A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, ACCEPTING A MEMORANDUM OF
UNDERSTANDING (MOU) BETWEEN THE CITY OF TAMARAC AND
THE CITY OF POMPANO BEACH, FLORIDA FOR THE SUBMITTAL
OF A REGIONAL ASSISTANCE TO FIREFIGHTERS GRANT (AFG)
APPLICATION TO THE US DEPARTMENT OF HOMELAND
SECURITY (DHS) VIA THE FEDERAL EMERGENCY MANAGEMENT
AGENCY (FEMA) ON BEHALF OF THE CITY OF TAMARAC AND A
COALITION OF LOCAL AGENCIES TO APPLY FOR AFG FUNDS
FOR THE PROVISION OF FIRE STATION ALERTING SYSTEM
EQUIPMENT; PROVIDING FOR THE CITY OF POMPANO BEACH
TO SERVE AS THE LEAD AGENCY APPLYING FOR AFG FUNDS
AND FOR THE ADMINISTRATION OF THE AFG GRANT AWARD IN
THE EVENT OF APPROVAL OF THE APPLICATION; AUTHORIZING
THE APPROPRIATE CITY OFFICIALS TO ACCEPT A REGIONAL
AFG GRANT AWARD AND TO EXECUTE THE NECESSARY
DOCUMENTS PENDING LEGAL REVIEW FOR FIRE STATION
ALERTING SYSTEM EQUIPMENT IN AN AMOUNT NOT TO EXCEED
$200,000; PROVIDING FOR A 15% MATCH IN LOCAL FUNDS NOT
TO EXCEED $30,000 IN THE EVENT OF APPROVAL OF THE
APPLICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac wishes to provide high performance Fire Rescue
services to residents, businesses and visitors to Tamarac; and
WHEREAS, the City Commission of the City of Tamarac desires to protect the health and
safety of Tamarac residents, businesses, visitors and Fire Rescue personnel; and
WHEREAS, Broward County is converting to a new communications system requiring
P25 Phase II compliant base stations and supportive components for 24-hour essential
communications with County -wide emergency management personnel; and

WHEREAS, the City of Tamarac wishes to remain in compliance with the compatible
equipment necessary to utilize the new County communications system; and
WHEREAS, the U.S. Department of Homeland Security (DHS), through the Federal
Emergency Management Agency (FEMA), provides grants to local governments for fire station
communications equipment through the Assistance to Firefighters Grant (AFG) Program; and
WHEREAS, the City of Pompano Beach and the City of Tamarac with a coalition of
neighboring agencies wish to apply for AFG funds under one regional application for the
provision of fire station alerting system equipment for our respective fire stations; and
WHEREAS, the coalition of neighboring agencies includes:

WHEREAS, FEMA requires and the City of Pompano Beach agrees to serve as the lead
agency to file a Regional AFG application on behalf of the above listed coalition of agencies and
administer the AFG grant in the event of approval of the application; and
WHEREAS, FEMA requires and the City of Pompano Beach agrees to provide a
Memorandum of Understanding (MOU) between the City of Pompano Beach and the above
listed coalition of agencies for the application to FEMA for a Regional AFG grant and the

administration of the grant if awarded, and the MOU is attached hereto as Exhibit A and
incorporated herein by this reference; and
WHEREAS, the Director of Financial Services and Fire Chief recommend the City of
Tamarac provide authority to the City of Pompano Beach to submit a Regional AFG application
on behalf of the City of Tamarac with the above listed coalition of agencies in an amount not to
exceed two hundred thousand dollars ($200,000), plus a 15% match in local funds as required
by FEMA in an amount not to exceed thirty thousand dollars ($30,000); and
WHEREAS, the Director of Financial Services and Fire Chief recommend the City of
Tamarac approve the attached MOU, accept the Regional AFG award and execute the
necessary documents pending legal review upon approval of the grant application; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the
best interest of the citizens and residents of the City of Tamarac to authorize the City of
Pompano Beach to submit a Regional AFG application on behalf of the City of Tamarac with the
above listed coalition of agencies, approve and execute the attached MOU, accept the Regional
AFG award and execute the necessary documents upon approval of the application pending
legal review; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA-.
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as
being true and correct and are HEREBY made a specific part of this Resolution. All exhibits
attached hereto are incorporated herein and made a specific part of this Resolution.

SECTION 2: The City Commission of the City of Tamarac HEREBY approves the City of
Pompano Beach submitting a Regional Assistance to Firefighters Grant (AFG) application on
behalf of the City of Tamarac along with the above listed coalition of agencies to the
Department of Homeland Security (DHS) via the Federal Emergency Management Agency
(FEMA) for Assistance to Firefighters Grant (AFG) program funds in an amount not to exceed
two hundred thousand ($200,000) for fire station alerting system equipment, providing for a
fifteen percent (15%) match in local funds in an amount not to exceed thirty thousand ($30,000)
in the event of approval of the application. A copy of said application is attached HERETO as
"Exhibit B" and incorporated HEREIN by this reference.
SECTION 3: The City Commission of the City of Tamarac HEREBY approves the
execution of a Memorandum of Understanding (MOU) between the City of Pompano Beach, the
City of Tamarac and the above listed coalition of agencies pending legal review.
SECTION 4: The appropriate City Officials are HEREBY authorized to accept the
Regional AFG grant award and execute the necessary documents following legal review in the
event of approval of the application.
SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are HEREBY
repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall
not affect the validity of the remaining portions or applications of this Resolution.

