court determines that this Resolution, or 'any 22 portion hereof, cannot be legally, applied to any individual(s), group(s), entity(ies), 23 property(ies), or circumstance(s), such determination shall not affect the applicability 24 hereof to any other individual, group, entity, property, or circumstance.
