R-2018 Z� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, RATIFYING THE ORIGINAL EMERGENCY PURCHASE ORDER NO. 2000991 IN THE AMOUNT OF $1,000,000; APPROVING AN INCREASE TO EMERGENCY PURCHASE ORDER NUMBER 200991 FOR DISASTER DEBRIS REMOVAL IN AN AMOUNT NOT TO EXCEED $400,000.00; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO TAKE THE NECESSARY STEPS TO EFFECTUATE THE APPROVED INCREASE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac is responsible for providing emergency engineering and public works services in the event of a disaster, including, but not limited to, clearance of debris and restoration of critical public services; and WHEREAS, via Resolution No. R-2017-36, the City Commission of the City of Tamarac authorized an Agreement between the City of Tamarac and Ashbritt, Inc. for disaster debris removal services; and WHEREAS, on September 7, 2017, the City Manager issued an emergency declaration in anticipation of Hurricane Irma, in accordance with Section 6-148 (c) of the Tamarac Procurement Codes; and WHEREAS, on September 7, 2017, the City of Tamarac issued a Notice to Proceed (NTP) and Emergency Purchase Order No. 200991 in the amount of $1,000,000.00 to Ashbritt, Inc. in preparation for Hurricane Irma and to facilitate disaster recovery activities; and WHEREAS, the estimated final cost of the debris removal work performed by Ashbritt, Inc. is projected to be $1,380,028.77; and Temp. Reso. 13144 July 11, 2018 Page 2 of 4 WHEREAS, in order to close out the project, the Public Services Director, the Financial Services Director, and the Purchasing and Contracts Manager, recommend the City Commission of the City of Tamarac approve an increase to Emergency Purchase Order No. 2000991; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to increase Emergency Purchase Order No. 200991 with Ashbritt, Inc. for disaster debris removal services in an amount not to exceed $400,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof, and all exhibits referenced and attached hereto are incorporated herein and made a specific part of this resolution. SECTION 2: The City Commission HEREBY ratifies the original Emergency Purchase Order No. 2000991 in the amount of $1,000,000. SECTION 3: The City Commission HEREBY approves an increase to Emergency Purchase Order No. 200991 in an amount not to exceed $400,000.00 and the appropriate City Officials are hereby authorized to take the necessary steps to effectuate the increase to Emergency Purchase Order No. 200991 for disaster debris removal and disposal services. SECTION 4: An additional expenditure in an amount not to exceed Temp. Reso. 13144 July 11, 2018 Page 3 of 4 $400,000.00 for disaster debris removal and disposal services is hereby approved. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any count of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