REGIONAL GRANT APPLICATION
MEMORANDUM OF UNDERSTANDING (MOU)
This Memorandum of Understanding ("MOU") is being executed by the following listed
participating agencies and their EIN Numbers (hereafter "participating agencies"):

Nothing in this MOU should be construed as limiting or impeding the basic spirit of cooperation
which exists between the participating agencies, listed above.
WHEREAS, the participating agencies have formed a working committee and
developed a course of action to achieve the goals and objectives of the Assistance to
Firefighters Grants ("AFG") grant programs; and
WHEREAS, the participating agencies have been identified as eligible jurisdictions
able to collectively implement the objectives and goals of the AFG grant program; and

WHEREAS, the City of Pompano Beach has been selected through this MOU to be
the host agency to file a regional AFG grant application (the "Application") on behalf of the
participating agencies, and
WHEREAS, the City of Pompano Beach has been selected through this MOU to
administer the 2017-2018 regional AFG grant program award and agrees to be the host
agency responsible for administration of the grant including asset accountability and reporting
requirements for those assets acquired under the AFG regional application in the event of
approval; and
WHEREAS, the City of Pompano Beach agrees to serve as host agency for the
procurement and disbursement of all P25 compliant base stations, mobile radios, and
supportive components (collectively, "equipment") received under AFG grant program award
in the event of approval; and
NOW THEREFORE, in consideration of the mutual terms, conditions, promises, and
covenants hereinafter set forth, the participating agencies agree as follows:
Article 1. PURPOSE
This MOU establishes the relationship between the participating agencies for participation in
a Regional 2017-2018 Assistance to Firefighters Grants (AFG) grant program in the event of
approval of the Application.
Article 2. PROCEDURES
2.1 The City of Pompano Beach ("Pompano Beach") will serve as the host agency to submit a
regional 2017-2018 AFG grant program application and serve as grant administrator for
the participating agencies in the event of approval.
2.2 Pursuant to the AFG grant program guidelines, all items approved under the Application will
be procured and administered through Pompano Beach in the event of approval of the
Application.
2.3 Pompano Beach agrees, as host agency, to provide accountability for the assets
acquired under the regional AFG grant award and to provide reporting requirement
deliverables. As such, participating agencies agree to provide Pompano Beach with this
information on a timely basis to remain in compliance with the requirements of the grant.
2.4 The participating agencies agree to accept the 2017-2018 regional AFG grant program
award and accept their respective items as listed in the AFG grant application in the event
of approval.
2.5 The participating agencies agree to provide the required cash match in the amount of 15%
of the total cost of their requested items as detailed in the grant application as required
under the regional AFG grant program guidelines. The required match shall be paid by
the participating agencies upon receipt of an invoice from Pompano Beach, in advance of
equipment procurement.

2.6 In the event of a reduced award, the participating agencies agree to accept this reduced
amount and provide a 15% cash match on the total reduced award amount of their
approved items.
2.7 Any expenditure beyond the grant award for a participating agency's approved item(s)
remain the sole responsibility of that participating agency.
2.8 The participating agencies agree to allow Pompano Beach to procure and distribute their
respective assets if awarded under the regional AFG grant program.
2.9 The participating agencies agree to participate in cooperative training on all equipment
procured under this grant award as appropriate. As host agency, training will be
coordinated through Pompano Beach.
2.10 The participating agencies agree to maintain/repair all items awarded to them under the
Application in accordance with the manufacturer's warranty, and to replace the equipment
if it becomes inoperable for a period of three years after official closeout of the grant
agreement.
2.11 The participating agencies agree to promptly provide any additional documentation to
Pompano Beach as requested, that may be necessary in connection with the grant.
2.12 Participating agencies agree to promptly return any equipment or deliverables that are
received in error to Pompano Beach.
2.13 The grant award to each participating agency will be P25 compliant equipment in the
amounts as follows:

