No. 12942 June 1, 2017 Page 1 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 2017- L A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, SETTING A NEW SCHEDULE OF FEES FOR THE COMMUNITY DEVELOPMENT DEPARTMENT TO BECOME EFFECTIVE OCTOBER 1, 2017, ATTACHED HERETO AS EXHIBIT "A", AS A RESULT OF THE CITY OF TAMARAC FLORIDA, AUGUST 2016 COST OF SERVICE STUDY BY MGT OF AMERICA, INC.; REPEALING RESOLUTION NO. R-2009- 45; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY: AND PROVIDING FOR AN EFFECTIVE nATP WHEREAS, the Land Development Regulations of the City of Tamarac Code of Ordinances authorizes the City Commission from time to time, to establish by resolution, the amount of application fees, and WHEREAS, Resolution No. R-2009-45, enacted by the City of Tamarac City Commission on April 7, 2009, amended and established the current development review fee schedule; and WHEREAS, modifications to the development review and code administration process, increases in administering costs associated with development review, code administration and inspection of projects necessitated the need for a review of fees currently being assessed; and WHEREAS, MGT of America, Inc. was retained by the City to perform a comprehensive analysis of the departments where services are being offered to citizens for which user fees can be collected; and Temp Reso. No. 12942 June 1, 2017 Page 2 WHEREAS, the Community Development Department offers an array of property development and code compliance related services to citizens for which user fees can be collected; and WHEREAS, MGT of America, Inc. has documented the cost of providing services for which service fees are, or could be assessed for the Community Development Department, which includes Planning and Zoning and Code Compliance fees, and has provided same into a Proposed Fee Schedule; and WHEREAS, MGT of America, Inc. recommended fee for each service is the amount required to cover the full cost of providing the service; and WHEREAS, the full cost fee as proposed by MGT of America, Inc. greatly exceeds the industry standard for community development and code administration related fees assessed by municipalities across Broward County; and WHEREAS, the Community Development Director has reviewed MGT of America Inc. proposed full cost community development and code compliance fees compared to fees assessed for the same service across Broward County and recommends the approval of a new Community Development Fee Schedule which is consistent with industry standards as opposed to a full cost of service recovery; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to establish a new Community Development Department Fee Schedule to reflect new fee amounts that are in line with industry standards for services and projects within the City. NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Temp Reso. No. 12942 June 1, 2017 Page 3 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are expressly incorporated herein and made a part hereof. SECTION 2: That the Community Development Department Fee Schedule attached hereto as Exhibit "A" and made a part hereof, is hereby approved, to become effective October 1, 2017. SECTION 3: That Resolution number R-2009-45 is hereby repealed in its entirety. SECTION 4: That all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. Temp Reso.
