RESOLUTION R-2017- 50
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
APPROVING A VACATION OF EASEMENT
PETITION IN AN EFFORT TO VACATE A 20
FOOT PLATTED UTILITY EASEMENT LYING IN
A PARCEL OF LAND FOR THE SUBJECT
PROPERTY LOCATED AT 7801 N.W. 80
AVENUE AS FURTHER DESCRIBED IN THE
LEGAL DESCRIPTION ATTACHED HERETO AS
EXHIBIT A; (CASE NO. 2-P-17); PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the section of the subject Vacation of Easement (attached hereto as
Exhibit "A", incorporated herein and made a specific part thereof) was previously platted in
conjunction with the previously approved Woodmont development; and
WHEREAS, Keith and Associates, Inc., the designated agent for the property
owner, Woodmont Country Club, Inc. has requested a Vacation of Easement in order to
vacate a twenty (20) foot utility easement dedicated by Plat lying in a parcel of land as
described in the legal descriptions within the attached survey (Exhibit A, attached hereto
are incorporated herein and made a specific part thereof); and
WHEREAS, the City Engineer has been contacted and has stated no objection to
the Vacation of Easement of the 20 ft. utility easement; and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the Planning Board conducted a duly noticed public hearing and
recommended approval on May 3, 2017; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant the Vacation
of Easement in order to vacate a twenty (20) foot utility easement dedicated to the City by
Plat lying in a parcel of land as described in the legal descriptions within the attached
survey (Exhibit A, attached hereto are incorporated herein and made a specific part
thereof); located on a parcel of land situated at 7801 N.W. 80 Avenue, in order to
accommodate the Woodmont Country Cub redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
All exhibits attached hereto are incorporated herein and made a specific part of this
Resolution.
SECTION 2: That the Vacation of Easement in order to vacate a twenty (20)
foot utility easement dedicated to the City by Plat lying in a parcel of land located at 7801
N.W. 80 Avenue, IS HEREBY vacated.
SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its
adoption.

Dear Mr. Zickar;
On behalf of Woodmont County Club, Inc., property owner of the above referenced parcel, Keith and
Associates Inc. is requesting a vacation of a portion of a 20' platted utility easement which is located on a
parcel of land located at 7801 NW 80' Avenue. For a more detailed description of this utility easement,
please refer to attached Plat and Survey of the subject site.
This request to vacation a portion of the 20' platted utility easement is to allow for the construction of an
approved Clubhouse and Cart Barn building. All utility companies have provided no objection letters and
the applicant will continue to coordinate any necessary utility relocations as required.
This requests supports Policy 1.5 of the future land use element of the 2007 City of Tamarac
Comprehensive Plan which states, "The City will continue to promote "quality development" in all land
use categories by the establishment and implementation of design criteria and development standards in
the Land Development Code (LDQ which promote the highest standards of urban development and
community aesthetics". The vacation of this utility easement will allow the approved project to be
constructed per City development standards in the Land Development Code to achieve the highest
standards of urban development and community aesthetics.