Article 3. TERM AND TERMINATION
This MOU shall be effective on the date of last signature of the participating agencies herein
and shall continue in full force and effect for a period of five years after official closeout of the
grant agreement.
Article 4. GUIDELINES
In performing its duties, responsibilities and obligations pursuant to this MOU, each
participating agency agrees to adhere to the requirement standards and conditions set forth
in the AFG grant program guidance and 2 C.F.R. Part 200 as applicable.
Article 5. RECORDS
5.1 Each participating agency understands that any and all records created as a result of
participating in this federal grant program may be subject to the public disclosure
pursuant to the Public Records Statute, Fla. Stat. Section 119.07 and shall be
responsible for compliance with any public records request served upon it and any
resultant award of attorney's fees for noncompliance.
5.2 Each participating agency shall comply with all applicable requirements contained in the
Florida Public Records Law (Chapter 119, Florida Statutes), including but not limited to
any applicable provisions in Section 119.0701, Florida Statutes. To the extent that the
participating agency and this MOU are subject to the requirements in Section 119.0701,
Florida Statutes, the participating agency shall: (a) keep and maintain public records
required by Pompano Beach to perform the services provided hereunder; (b) upon
request from Pompano Beach's custodian of public records, provide Pompano Beach
with a copy of the requested records or allow public records to be inspected or copied
within a reasonable time at a cost that does not exceed the cost provided in Chapter 119,
Florida Statutes, or as otherwise provided by law; (c) ensure that public records that are
exempt or confidential and exempt from public records disclosure requirements are not
disclosed, except as authorized by law for the duration of the term of this MOU and
following completion of this MOU if the participating agency does not transfer the records
to Pompano Beach; and (d) upon completion of the MOU, transfer, at no cost, to
Pompano Beach all public records in the possession of the participating agency or keep
and maintain public records required by Pompano Beach to perform the service. If the
participating agency transfers all public records to Pompano Beach upon completion of
the MOU, the participating agency shall destroy any duplicate public records that are
exempt or confidential and exempt from public records disclosure requirements. If the
participating agency keeps and maintains public records upon completion of the MOU,
the participating agency shall meet all applicable requirements for retaining public
records. All records stored electronically must be provided to Pompano Beach, upon
request from Pompano Beach's custodian of public records, in a format that is compatible
with the information technology systems of Pompano Beach. If the participating agency
fails to comply with the requirements in this Section 5.2, Pompano Beach may enforce
these provisions in accordance with the terms of this MOU. If the participating agency
fails to provide the public records to Pompano Beach within a reasonable time, it may be
subject to penalties under Section 119.10, Florida Statutes.

IF THE PARTICIPATING AGENCY HAS QUESTIONS REGARDING
THE APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO
THE PARTICIPATING AGENCY'S DUTY TO PROVIDE PUBLIC
RECORDS RELATING TO THIS MOU, THE PARTICIPATING
AGENCY SHOULD CONTACT POMPANO BEACH'S CUSTODIAN OF
PUBLIC RECORDS: THE CITY CLERK, ASCELETA HAMMOND, BY
TELEPHONE (954.786.4611), E-MAIL

POMPANO BEACH, OFFICE OF THE CITY CLERK, 100 West Atlantic
Blvd Second Floor Pompano Beach, FL 33060).
5.3 Each participating agency shall maintain its own respective records and documents
associated with this MOU sufficient to demonstrate compliance with the terms of this
MOU for a period of five years from the close-out date of the grant agreement, and shall
allow Pompano Beach and the Department of Homeland Security access to such records
upon request.
Article 6. EXECUTION
This MOU may be executed in counterparts each of which shall be deemed an original and
all of which together shall be considered one and the same agreement.
Article 7. INSURANCE OR SELF-INSURANCE
Each participating agency at its sole cost and expense, shall carry insurance, or self -insure,
its activities in connection with this MOU, and obtain, keep in force and maintain, insurance
or equivalent programs of self-insurance, for general liability, professional liability, workers'
compensation, and business automobile liability adequate to cover its potential liabilities
hereunder. Each participating agency agrees to provide the other participating agencies
fortyfive (45) days' advance written notice of any cancellation, termination or lapse of any of
the insurance or self-insurance coverage.
Article 8. INDEPENDENT CONTRACTOR
This MOU does not create an employee/employer relationship between the parties. It is the
intent of the parties that each participating agency is an independent contractor, and each
participating agency shall assume responsibility for all personnel costs for its respective
employees, including but not limited to, the application of the Fair Labor Standards Act
minimum wage and overtime payments, Federal Insurance Contribution Act, the Social
Security Act, the Federal Unemployment Tax Act, the provisions of the Internal Revenue
Code, the State Workers Compensation Act, and the State unemployment insurance law.
Article 9. INDEMNIFICATION

Each participating agency shall each be separately liable and responsible for the actions of
their respective officials, officers, agents and employees in the performance of their
respective obligations under the MOU.
To the extent permitted by law, each participating agency shall indemnify, defend, and hold
Pompano Beach, its officials, agents, servants and employees, harmless from any and all
liability, actions, causes of action, suits, trespasses, damages, judgments, executions, claims
and demands of any kind whatsoever, in law or in equity, which results from or arises out of
the negligent acts or omissions of the participating agency or its employees, and the
participating agency shall indemnify Pompano Beach, its officials, agents, servants and
employees, for damages, judgments, claims, costs, expenses, including reasonable
attorney's fees, which Pompano Beach, its officials, agents, servants and employees, might
suffer in connection with or as a result of the negligent acts of the participating agency or its
employees. For purposes of this provision, the participating agency's employees shall not be
deemed agents or servants of Pompano Beach and Pompano Beach's employees shall not
be deemed agents or servants of the participating agency. The participating agency will at all
times be entitled to the benefits of sovereign immunity as provided in Florida Statutes, Section
768.28, and common law. Nothing contained in the MOU shall be construed as a waiver of
sovereign immunity.
To the extent permitted by law, Pompano Beach shall indemnify, defend, and hold
participating agency, its officials, agents, servants and employees, harmless from any and all

