RESOLUTION NO. R-2018
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, TO APPROVE AGREEMENT
RENEWAL AMENDMENT NUMBER 1 TO THE AGREEMENT
WITH PRESTIGE PROPERTY MANAGEMENT AND
MAINTENANCE, INC. FOR LANDSCAPE MAINTENANCE
SERVICES OF CERTAIN PUBLIC RIGHTS -OF -WAY AND
CITY PARKS; AUTHORIZING ANNUAL EXPENDITURE NOT
EXCEED $1,331,078.39; AUTHORIZING A BUDGET
AMENDMENT IN THE AMOUNT NOT TO EXCEED OF
$129,726.39 WHICH WILL BE INCLUDED IN A BUDGET
AMENDMENT PURSUANT TO F.S. 166.241(2); PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Mayor and City Commission deem it to be in the best interest of the
citizens, residents, and businesses of the City of Tamarac to maintain City Rights -of -Way,
public parks, and other green spaces around City facilities through proper landscape
maintenance services provided in a cost-effective and efficient manner; and
WHEREAS, via Resolution R-2015-06, dated January 28, 2015, the City
Commission of the City of Tamarac awarded Bid Number 14-25B to and authorized an
Agreement with Prestige Property Management and Maintenance, Inc. forthe provision of
grounds maintenance and irrigation repair services for City -owned properties, a copy of the
Agreement is incorporated herein by reference and on file in the office of the City Clerk;
and
WHEREAS, via Resolution R-2017-98, dated September 30, 2017, the City
Commission of the City of Tamarac approved Change Order Number 1 to the Agreement

with Prestige authorizing an additional amount not to exceed $95,000.00 for variable cost
services for an annual expenditure not to exceed $1,331,078.39, a copy of the Change
Order is incorporated herein by reference and on file in the office of the City Clerk; and
and
WHEREAS, the original Agreement included one (1) three (3) year renewal option;
WHEREAS, due to impacts on the market from Hurricane Irma, City staff deem it in
the best interest of the City to approve and authorize execution of the Agreement Renewal
Amendment No. 1 to the Agreement, which includes one (1) one (1) year renewal and two
(2) one (1) year optional renewals to provide continuity of service and allow for rebid of
these services at a later date; and
WHEREAS, it is the recommendation of the Public Services Director, the Financial
Services Director, and the Purchasing and Contracts Manager that the appropriate City
Officials execute Agreement Renewal Amendment Number 1 to the Agreement with
Prestige Property Management and Maintenance, Inc., for the landscape maintenance
services; and
WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best
interest of the citizens and residents of the City of Tamarac to execute the Agreement
Renewal Amendment No. 1 to the Agreement for landscape services with Prestige
Property Management and Maintenance, Inc., at an annual cost not to exceed
$1,331,078.39.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE

CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof. All Exhibits attached hereto are hereby incorporated herein and
made a specific part of this resolution.
SECTION 2: The City Commission hereby approves Agreement Renewal
Amendment Number 1 to the Agreement with Prestige Property Management and
Maintenance, Inc., ("the Agreement") and the appropriate City Officials are hereby
authorized to execute Agreement Renewal Amendment Number 1 hereto attached as
"Exhibit 1", to provide landscape maintenance services.
SECTION 3: An annual expenditure in an amount not to exceed
$1,331,078.39 is hereby approved for the term of the Agreement.
SECTION 4: An appropriation in the amount not to exceed $129,726.39 is
hereby approved and will be included in a Budget Amendment pursuant to F.S. 166.241(2).
SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in
part or application, it shall not affect the validity of the remaining portions or applications of
this Resolution.

This Resolution shall become effective immediately upon its

AGREEMENT AMENDMENT #1
BETWEEN THE CITY OF TAMARAC
AND
PRESTIGE PROPERTY MANAGEMENT AND MAINTENANCE, INC.
Division
The City of Tamarac, a municipal corporation, with principal offices located at
7525 NW 88th Avenue, Tamarac FL 33321 (CITY), and Prestige Property Management
and Maintenance, Inc., a Florida corporation with principal offices located at 3300 SW
461h Avenue, Davie, FL 33314 (hereinafter referred to as "Contractor") agree to amend
the original Agreement dated January 28, 2015 to provide for City-wide Landscape
Maintenance Services.
1. Please amend paragraph 2.4 of the Agreement to read as follows:
2.4 Renewal Term: City reserves the right to renew the Agreement for a-n up
to three (3) additional three one 1 year terms upon mutual written
agreement between the parties, successful vendor performance, and
City's determination that such renewal would be in its best interest.
2. Pursuant to the revised terms of Section 2, Term, Paragraph 2.4 Renewal Term
of the original Agreement dated January 28, 2015, between the City and Prestige
Property Management and Maintenance, Inc., and in recognition of satisfactory
performance under the current term of the Agreement, the CITY hereby
exercises its option to renew the Agreement for one (1) additional year effective
January 29, 2018 through January 28, 2019, with the right to exercise up to two
(2) additional one (1) year renewal options.

IN WITNESS WHEREOF, the parties have made and executed this Agreement
on the respective dates under each signature. CITY OF TAMARAC, signing by and
through its Mayor and City Manager, and PRESTIGE PROPERTY MANAGEMENT
AND MAINTENANCE, INC., signing by and through its President, duly authorized to
execute same.
