A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DETERMINING THAT THE WESTPOINT DEVELOPMENT OF REGIONAL IMPACT IS ESSENTIALLY BUILT -OUT AS PROVIDED IN SECTION 380.06(15)(g)3., FLORIDA STATUTES; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY: AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac, Florida ("City") adopted Ordinance 89-44 on December 21, 1989 to approve a Development Order for the Westpoint Development of Regional Impact ("Westpoint DRI") pursuant to Chapter 380, Florida Statutes; and WHEREAS, the Westpoint DRI encompasses that property described in Exhibit "A", which is attached hereto and incorporated herein by reference; and WHEREAS, the DRI Development Order adopted by Ordinance 0-89-44 was thereafter amended by Ordinance No. 0-94-20 adopted on November 9, 1994; by Resolution No. R-2000-206, adopted July 12, 2000; by Ordinance No. 0-2000-33 adopted November 22, 2000; by Ordinance No. 0-2004-14 adopted April 28, 2004; by Ordinance No. 0-2004-42 adopted December 22, 2004; and by Ordinance No. 0-2016- 17 adopted November 9, 2016; and WHEREAS, less than 7 of the original 158 acres in the Westpoint DRI remain undeveloped; and WHEREAS, of the remaining undeveloped acreage: the City is the Owner of approximately 2.24 acres; TT of Lighthouse Point LLC is the Owner of approximately 2.8 acres; and Community Christian Church of Fort Lauderdale, Inc. is the owner of approximately 1.72 acres (collectively the "Owners of Undeveloped DRI Acreage"); and Temp. No. 12862 October 26, 2016 Page 1 of 2 WHEREAS, the Owners of the Undeveloped DRI Acreage wish to be assured that the expiration of the Westpoint DRI will not prevent them from developing their property; and WHEREAS, Section 380.06(15)(g)3, Florida Statutes, permits development within the Westpoint DRI to continue beyond the build out date provided that the development meets the criteria for being Essentially Built Out; and WHEREAS, the City Commission held a public hearing to consider this Essentially Built Out determination, with notice provided to the owners of property within the Westpoint DRI; and WHEREAS, following those public hearings and based upon the facts set forth in this Resolution, the City Commission has determined that the Westpoint DRI is Essentially Built Out as set forth in this Resolution. C NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1. The foregoing "WHEREAS" clauses set forth above are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2. The City Commission hereby makes the following Findings. 1. The development of the Westpoint DRI is approved for 216,539 square feet of Commercial use of which 45,000 square feet is reserved for automobile dealership, and 1,021,635 square feet of Office use. Temp. Reso. No. 12862 October 26, 2016 Page 3 of 10 2. The industrial and hotel uses originally approved by the Westpoint DRI are no longer subject to DRI thresholds. 3. The amount of Commercial and Office use remaining to be built is 100,000 square feet of Commercial use of which 1,418 square feet is reserved for automobile dealership; and 197,400 square feet of Office Use. 4. Section 380.06(15)(g)3, Florida Statutes provides the following criteria for determining that a DRI is Essentially Built Out; • All mitigation requirements in the development order have been satisfied, and • All developers are in compliance with all applicable terms and conditions of the development order except the build out date for development, and • The amount of proposed development that remains to be built is less than 40% of any applicable development of regional impact threshold. 5. All mitigation requirements of the Westpoint DRI Development Order have been satisfied. 6. The Westpoint DRI is in compliance with all applicable terms and conditions of the development order. 7. The remaining Office, Commercial and Multi (Mixed) Use square footage available under the Westpoint DRI is less than 40% of any applicable threshold as shown on Exhibit B. SECTION 3. Based upon the above Findings of Fact, the Westpoint DRI is hereby determined to be Essentially Built Out pursuant to Section 380.06(15)(g)3, Florida Statutes. Temp. Reso. No. 12862 October 26, 2016 Page 4 of 10 SECTION 4. The remaining Office and Commercial development shown in Exhibit B may be developed without further DRI review or DRI approvals. SECTION 5. The development of other uses not subject to current DRI Thresholds may be developed without further DRI review or approval. SECTION 6. Future redevelopment of parcels within the previously developed parcels of the Westpoint DRI shall not be considered as part of a "common plan of development," but rather the redevelopment of any such parcel shall be evaluated on its own against DRI Thresholds to determine whether a new DRI approval is required for the redevelopment of that parcel. SECTION 7. Any modification to the terms of this Essentially Built Out Resolution shall be processed in accordance with the provisions of Florida Statutes in effect at the time of the modification SECTION 8. Nothing in this resolution shall be interpreted to prevent an owner of property within the DRI, from seeking a rescission of the Westpoint DRI in the future, in the event that state law is amended so that the Westpoint DRI qualifies for rescission. SECTION 9. If any clause, section, or other part or application this Resolution shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated and so not affecting the validity of the remaining portions or applications remaining in full force and effect. SECTION 10. All Resolutions or parts of Resolutions in conflict with this Resolution are repealed to the extent of such conflict. SECTION 11. This Resolution shall become effective immediately upon passage and adoption. Temp. Reso.