participating agency, its officials, agents, servants and employees, might suffer in connection
with or as a result of the negligent acts of the Pompano Beach or its employees. For purposes
of this provision, Pompano Beach's employees shall not be deemed agents or servants of
participating agency and participating agency's employees shall not be deemed agents or
servants of Pompano Beach. Pompano Beach will at all times be entitled to the benefits of
sovereign immunity as provided in Florida Statutes, Section 768.28, and common law.
Nothing contained in the MOU shall be construed as a waiver of sovereign immunity.
Article 10. GOVERNMENTAL IMMUNITY
Each participating agency is a municipal corporation existing under the laws of the state of
Florida. Each agrees to be fully responsible for negligent acts and omissions of their agents
or employees while acting in the course and scope of his or her employment function to the
extent permitted by law. Nothing herein is intended to serve as a waiver of sovereign
immunity by any party to which sovereign immunity may be applicable. Nothing herein shall
be construed as consent by a political subdivision of the state of Florida to be sued by third
parties in any matter arising out of this MOU.
Article 11. NOTICES
Any and all notices given or required under this MOU shall be in writing and may be delivered
in person or by United States mail, postage prepaid, first class, and certified return receipt
requested, addressed as follows:

this Article. Each such notice shall be deemed delivered on the date delivered if by personal
delivery or by overnight courier; or on the date upon which the return receipt is signed or
delivery is refused or the notice is designated by the postal authorities as not deliverable, as
the case may be if mailed.
Article 12. MISCELLANEOUS

12.1 COMPLIANCE WITH LAWS
The participating agencies shall comply with all federal, state, and local laws, codes,
ordinances, rules, and regulations which may be applicable in performing its duties,
responsibilities, and obligations pursuant to this MOU.
12.2 JOINT PREPARATION
The participating agencies acknowledge that they have sought and received whatever
competent advice and counsel as was necessary for them to form a full and complete
understanding of all rights and obligations herein and that the preparation of this MOU has
been their joint effort. The language agreed to expresses their mutual intent and the resulting
document shall not, solely as a matter of judicial construction, be construed more severely
against one of the parties than the other.
12.3 APPLICABLE LAW AND VENUE
This MOU shall be interpreted and construed in accordance with and governed by the laws
of the State of Florida. Venue in any proceeding or action among the parties arising out of
this MOU shall be in Broward County, Florida.
12.4 INCORPORATION BY REFERENCE
The truth and accuracy of each "Whereas" clause set forth above is acknowledged by the
participating agencies.
12.5 ENTIRE AGREEMENT
This MOU contains the entire understanding of the participating agencies relating to the
subject matter hereof superseding all prior communications between the parties whether oral
or written. This MOU may not be altered, amended, modified, or otherwise changed nor may
any of the terms hereof be waived, except by written instrument executed by the participating
agencies. The failure of a participating agency to seek redress for violation of or to insist on
strict performance of any of the covenants of this MOU shall not be construed as a waiver or
relinquishment for the future of any covenant, term, condition or election but the same shall
continue and remain in full force and affect.
12.6 SEVERABILITY
Should any part, term or provision of this MOU be by the courts decided to be invalid, illegal
or in conflict with any law of this State, the validity of the remaining portions or provisions shall
not be affected thereby.

12.7 UNCONTROLLABLE FORCES
Participating agencies shall not be considered to be in default of this MOU if delays in or
failure of performance shall be due to Uncontrollable Forces, the effect of which, by the
exercise of reasonable diligence, the non -performing party could not avoid. The term
"Uncontrollable Forces" shall mean any event which results in the prevention or delay of
performance by a party of its obligations under this MOU and which is beyond the reasonable
control of the nonperforming party. It includes, but is not limited to fire, flood, earthquakes,
storms, lightning, epidemic, war, riot, civil disturbance, sabotage, and governmental actions.
Neither party shall, however, be excused from performance if nonperformance is due to
forces, which are preventable, removable, or remediable, and which the nonperforming party
could have, with the exercise of reasonable diligence, prevented, removed, or remedied with
reasonable dispatch. The nonperforming party shall, within a reasonable time of being
prevented or delayed from performance by an uncontrollable force, give written notice to the
other party describing the circumstances and uncontrollable forces preventing continued
performance of the obligations of this MOU.
12.8 ASSIGNMENT
Participating agencies shall not assign or transfer its rights, title or interests in the MOU.
12.9 SIGNATORY AUTHORITY
Each participating agency shall supply Pompano Beach with copies of requisite
documentation evidencing that the signatory for the participating agency has the authority to
enter into this MOU.
12.10 NO THIRD PARTY BENEFICIARIES.
The participating agencies expressly acknowledge that it is not their intent to create or confer
any rights or obligations in or upon any third person or entity under this MOU. None of the
parties intend to directly or substantially benefit a third party by this MOU. The parties agree
that there are no third party beneficiaries to this MOU and that no third party shall be entitled
to assert a claim against any of the parties based upon this MOU. Nothing herein shall be
construed as consent by an agency or political subdivision of the State of Florida to be sued
by third parties in any matter arising out of any contract.
12.11 CAPTIONS
The captions, section designations, section numbers, article numbers, titles and headings

