R-2017- / J 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AMENDING THE BENEFITS PLAN FOR MEMBERS OF THE COMMISSION, APPOINTED OFFICIALS, EXECUTIVE, MANAGERIAL/PROFESSIONAL AND ADMINISTRATIVE NON -BARGAINING EMPLOYEES EFFECTIVE JANUARY 1, 2018; AUTHORIZING APPROPRIATE BUDGET TRANSFERS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the current Non -bargaining Benefit Plan was adopted through City Commission Resolution R-96-227 on October 9, 1996; and WHEREAS, the City now wishes to increase the benefit option package to the Benefit Plan; and WHEREAS, the City Manager and the Director of Human Resources recommend the approval of the modification to the benefit option package of the Benefit Plan; and WHEREAS, the proposed benefit option package modification will assist the City in attracting and retaining employees by providing a competitive package of benefits which is fair and cost effective for the City and its employees; and WHEREAS, funds are included in the Fiscal Year 2018 budget to cover the cost of the proposed benefit option package modification; and WHEREAS, the City Commission of the City of Tamarac, Florida has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to approve the Temp. Reso. #13032 Page 2 of 3 November 27, 2017 modification to the Benefit Plan for Members of the Commission, Appointed Officials, Executives, Managerial/Professional and Administrative non -bargaining employees. NOW, TEHREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits attached hereto are incorporated herein and made a specific part of the Resolution. SECTION 2: That the City Commission approves the modifications to the Benefit Plan outlined in Exhibit 1 (attached hereto and made a part of this Resolution hereof) and the City Manager is hereby authorized to implement the revised Benefit Plan outlined in Exhibit 1, and incorporated herein, and to undertake such acts as are necessary to implement the foregoing resolution, for Members of the Commission, Appointed Officials, Executive, Managerial/Professional, and Administrative Non - bargaining regular employees effective January 1, 2018. SECTION 3: That all appropriate budgetary transfers of funds necessary to implement this program are hereby authorized. SECTION 4: That all resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: That if any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, Temp. Reso. #13032 Page 3 of 3 November 27, 2017 in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon passage and adoption. GOREN CITY ATTORNEY 0 Temp Reso. 13032 Page 1 of 3 November 27, 2017 Exhibit I BENEFIT PLAN The following benefit plan for Members of the Commission, Appointed Officials, and Executive, Managerial/Professional and Administrative non -bargaining full-time employees is effective January 1, 2018, except as noted. Benefit Options Members of the Commission, Appointed Officials, and Executive, Managerial/Professional and Administrative employees will receive a $1,850 Benefit Options package in calendar year 2018, or as established by the City Commission every calendar year. New employees will receive a pro -rated Benefit Option package after successfully completing their probationary period, where applicable. Vacation Vacation Leave shall accrue at the following rate for each non -bargaining category: Appointed and Executive 0 to the end of 4 years 5 to the end of 9 years 10 years + Manaaerial/Professional 0 to the end of 4 years 5 to the end of 9 years 10years + Administrative 0 to the end of 4 years 5 to the end of 9 years 10 years + All Above Categories 17 days (119 hrs) per year 20 days (140 hrs) per year 23 days (161 hrs) per year 15 days (105 hrs) per year 18 days (126 hrs) per year 21 days (147 hrs) per year 12 days (84 hrs) per year 15 days (105 hrs) per year 18 days (126 hrs) per year Vacation Leave may be accrued without limit for use only. Employees must use five (5) days of vacation in the fiscal year during which it is earned (after the first full year of employment) or it will be forfeited at the end of the fiscal year. The City Manager may extend this carryover to the end of the next fiscal year at his discretion. Up to a maximum of 350 hours of accrued vacation leave will be paid upon termination of employment with the City. Any balance of vacation leave over the 350 hours has no cash value. Sick Leave Sick Leave with pay shall be granted to Appointed Officials and to employees in the Executive, Managerial/Professional and Administrative job categories at the rate of seven (7) hours, or one (1) day, for each completed month of service and shall be accrued from year to year. Upon termination of employment, reimbursement will be made to Appointed Officials and Executive, Managerial/Professional and Administrative employees for twenty-five (25) percent of their