R-2018- C16 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE THE PURCHASE OF FITNESS EQUIPMENT FROM GYM SOURCE USA, LLC, AT A COST NOT TO EXCEED $175,974.13, UTILIZING BROWARD COUNTY SCHOOL BOARD CONTRACT #16-097N; AUTHORIZING AN APPROPRIATION OF $113,887. PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac Fitness Center has offered a friendly, non- competitive workout environment for our residents, employees, and surrounding neighbors for the past 18 years; and WHEREAS, the City of Tamarac Fitness Center currently has fitness equipment consisting of Life Fitness machines, treadmills, elliptical cross trainers, recumbent lifecycles, stationary bikes, free weights, and more; and WHEREAS, the age of the existing fitness equipment ranges from 10-18 years old which has already exceeded the average 10-year expected lifecycle for fitness equipment; and WHEREAS, fitness equipment endures substantial use and to meet current trends in fitness, an upgrade to existing equipment is needed to improve client satisfaction, keep up with other area fitness centers and incorporate the latest technology to improve client results and increase safety; and WHEREAS, City of Tamarac Code, §6-148 allows the Purchasing Manager the authority to waive purchasing procedures and purchase equipment which is the subject of contracts with the State of Florida, the Unites States Government, or with other government agencies; and Temp. Reso #13138 June 19, 2018 Page 2 n WHEREAS, Gym Source USA, LLC, provided a quote for the acquisition cost in the amount of $175,974.13 for the requested fitness equipment and the removal and replacement of existing equipment, attached hereto as Exhibit "'I"; and WHEREAS, the proposed fitness equipment pricing is per Broward County School Board Contract # 16-097N, attached hereto as Exhibit ' 2"; and WHEREAS, the Director of Financial Services and the Director of Parks and Recreation recommend the purchase of new fitness equipment; and WHEREAS, funding for this purchase is available in the Parks and Recreation Aquatics Division budget; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to purchase new fitness equipment from Gym Source USA, LLC, at a cost not to exceed $175,974.13 per the quote attached hereto as Exhibit "'I". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits referenced herein are incorporated and made a specific part of this resolution. SECTION 2: The appropriate City Officials hereby authorize the purchase of fitness equipment from Gym Source USA, LLC, utilizing Broward County School Board Contract # 16-097N, for a cost not to exceed $175,974.13. Temp. Reso #13138 June 19, 2018 Page 3 SECTION 3: An appropriation in the amount of $113,887 is hereby authorized and will be included in a budget amendment prior to November 30, 2018. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