Pompano Beach Fire Rescue (PBFR) will serve as the host applicant for 20 municipalities that provide fire/EMS services
through 12 career fire departments. All participating municipalities are included in the Miami -Fort Lauderdale -West Palm
Beach Metropolitan Statistical Area (MSA) as designated by the U.S. Office of Management and Budget. With over 2,000
persons per square mile, it is the eighth largest MSA in the nation. Broward County ranks as the second most densely
populated MSA with a population increase of 8.5% from 2010 to 2015. Several participating cities have been designated as
"high risk" by NFPA since they are particularly dense with about 200 high-rises plus numerous multi -family complexes.
Together, we have 76 fire stations and a Fire Training Academy that meets the training needs of over 35 different fire
departments in 8 counties. Our combined response area spans from the Atlantic Ocean to the Everglades. Combined,
these agencies serve 288 square miles with over 1.2 million permanent residents (more than the population of 13 states),
plus 272,072 seasonal, and millions of tourists annually. Our agencies cover critical infrastructure including water treatment
plants, natural gas centers (with pipelines pumping gas in excess of 2-billion cubic feet per day), electrical power plants, 15
hospitals, a regional Veterans' Administration Clinic, a Doppler radar facility, and numerous industrial parks containing
highly flammable materials. Under mutual and automatic aid agreements, it is also our collective duty to protect 9
additional hospitals, health care facilities, stretches of dangerous highways, & the Broward County Emergency Operations
Center. The response area includes critical roadways, air and sea transportation infrastructure, & critical hurricane
evacuation routes. We respond to calls on some of the busiest roads in the country: 1-95, 1-595, 1-75, the Florida Turnpike,
& the Sawgrass Expressway. 1-95 in Broward County has over 300,000 daily trips according to the Florida Department of
Transportation. 1-595 carries 185,000, 1-75 and the Sawgrass Expressway carry over 165,000 & the Turnpike handles over
110,000 trips every day. These roadways support commercial activity and provide a conduit for the transportation of
hazardous materials on a daily basis. The Fort Lauderdale Executive Airport, the Fort Lauderdale/Hollywood International

Airport & Port Everglades Sea Port bring over 44.5 million travelers and vacationers annually, according to the South
Florida Regional Planning Council, making Broward County an international travel and tourism destination. Tri-rail handled
4.2 million trips in 2016, up 17.6% over 5 years. We have the 6th largest school district in the country, 4 colleges and
universities and 8 other adult education providers. In addition to servicing dense population centers, our agencies cover
numerous places of assembly and tourist attractions, including the BB&T Center, home of the Florida Panthers; Sawgrass
Mills Mall, the 2nd most popular Florida attraction outside of Disney (USA Today); Calypso Cove, a major water park; the
Seminole Tribe's Coconut Creek Casino, Hard Rock, Mardi Gras Casino, and the Village at Gulfstream Park, several of
which are expanding just to keep pace.
Our combined annual call volume increased 9% from 228,589 in 2014 to 249,210 in 2016. Our combined mutual/automatic
aid calls continually comprise over 12,000 incidents per year. Our departments are working together more than ever to
meet these increased demands, and the challenge to meet this demand increases every year. Our resources are already
stretched to the limit. Our collective cities are called upon to provide specialized response, including Hazardous Materials,
Technical Rescue, Dive Rescue, SWAT Medics, Tactical EMS, & a Community Paramedic Program. These programs are
in addition to the fire rescue, EMS, fire prevention, and public education services that all included agencies are tasked to
provide.

While municipalities in our region have begun to experience slow but steady general fund revenue growth with increases in
the property tax values, the general funds have not been restored to the levels prior to the Great Recession. The challenge
to achieve a balance between covering increasing operating costs and maintaining service levels while keeping taxes and
fees affordable for residents has contributed to the need to seek regional grant funding. All the cities associated with this
grant have seen significant increases in costs, such as the astronomical rise in cost of healthcare, rising pension costs, &
infrastructure maintenance and improvements that were delayed during the recession. These increasing expenses have
lead the departments to seek grant funding assistance as they currently lack the resources to purchase P25 compliant

base station alerting systems. An uneducated analysis of the financial condition of cities within Broward County would lead
to the faulty premise that there is widespread improvement in the tax base. For example, the value of properties in the
County went up by 7.9% overall in 2017; however, this hardly compensates for the 29% drop during the great recession.
Only 8.5% of single family homes have property values above 2007 levels. Additionally, the increase was almost entirely
due to completion of new homes. In turn, these new residents will increase the demand for service, which will drive up
costs. At the same time, there are a record number of properties having $0 taxable value thus resulting in no property tax
revenues) and Florida6s Save Our Homes legislation doesn't allow taxable value to increase more than 3%, even if the
value goes up much more, for those that are above the exemption threshold. Residents approved additional taxation for
schools, parks and other capital projects through an $800 million general obligation bond. The voters thereafter promptly
rejected a penny tax on 11/8/17 that was designed to fund capital projects. While economic recovery is underway, tax base
gains have been minimal compared to the steep declines experienced in this region. To compound the problem, the voters
approved a referendum that increased homestead exemptions on property from $25,000 to $50,000, which resulted in a
corresponding decrease in ad valorem taxes that would have otherwise been available. Given the information above, it
becomes evident that this project cannot solely be funded by local dollars. If that were the answer, the cities involved in
this grant application would have already addressed the issue, at least incrementally. At the time of writing, only 3 of the
affected municipalities have been able to fund and purchase the alerting base stations. The challenge is that the
infrastructure change is wide in scope and financially overwhelming considering the short timeline. These facts make it
difficult, if not impossible, for the cities to address the change at a time when the local economy has not recovered from
the recession. The total projected cost estimate associated with replacing the existing antiquated Zetrons with a P25
Phase II system is $9,000,000. The County, which controls the dispatch system, will not provide cities any financial
assistance in the conversion to the interoperable system as their contribution to the project is over $40 million. The
associated costs for the 29 cities in the centralized dispatch system is approximately $28,004,700. Cities simply do not
have the financial resources to cover costs related to the adoption of an interoperable system. The total amount of this
grant award would not even cover 10% of this cost. Currently, there are approx. 100 stations working on the existing
communication system. The proposed regional grant will provide funding for the purchase of 50 base stations and mobile
radios for the 12 participating agencies. The purchase of these 50 systems will help alleviate the overall burden that the
affected cities currently face.

