No. 12939 April 12, 2017 Page 1 of 4 CITY OF TAMARAC, FLORIDA RESOLUTION R-2017- 43 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING NEW DEVELOPMENT SITE PLAN APPROVAL (WITH CONDITIONS) FOR WOODMONT COUNTRY CLUB MASTERPLAN, PHASE III, RESIDENTIAL DEVELOPMENT PROJECT, TO ALLOW FOR THE REDEVELOPMENT OF THE SUBJECT PROPERTY, FORMERLY KNOWN AS THE PINES GOLF COURSE, TO PERMIT THE CONSTRUCTION OF ONE HUNDRED, FIFTY- TWO (152) SINGLE FAMILY HOMES ON SIX (6) SEPARATE PARCELS FOR PROPERTIES LOCATED SOUTH OF SOUTHGATE BOULEVARD, NORTH OF NW 75T" STREET, EAST OF NORTH PINE ISLAND ROAD, AND WEST OF UNIVERSITY DRIVE, SITUATED ON VARIOUS PORTIONS OF THE FORMER "PINES GOLF COURSE", TAMARAC, FLORIDA (CASE NO. 4-SP-17); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Ken DeLaTorre, designated agent for the applicant, Pulte Home Company, LLC , is requesting approval of a New Development Site Plan to allow for the redevelopment of the subject property, formerly known as the Pines Golf Course, to permit the construction of one hundred fifty-two (152) single family homes on six (6) separate parcels ("Pods") located south of Southgate Boulevard, north of NW 75th Street, east of North Pine Island Road, and west of University Drive, situated on various portions of the former "Pines Golf Course", Tamarac, Florida; and WHEREAS, pursuant to Chapter 2, Article X and the City of Tamarac Code of Ordinances, , a public meeting has been advertised of the date, time and place of the meeting regarding the review of the petition for New Development Site Plan approval; and Temp. No. 12939 April 12, 2017 Page 2 of 4 WHEREAS, Director of Community Development recommends approval (with conditions); and WHEREAS, on April 5, 2017 the Planning Board recommended approval (with conditions); and WHEREAS, the City Commission has examined the application, the staff and Planning Board recommendations; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance with all elements of the Comprehensive Plan and the Land Development Regulations, prior to the issuance of a Certificate of Occupancy for the development; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac, Florida to grant approval of a New Development Site Plan to allow for the redevelopment of the subject property, formerly known as the Pines Golf Course, to permit the construction of one hundred fifty-two (152) single family homes in 6 separate Pods located south of Southgate Boulevard, north of NW 75th Street, east of North Pine Island Road, and west of University Drive, situated on various portions of the former "Pines Golf Course", Tamarac, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part of this resolution. No. 12939 April 12, 2017 Page 3 of 4 SECTION 2: That the application for the approval of a New Development Site Plan to allow for the redevelopment of the subject property, formerly known as the Pines Golf Course, to permit the construction of one hundred fifty-two (152) single family homes in 6 separate Pods, located south of Southgate Boulevard, north of NW 75th Street, east of North Pine Island Road, and west of University Drive, situated on various portions of the former "Pines Golf Course", Tamarac, Florida is hereby approved subject to the following conditions: 1. New Development Site Plan approval is contingent upon approval of the proposed Woodmont Country Club plat, Case No. 1-P-17, by the City of Tamarac and Broward County, and recordation of the approved plat in the Public Records of Broward County at the applicant's expense. 2. New Development Site Plan approval is contingent upon approval of the requested variances for the Woodmont Country Club, Case No. 6-B-16. 3. All requirements from the Amended and Restated Development Agreement between the City of Tamarac, Pulte Home Company LLC and Woodmont Country Club, Inc. shall be adhered to as part of this application. 4. Prior to the issuance of the first of the building permit for a residential home, the required public and private park impact fees shall be submitted to the City per code Section 10-296. 5. Prior to any paving, grading and drainage activities, a copy of Broward County's Environmental Resource Permit for the Woodmont Country Club Conceptual Master Plan shall be provided. Any modifications to the site, due to the surface water permit requirements, shall be reflected on the site plan. 6. Satisfaction of minor outstanding Development Review Committee comments from the review of the Site Plan for Woodmont Country Club, Case No. 4-SP-17. Temp. Reso. No. 12939 April 12, 2017 Page 4 of 4 SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its adoption. PASSED, ADOPTED AND APPROVED this day of , 2017.
