R-2017- 12,3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE REQUEST TO DEVIATE FROM THE CITY OF TAMARAC CODE OF ORDINANCES SECTION 10-266(a) IN REFERENCE TO LOWERING OUR FINISH FLOOR ELEVATION FOR THE FAIRFIELD INN, COLONY WEST CLUBHOUSE AND CART BARN PROJECT LOCATED AT 6800, 6850 AND 6900 NW 88th AVENUE, TAMARAC, FL 33321; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Mr. Clifford R. Loutan, P.E. Engineer of Record has requested to deviate from the City of Tamarac Code of Ordinances Section 10-266 (a) in reference to lowering finish floor elevation for the Fairfield Inn, Colony West Clubhouse and Cart Barn Project (the "Project") (see attached request letter Exhibit # 1); and WHEREAS, the contour as shown on the one -hundred -year flood elevation map indicates the minimum elevation of the first floor level of buildings to be constructed. In order to comply with the requirements of the Federal Flood Insurance Program, a one - hundred -year flood elevation map has been adopted by the Board of County Commissioners; and WHEREAS, the governing factor for the elevations of the first floor level is the one - hundred -year contour, or eighteen (18) inches above the crown of the nearest road for residential buildings or six (6) inches above the crown of the nearest road for nonresidential buildings, whichever is higher; and Temp. Reso. #13031 October 25, 2017 Page 2 of 4 WHEREAS, the City of Tamarac Master South Florida Water Management District permit conditions and grading parameters have been defined within the permit, establishing minimum road grade elevation of 10.00' NGVD (8.5' NAVD) and First -Floor Elevation of 12.00' NGVD (10.50' NAVD) for any development or re -development within the City; and WHEREAS, the proposed development of the Fairfield Inn, Colony West Clubhouse and Cart Barn project located at 6800, 6850 and 6900 NW 88th Avenue, Tamarac, FL 33321 will be constructed and maintained as a master planned project, subject to a Unified Control Agreement; and WHEREAS, the Project will be built at an elevation of 12.50' NGVD (1 1.00'NAVD) which is six inches above the one -hundred -year contour elevation specified in the Flood Insurance Map and it will also meet the South Florida Water Management District permit requirements; and WHEREAS, in accordance with Section 10-266 (b), The City Engineer recommends that the City Commission of the City of Tamarac approve the request to deviate from the City of Tamarac Code of Ordinances Section 10-266 section (a), allowing the Engineer of Record forthe design of the Fairfield Inn, Colony West clubhouse and Cart Barn, to setthe proposed first floor elevation at 12.50' NGVD (11.00' NAVD). n Temp. Reso. #13031 October 25, 2017 Page 3 of 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution upon adoption hereof. All exhibits attached hereto are incorporated herein and made a specific part hereof. SECTION 2: The city commission hereby approves and permits a lesser evaluation option as set forth in Section 10-266(b) of the City Code and the appropriate City Officials are hereby authorized to accept the request of alternative (b) of City of Tamarac Code of Ordinance Section 10-266 (a), allowing the Engineer of Record for the design of the Fairfield Inn, Colony West Clubhouse and Cart Barn, to set the proposed first floor elevation at 12,50' NGVD (11.00' NAVD). SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application; it shall not affect the validity of the remaining portions or applications of this Resolution. Section (a) in reference to lowering our finish floor elevation for the Fairfield Inn and Colony West Clubhouse and Cart Barn project located at 6800 NW 881 Avenue, Tamarac, Fl. 33321. As you are aware, this site is part of the City of Tamarac Master SFWMD permit No.: 06-00072-5. Permit conditions and grading parameters have been defined within this permit, establishing minimum road grade elevation of 10.00' NGVD (8.50' NAVD) and floor elevation of 12.0' NGVD (10.50' NAVD) for any development or re -development within the basin. As part of our analysis of this site, we reviewed all applicable requirements listed below and met with the permitting agencies to establish finish floor elevations. Based on our analysis, the regulatory agencies determined we were in conformance with having no adverse water quality or water quantity impacts on the site and surrounding area and therefore granted the following • permits (a) SFWMD Permit No.: 06-00072-S-72 and (b) Broward County Surface Water Management License No.: SWM 2017-048-0 for the site. Based on analysis and calculations, we utilized the following parameters to establish our floor elevations: • FEMA Flood Zone: AH Elev. =10.0' NAVD. • Broward County 100 yr. flood elevation map = 10.50' NAVD. • SFWMD Master Permit No.: 06-00072-S = El. 10.50' NAVD. • Calculated Pre -vs. -Post 100 yr. / 3-day analysis = 10.18'NAVD. • ASCE (Category II): BFE + 1 ft. = 11.00' NAVD • Adjacent road crown elevations were also examined along NW 88'h Avenue; however, due to the proximity of the intersection of McNab Road, it was determined that the road was elevated to match existing conditions and therefore, basing our finish floor elevation of 6" higher than the crown of the adjacent street would provide adverse impact to the existing basin and master permit by (a) losing basin surface storage and negatively impacting adjacent properties and (b) raising our site unnecessarily to match an abnormal existing condition. It is my professional opinion that the floor elevation (El.=11.00' NAVD) is set in accordance with requirements of the applicable regulatory agencies and is sufficiently elevated to be protected from the 100 yr. / 3-day flood event.
