HomeMy WebLinkAboutCity of Tamarac Resolution R-2017-066Temp Reso #12941 May 31, 2017 Page 1 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 2017-- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ADOPTING A NEW SCHEDULE OF FEES FOR SERVICES FOR THE FIRE RESCUE DEPARTMENT, PURSUANT TO EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN; AS A RESULT OF THE CITY OF TAMARAC FLORIDA, JULY 2016 COST OF SERVICE STUDY BY MGT OF AMERICA, INC.; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE THE REVISED FIRE RESCUE FEES INCLUDING A PHASING SCHEDULE TO BECOME EFFECTIVE OCTOBER 1, 2017; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Tamarac Fire Rescue charges fees for services which are authorized under City Code of Ordinances Section 7-29 Fire Service Fees; and WHEREAS, Tamarac Fire Rescue provides services including but not limited to basic and advanced life support transport, building inspections, permitting, plan review, new construction review, life safety services, special details, fire watches, disaster management, and WHEREAS, Fire Rescue schedule of fees was originally adopted in 2004 via Resolution R-2004-194, and fees have not been revised since adopted in 2004; and WHEREAS, the schedule of Emergency Medical Services (EMS) transport fees was originally adopted in1999 via Resolution R-1999-270, and two revisions were approved in 2004 via Resolution R-2004-194 and in 2008 via Resolution R-2008-92; and WHEREAS, the EMS transport fees are appropriate and are not to be Temp Reso #12941 May 31, 2017 Page 2 adjusted in this proposal as they remain in full effect; and WHEREAS, the City of Tamarac Purchasing Department issued Fee Study RFP #15-04 for a Comprehensive Fee Study on February 1, 2015; and WHEREAS, MGT of America, Inc. was awarded the RFP #15-14R and an Agreement was issued to provide the City of Tamarac with a Comprehensive Cost of Service Analysis of the departments where services are being performed which user fees can be collected; and WHEREAS, a final report dated August 2016 for the Cost of Service Analysis provided by MGT of America, Inc. was issued to the City providing the cost of service results of the study; and WHEREAS, MGT of America, Inc. recommendation for each fee for services reflects the amount required to cover the full cost of providing the services; and WHEREAS, the Fire Chief and Financial Services Director recommend that the City Commission adopt the proposed fees including a phasing schedule for all multiple family residential inspection fees as follows: • 50% of increase beginning October 1, 2017 (FY18) • an additional 25% increase to 75% beginning October 1, 2019 (FY20) • an additional 25% increase to 100% beginning October 1, 2021 (FY22) WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to establish a new Fire Rescue Department Fee Schedule to reflect new fee amounts that are in line with industry standards for services and projects within the City. Temp Reso #12941 May 31, 2017 Page 3 NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are expressly incorporated herein and made a part hereof. SECTION 2: That the Fire Rescue Department Fee Schedule attached hereto as Exhibit A is hereby approved will become effective October 1, 2017. SECTION 3: That all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption.
