No. 13194 October 3, 2018 Page 1 of 3 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 2018-- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING THE COMMUNITY DEVELOPMENT DEPARTMENT FEE SCHEDULE, ATTACHED HERETO AS EXHIBIT "A", TO PROVIDE FOR NEW APPLICATION TYPES AND FEES ASSOCIATED WITH THE JULY 11, 2018 ADOPTION OF THE NEW LAND DEVELOPMENT CODE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Land Development Code of the City of Tamarac Code of Ordinances authorizes the City Commission from time to time, to establish by resolution, the amount of application fees; and WHEREAS, Resolution No. R-2017-67, enacted by the City of Tamarac City Commission on June 14, 2017, established the current development review fees that are listed in the Community Development Department Fee Schedule ("Fee Schedule"); and WHEREAS, on May 9, 2018, the City Commission amended the Fee Schedule via Resolution No. R-2018-47 to provide for applications and fees associated with a new Vacation Rental Registration program; and WHEREAS, the new Land Development Code adopted on July 11, 2018, establishes new application types and fees not captured in the existing Fee Schedule, thereby necessitating the need for an amendment to the Community Development Department Fee Schedule to reflect the new applications and fees; and WHEREAS, the Community Development Director has reviewed the amended Community Development Fee Schedule which is consistent with industry standards, and concurs with the fees being proposed; and Temp Reso. No. 13194 October 3, 2018 Page 2of3 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend the Community Development Department Fee Schedule to reflect new application types and fees established in the recently adopted Land Development Code and not previously reflected in the Fee Schedule. NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are expressly incorporated herein and made a part hereof. SECTION 2: That the Community Development Department Fee Schedule amendment attached hereto as Exhibit "A" and made a part hereof, is hereby approved, to become effective immediately upon adoption. SECTION 3: That all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. Temp Reso.