The host city, Pompano Beach Fire Rescue (PBFR), has experienced an increased call volume consistently over the past
few years. In calendar year 2017, PBFR responded to over 31,000 incidents with more than 50,000 apparatus responses
handled by only six (6) fire stations. The prior calendar year call volume was just over 28,000 with a similar volume for
2015. In 2014, PBFR was barely more than 25,000. This stark increase in call volume is caused by different factors,
however, the increase in population, improved economy, and continued growth within the community are among the more
significant factors causing the increased demand for service.
The partner agencies are experiencing similar increases in call volume as the overall population in Broward County has
soared from 1,748,066 to 1,873,970 in the last seven (7) years, which equates to an increase of 125,000 people. This trend
is expected to continue into the future, which will serve as a key factor to the increase in call volume experienced by all
agencies participating in this grant application.

Broward County decided to replace the current core platform radio system with a P25 Phase II system. While the core
radio system is the responsibility of Broward County, all subscriber base stations, mobile radios, and equipment necessary
for the system to function, including purchases, ownership, and maintenance are the responsibilities of the user agencies
on the county system. The County does not have any responsibilities pertaining to subscriber equipment so the
responsibility lies solely on the partner municipalities to obtain the equipment necessary to stay in service and it must be
done before the County makes the switch to the new P25 system in December 2018.
Age: Each participant in this grant application is part of the Broward County Regional Communications System. The
system has been experiencing ever-increasing problems and a comprehensive radio analysis report was completed in
September of 2015 and found that the current core radio system, initially installed in 1992 with an upgrade in 2002, is past
its serviceable life, no longer had support, nor could be upgraded to meet current requirements. Some individual base
stations have recently been purchased by other fire agencies in Broward County, but the cost of the full base station,
mobile radio, speakers, antennae, message boards and related equipment for the alerting system is too costly for many
agencies, including those participating in this grant application.
Serviceability: The County is responsible for all infrastructure of the core radio system including radio purchases,
ownership, and maintenance while the municipalities are responsible for equipment to receive communications such as the
base stations, mobile radios, and equipment sought herein. From the report:

next three to five years. Supporting systems, including the microwave backhaul system, the fire station alerting system,

will reach end of life and the substantial investment that would be required to further extend the life of the system, the
County determined that a system replacement is necessary.6

Compatibility: None of the base stations, mobile radios for the base stations, and related equipment owned by the applicant
agencies are P25 compliant. The systems include Zetron alerting base stations that are over 20 years old and are analog
based. Because of the switch to a Phase II P25 system, all of the current subscriber base stations and alerting system
components will become obsolete instantaneously. This funding requests only 50 base stations, mobile radios, and related
equipment for 50 fire stations, though the total count of fire stations is 76 among the participating agencies. Without
purchasing these new systems, our first and only accountability line will be gone. All personnel need to receive the alerting
signal at each fire station before being able to respond to an emergency. The current Zetron base stations will not be able to
receive any signal when the new P25 system is activated at the end of 2018. This has not occurred in Broward County for
over 20 years, and the immediate nature of the transition increases the financial burden and operational impact throughout
each agency participating in this grant.

