No. 13277 May 22, 2019 Page 1 CITY OF TAMARAC, FLORIDA RESOLUTION R-2019-.5 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING NEW DEVELOPMENT SITE PLAN APPROVAL (WITH CONDITIONS) FOR THE TAMARAC CIRCLE RESIDENTIAL SUBDIVISION DEVELOPMENT, TO ALLOW FOR THE DEVELOPMENT OF THE SUBJECT PROPERTY, FORMERLY KNOWN AS TRACT "A" OF THE "COMROCK" PLAT AND REPLATTED AS THE "TAMARAC CIRCLE" PLAT, TO PERMIT THE CONSTRUCTION OF FIVE (5) SINGLE FAMILY HOMES ON FIVE (5) SEPARATE LOTS FOR THE PROPERTY LOCATED AT THE 5700 BLOCK OF ROCK ISLAND ROAD AT 5400-5440 NW 57 COURT, TAMARAC, FLORIDA (CASE NO. 11-SP-18); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Daniel A. Fee, P.E., CDI Engineering and Planning, designated agent for the property owner, Gaddis Properties, LLC, is requesting approval of a New Development Site Plan to allow for the development of the property, P P subjectformerly known as Tract "A" of the "Comrock" plat and replatted as the "Tamarac Circle" plat, to permit the construction of five (5) single family homes on five (5) separate lots located at the 5700 block of Rock Island Road at 5400-5440 NW 57 Court, Tamarac, Florida; and WHEREAS, pursuant to Chapter 2, Article X and the City of Tamarac Code of Ordinances, a public meeting has been advertised of the date, time and place of the meeting regarding the review of the petition for New Development Site Plan approval; and WHEREAS, Director of Community Development recommends approval (with conditions, as agreed to by the Applicant); and WHEREAS, on June 5, 2019, the Planning Board recommended approval (with conditions, as agreed to by the Applicant); and Temp. No. 13277 May 22, 2019 Page 2 h CityCommission has examined the application,WHEREAS t e the staff and Planning Board recommendations; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance with all elements of the Comprehensive Plan and the Land Development Regulations, prior to the issuance of a Certificate of Occupancy for the development; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac, Florida to grant approval of a New Development Site Plan to allow for the development of the subject property, formerly known as Tract"A"of the"Comrock" plat and replatted as the"Tamarac Circle" plat, to permit the construction of five (5) single family homes on five (5) separate lots located at the 5700 block of Rock Island Road at 5400-5440 NW 57 Court, Tamarac, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part of this resolution. SECTION 2: That the application for the approval of a New Development Site Plan to allow for the development of the subject property, formerly known as Tract "A" of the"Comrock" plat and replatted as the"Tamarac Circle" plat, to permit the construction of five (5) single family homes on five (5) separate lots located at the 5700 block of Rock Temp. Reso. No. 13277 May 22, 2019 Page 3 Island Road at 5400-5440 NW 57 Court, Tamarac, Florida is hereby approved subject to the following conditions, as agreed to by the Applicant: 1. New Development Site Plan approval is contingent upon approval of the proposed "Tamarac Circle" plat, Case No. 3-P-18, by the City of Tamarac and Broward County, and recordation of the approved plat in the Public Records of Broward County at the applicant's expense. 2. Commencement of construction shall begin no later than one (1)year from the date of approval. If the development does not commence construction within one (1) year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. 3. Satisfaction of minor outstanding Development Review Committee comments from the review of the proposed Site Plan for Tamarac Circle, Case No. 11-SP-18. 4. Pavement arrows shall be installed on NW 57 Court (one [1] on the north roadway segment, one [1] on the south roadway segment, and one [1] on the east roadway segment) and "Do Not Enter" signs shall be installed on the north-south leg of NW 57 Court, adjacent to Rock Island Road, in order to provide a one-way counterclockwise traffic flow. 5. Security camera(s) shall be installed at the entrance of the community. 6. A proportionate fair share, reasonable contribution shall be made to the City's Wall Program for the construction of a wall on Rock Island Road, a portion of which is within the Wall and Planting Screen (W.P.S.) Easement dedicated pursuant to the Tamarac Circle plat. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp. Reso. No. 13277 May 22, 2019 Page 4 SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its adoption.