accrued sick leave hours in excess of eighty-four (84) hours. The eighty-four (84) hours have no cash value. Personal Days Appointed Officials, and Executive, Managerial/Professional and Administrative employees will receive three (3) personal days converted as twenty-one (21) hours annually on the first day of the fiscal year. Personal days must be used in the fiscal year earned or it will be forfeited, and have no cash value. On the initial fiscal year of employment, personal days will be awarded as follows regardless of probationary status: Date of Hire October 1 October 2 — February 1 February 2 — June 1 Life Insurance Personal Days Awarded 3 days (21 hrs) 2 days (14 hrs) 1 day (7 hrs) Members of the Commission, Appointed Officials and Executive and Managerial/Professional employees will receive group term life insurance of $50,000 with the premium paid by the City. Administrative employees will receive group term life insurance of $25,000 with the premium paid by the City. Dental Insurance Members of the Commission, Appointed Officials and Executive Managerial/Professional and Administrative employees will receive dental insurance selected by the City with the premium paid by the City as follows: Employee only 100% Employee plus one dependent 50% Employee plus family 50% Tuition Assistance Full-time Executive, Managerial/Professional and Administrative employees who have completed at least one (1) year of continuous service are eligible for participation in the City's Education Assistance Program. Upon pre -approval of the Department Director and the Human Resources Department, an employee will receive tuition reimbursement for successfully completing an eligible training or educational course(s). An eligible course is one that either directly relates to the employee's current position, a similar City position, or to a higher level position within the City to which the employee could reasonably aspire through promotion (courses that are a requirement of a degree program may also be eligible for reimbursement). To receive tuition reimbursement the employee must attain a grade of "C" or better for undergraduate courses, or a grade of "B" or better for graduate courses, or a grade of "pass" in a pass/fail course, or a certificate of course completion in a certificate program. Effective August 1, 2009, employees will be reimbursed the in -state tuition and fee per credit hour cost at Florida Atlantic University. The maximum amount of tuition reimbursement per fiscal year is as follows: • For training programs and/or professional certifications, the City will reimburse up to a maximum of $1,000 per eligible employee, per fiscal year; or • For undergraduate courses, the City will reimburse up to a maximum $1,900 per eligible employee, per fiscal year; or • For graduate courses, the City will reimburse up to a maximum of $3,400 per eligible employee, per fiscal year. Employees who resign from the City within two (2) years of receiving tuition reimbursement are responsible for repaying the City the total amount of tuition reimbursement received during the two (2) years preceding their separation from the C ity. Pension Plan Members of the Commission, Appointed Officials and Full-time Executive, Managerial/Professional and Administrative employees must participate in mandatory defined benefit Elected and Appointed Officers' and Non -Represented Employees' Pension Trust Fund on the first day of employment. Employee contributions are at a rate of ten (10) percent of compensation, while the City contribution is determined by consulting actuaries. Members shall vest at the rate of twenty (20) percent for each completed year of service. Participants are 100% vested with five (5) years of credited service. An option of return of the member's contributions, plus interest, is available if an employee leaves the City prior to vesting at five years or leaving prior to eligibility for normal or early retirement. Disability Insurance Members of the Commission, Full-time Appointed Officials, and Executive, Managerial/Professional and Administrative employees who are covered under the 401(a) Retirement Plan are covered by long term disability insurance plan paid by the C ity. Members of the Commission and Appointed Officials Members of the Commission and Appointed Officials (City Manager and City Attorney) employed by the City will participate in the Elected and Appointed Officers' and Non - Represented Employees Retirement Plan, with the equivalent contributions from the City and the employee as applies to Executive employees. In the event an Appointed Official has a separate agreement, contract or amendments by Commission action, benefits specifically described in the agreement, contract or amendments by Commission action shall supersede this resolution.
