R-2017'� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AUTHORIZING PAYMENT OF A ONE TIME MERIT AWARD TO CITY MANAGER MICHAEL C. CERNECH, AS SET FORTH IN RESOLUTION NO. R-2011-04, PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Michael C. Cernech (hereinafter referred to as "CERNECH") has been employed as City Manager since January 29, 2011 pursuant to Resolution No. R-2011-04; and WHEREAS, the City Commission has reviewed CERNECH'S performance for the evaluation period of January 29, 2016 through January 28, 2017; and WHEREAS, CERNECH has exceeded the performance requirements established for the evaluation period; and WHEREAS, it is the express desire of the City Commission to continue to retain the services of CERNECH and to provide an inducement for him to remain in such employment and; WHEREAS, the City Commission desires to provide a one-time three percent (3%) merit award for accomplishments realized during the evaluation period; and WHEREAS, available funds have been appropriated and exist in the FY 2017 General Fund Budget; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in Temp. Reso # 12925 March 16, 2017 Page 2 the best interests of the citizens and residents of the City of Tamarac to award CERNECH a three percent (3%) merit award for his performance during the evaluation period. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission agrees to provide a three percent (3%) merit award to CERNECH based on his performance during the evaluation period of January 29, 2016 through January 28, 2017 as set forth in Resolution No. R-2011-04. SECTION 3: All necessary budget transfers are hereby approved. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption.