The benefit of this new equipment is tremendous compared to its cost. AFG funds will allow 12 fire departments to work
together to purchase station alerting systems to be utilized by over 2300 firefighters. With a population of 1.2 million plus
permanent residents (plus 272,072 seasonal) in a densely populated 288 square miles, personnel costs are already
minimal, providing only one fire fighter per 536 residents. Therefore, equipment costs per resident will be a mere $2.15, or
about 0.7 cents/year over a 30-year useful life.
This is not just a benefit; it is a necessity. Because of the Phase II system implementation, all of the current
communications systems for the entire county will become obsolete within the next year. The need is urgent and
immediate. It would be impossible to even patch pieces of the new communications system together one at a time, as the
current system is an analog system that will not work with the new P-25 compliant system. Broward County has provided
no funding sources for station alerting systems that must be replaced by the partner cities. Besides the fire station alerting
systems requested in this application, all portable radios, mobile radios, and base stations, must be replaced as well. Some
of the cities within the regional system have already purchased some components of the P25 compliant communication
systems, such as radios, due to normal end -of -life replacement schedules, but none of the participating agencies have
replaced any station alerting systems. This grant request would alleviate a portion of the financial pressure that our
communities face as one of our greatest funding challenges.
AFG funds would allow us to purchase half of all of the needed station alerting systems for 13 fire rescue agencies
immediately. If the grant request is funded it would help ease the burden of such an immense cost expenditure and partial
funds that have already been allocated would be used to ensure that all of mobile radios, base stations, and alerting
systems would be purchased in bulk and at discounted pricing. Not obtaining AFG funds would ruin these opportunities.
There is no back-up plan by Broward County in the event that a partner city is unable to purchase P25 complaint station
alerting systems before the switch. Cities would be forced to take funds from other capital projects, secure loans, raise
taxes, or dip into state mandated reserve funds.
AFG funds will help mitigate these problems & save taxpayer dollars while bringing all 13 applicant fire departments into
compliance with the P25 standard. We will also benefit from the new functionality that the P25 system provides. AFG
funds will allow us to replace our, soon to become, unusable station alerting systems to ensure compatibility with the new
P25 Phase II system and to maintain interoperability and safety.
* Section # 3 Statement of Effect: How would this award impact the daily operations of your department? How would this
award impact your department's ability to protect lives and property in your community? *4000 characters
New base stations, mobile radios, and supporting equipment will directly benefit daily operations and those of our
community. As noted under our Department Characteristics, we serve 288 square miles with 1,239,407 residents (plus over
272,072 seasonal), thousands of businesses and millions of tourists annually. Together we have 75 fire stations that handle
2,227 fires per year and a Fire Training Academy that meets the training needs of over 35 different fire departments in eight
counties. All funding for this project will go toward procuring the base stations, mobile radios, and the equipment needed to
make the system fully functional. The base station and alerting system will be used on all response calls in order to protect
life and property, as well as during regular training for this equipment. Our 288 square mile region is not a simple contiguous
square. We are spread out in many directions and utilize mutual/automatic aid agreements heavily. This grant is essential
to provide this equipment in order to safely and effectively respond to the increasing number of calls we receive daily. Total

annual calls increased from about 228,589 in 2014 to 249,210 in 2016, which represented a 9% increase in only three
years. Mutual/Auto aid calls also remain a significant source of call volume, equating to 12,090 for 2016. In addition to the
potential for man-made disaster, the South Florida region is located in hurricane alley where we face the annual threat of
storm devastation. These storms have wiped out entire portions of the state, as they did during hurricanes Andrew (1992),
Wilma (2005), Irma (2016). The proposal will greatly enhance first responder safety by supporting efforts to comply with
P25 standards for components. Responding with our current base station, mobile radios and supporting equipment will
shortly not be an option to us. Our dispatch in Broward County is centralized at the county level under civilian
administration, and the county is unilaterally switching to a Phase 2, P25 compliant system in December of 2018 which is
not compatible with our current analog technology. The County has allocated no funding for the municipalities and has
simply handed down the timeline for transition without agreement from the affected municipalities in regards to that timeline
or associated costs. Our backs are against the wall. For example, with the new dispatch system and our current Zetron
systems, we will not have the interoperability that is so necessary in fire and EMS. Instead of one interoperable system,
our agencies will become 29 individual islands. At best, individual patches will need to be created between each agency in
order for them to receive the interagency communications. This includes each and every call that we run. The newer digital
base stations and mobile radios are capable of transmitting & receiving data and will be compatible with many of all of our
surrounding agencies, furthering our interoperability. The equipment collectively purchased with this committee will all be P-
25 compliant. Interoperability enhancement through this grant will allow us to better alert our firefighters to all calls and
better serve our communities as a whole. Even if this transition were not happening, our system would require replacement
as the technology is over 20 years old. We are experiencing limited system upgrade options, diminishing manufacturer
support, and issues with equipment end of life, radio frequency interference, inadequate system user capacity, coverage
gap areas, and lack of back-up system capabilities. These are all issues that would be improved with P-25 compliant base
stations, mobile radios, and the equipment needed to make the system fully functional, such as speakers, message
boards, antennae and other necessary components.

11738; (c) protection of wetlands pursuant to EO 11990; (d) evaluation of flood hazards in floodplains in
accordance with EO 11988; (e) assurance of project consistency with the approved State management
program developed under the Coastal Zone Management Act of 1972 (16 U.S.C. §§1451 et seq.); (f)
conformity of Federal actions to State (Clean Air) Implementation Plans under Section 176(c) of the
Clean Air Act of 1955, as amended (42 U.S.C. §§7401 et seq.); (g) protection of underground sources
of drinking water under the Safe Drinking Water Act of 1974, as amended (P.L. 93-523); and, (h)
protection of endangered species under the Endangered Species Act of 1973, as amended (P.L. 93-
205).
12. Will comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. Section 1271 et seq.) related to
protecting components or potential components of the national wild and scenic rivers system.
13. Will assist the awarding agency in assuring compliance with Section 106 of the National Historic
Preservation Act of 1966, as amended (16 U.S.C. 470), EO 11593 (identification and protection of
historic properties), and the Archaeological and Historic Preservation Act of 1974 (16 U.S.C. 469a-1 et
seq.).
14. Will comply with P.L. 93-348 regarding the protection of human subjects involved in research,
development, and related activities supported by this award of assistance.
15. Will comply with the Laboratory Animal Welfare Act of 1966 (P.L. 89-544, as amended, 7 U.S.C. 2131
et seq.) pertaining to the care, handling, and treatment of warm blooded animals held for research,
teaching, or other activities supported by this award of assistance.
16. Will comply with the Lead -Based Paint Poisoning Prevention Act (42 U.S.C. Section 4801 et seq.)
which prohibits the use of lead based paint in construction or rehabilitation of residence structures.
17. Will cause to be performed the required financial and compliance audits in accordance with the Single

