R- 2018 / 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE PURCHASE OF SOLAR SALT FROM MORTON SALT, INC.; AUTHORIZING AN EXPENDITURE OF FUNDS FOR AN AMOUNT NOT TO EXCEED THE APPROVED ANNUAL BUDGET; UTILIZING ITB 2017-024 SOLICITED AND AWARDED BY THE CITY OF BOCA RATON, FLORIDA AS THE LEAD AGENCY FOR THE SOUTHEAST FLORIDA GOVERNMENTAL PURCHASING COOPERATIVE GROUP; EFFECTIVE UPON APPROVAL THROUGH MAY 30, 2019 OR AS EXTENDED BY THE CITY OF BOCA RATON ON BEHALF OF THE SOUTHEAST FLORIDA GOVERNMENTAL PURCHASING COOPERATIVE; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE CONTRACT RENEWALS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Public Services Department of the City of Tamarac is responsible for the operation and maintenance of the water and wastewater utilities which requires the treatment and distribution of potable water in a safe, efficient and economical manner; and WHEREAS, to maintain the City's water consumption demands and to eliminate potential health hazards, the Water Treatment Plant utilizes sodium chloride for use in electrolytic chlorination process as disinfectant during the water treatment process; and WHEREAS, the Co-op, through the City of Boca Raton, awarded ITB 2017-024, approved by City Commission as Resolution #9-A-2 on March 28, 2017 to Morton Salt, Inc. ("Morton Salt") effective for one (1) year beginning May 31, 2017 through May 30, 2018, and subsequently renewed for the first of three (3) one-year renewals effective from May 31, 2018 through May 30, 2019, and is eligible for two (2) additional one-year renewals, a Temp. Reso. #13195 October 5, 2018 Page 2 of 5 copy of ITB 2017-024 is incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, the City of Tamarac is a member of the Southeast Florida Governmental Purchasing Cooperative Group and is eligible to utilize ITB 2017-024 for the purchase of Solar Salt for water treatment, and WHEREAS, sufficient funds for this project are available from the Water Treatment Plant Operating accounts; and WHEREAS, it is the recommendation of the Director of Public Services, Director of Financial Services, and the Purchasing & Contracts Manager that the City Commission approve the purchase of Solar Salt from Morton Salt, Inc.; and that expenditures for Solar Salt per ITB 2017-024 not to exceed the approved budget, including any approved budget amendments, for said purpose be approved; and that the Appropriate City Officials be authorized to approve and execute any subsequent renewals to ITB 2017-024; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve and to authorize the appropriate City Officials to purchase Solar Salt from Morton Salt, Inc.; and that expenditures for Solar Salt per ITB 2017-024 not to exceed the approved budget, including any approved budget amendments, for said purpose be approved; and that the Appropriate City Officials be authorized to approve and execute any subsequent renewals to ITB 2017- 024. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: 1 7 L 1 Temp. Reso. #13195 October 5, 2018 Page 3 of 5 SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits referenced herein are incorporated within this resolution and made a specific part hereof. SECTION 2: The City Commission HEREBY approves the purchase of Solar Salt from Morton Salt, Inc., utilizing ITB 2017-024 solicited and awarded by the City of Boca Raton, Florida as the lead agency for the Southeast Florida Governmental Purchasing Cooperative Group. SECTION 3: Expenditures for Solar Salt from Morton Salt, Inc. per ITB 2017- 024, are hereby authorized and shall not exceed the approved budget including any approved budget amendments. SECTION 4: The City Manager, or his designee, is hereby authorized to approve and execute any subsequent renewal options to this Agreement, initiate Change Orders in amounts not to exceed $65,000 per Section 6-147 of the City Code, and close the contract award, which includes, but is not limited to, making final payment and releasing bonds per Section 6-149 of the City Code, when the work has been successfully completed within the terms, conditions and pricing of the agreement. Temp. Reso. #13195 October 5, 2018 Page 4 of 5 SECTION 5: Funding is available for Solar Salt from the appropriate accounts within the Utilities Fund. SECTION 6: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 7: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