Signature on this form provides for compliance with certification requirements under 44 CFR Part 18, "New Restrictions on
Lobbying; and 44 CFR Part 17, "Government -wide Debarment and Suspension (Non -procurement) and Government -wide
Requirements for Drug -Free Workplace (Grants)." The certifications shall be treated as a material representation of fact
upon which reliance will be placed when the Department of Homeland Security (DHS) determines to award the covered
transaction, grant, or cooperative agreement.
1. Lobbying
A. As required by the section 1352, Title 31 of the US Code, and implemented at 44 CFR Part 18 for persons (entering)
into a grant or cooperative agreement over $100,000, as defined at 44CFR Part 18, the applicant certifies that:
(a) No Federal appropriated funds have been paid or will be paid by or on behalf of the undersigned to any
person for influencing or attempting to influence an officer or employee of any agency, a Member of
Congress, an officer or employee of congress, or an employee of a Member of Congress in connection with
the making of any Federal grant, the entering into of any cooperative agreement and extension, continuation,
renewal amendment or modification of any Federal grant or cooperative agreement.
(b) If any other funds than Federal appropriated funds have been paid or will be paid to any person for
influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer
or employee of congress, or an employee of a Member of Congress in connection with this Federal grant or
cooperative agreement, the undersigned shall complete and submit Standard Form LLL, "Disclosure of
Lobbying Activities", in accordance with its instructions.
(c) The undersigned shall require that the language of this certification be included in the award documents
for all the sub awards at all tiers (including sub grants, contracts under grants and cooperative agreements
and sub contract(s)) and that all sub recipients shall certify and disclose accordingly.
2. Debarment, Suspension and Other Responsibility Matters (Direct Recipient)
A. As required by Executive Order 12549, Debarment and Suspension, and implemented at 44CFR Part 67, for prospective
participants in primary covered transactions, as defined at 44 CFR Part 17, Section 17.510-A, the applicant certifies that it
and its principals:
(a) Are not presently debarred, suspended, proposed for debarment, declared ineligible, sentenced to a denial
of Federal benefits by a State or Federal court, or voluntarily excluded from covered transactions by any
Federal department or agency.
(b) Have not within a three-year period preceding this application been convicted of or had a civilian judgment
rendered against them for commission of fraud or a criminal offense in connection with obtaining, attempting
to obtain or perform a public (Federal, State, or local) transaction or contract under a public transaction;
violation of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery,
falsification or destruction of records, making false statements, or receiving stolen property.
(c) Are not presently indicted for or otherwise criminally or civilly charged by a government entity (Federal,
State, or local) with commission of any of the offenses enumerated in paragraph (1)(b) of this certification:
and
(d) Have not within a three-year period preceding this application had one or more public transactions
(Federal, State, or local) terminated for cause or default; and
B. Where the applicant is unable to certify to any of the statements in this certification, he or she shall attach an
explanation to this application.
3. Drug -Free Workplace (Grantees other than individuals)

As required by the Drug -Free Workplace Act of 1988, and implemented at 44CFR Part 17, Subpart F, for grantees, as
defined at 44 CFR part 17, Sections 17.615 and 17.620:
(A) The applicant certifies that it will continue to provide a drug -free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture, distribution,
dispensing, possession, or use of a controlled substance is prohibited in the grantee's
workplace and specifying the actions that will be taken against employees for violation of such
prohibition;
(b) Establishing an on -going drug free awareness program to inform employees about:
(1) The dangers of drug abuse in the workplace;
(2) The grantees policy of maintaining a drug -free workplace,
(3) Any available drug counseling, rehabilitation and employee assistance
programs; and
(4) The penalties that may be imposed upon employees for drug abuse violations
occurring in the workplace;
(c) Making it a requirement that each employee to be engaged in the performance of the grant
to be given a copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a condition of
employment under the grant, the employee will:
(1) Abide by the terms of the statement and
(2) Notify the employee in writing of his or her conviction for a violation of a
criminal drug statute occurring in the workplace no later than five calendar days
after such conviction.
(e) Notifying the agency, in writing within 10 calendar days after receiving notice under
subparagraph (d)(2) from an employee or otherwise receiving actual notice of such conviction.
Employers of convicted employees must provide notice, including position title, to the
applicable DHS awarding office, i.e. regional office or DHS office.
(f) Taking one of the following actions, against such an employee, within 30 calendar days of
receiving notice under subparagraph (d)(2), with respect to any employee who is so convicted:
(1) Taking appropriate personnel action against such an employee, up to and
including termination, consistent with the requirements of the Rehabilitation Act of
1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a drug abuse
assistance or rehabilitation program approved for such purposes by a Federal,
State, or local health, law enforcement or other appropriate agency.
(g) Making a good faith effort to continue to maintain a drug free workplace through
implementation of paragraphs (a), (b), (c), (d), (e), and (f).
(B) The grantee may insert in the space provided below the site(s) for the performance of work done in
