A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, DECLARING THE RESULTS OF THE
REFERENDUM ELECTION VOTING AT THE NOVEMBER 8, 2016
ELECTION ON AMENDMENTS TO THE CITY CHARTER: ORDINANCE
NO. 0-2016-06 ARTICLE XII, DELETING SECTION 12.06 ENTITLED
"RESIDENTIAL GROWTH CONTROL" TO ELIMINATE REDUNDANCY
SINCE THE CITY'S RESIDENTIAL GROWTH CONTROL REGULATION IS
OTHERWISE CONTEMPLATED BY THE CITY'S COMPREHENSIVE PLAN;
ORDINANCE NO. 0-2016-07 AMENDING ARTICLE VI, SECTION 6.03
ENTITLED "REDISTRICTING" REQUIRING THE ENGAGEMENT OF A 4-
YEAR UNIVERSITY TO CONDUCT A REDISTRICTING ANALYSIS AND
PROVIDE FOR REDISTRICTING EVERY 10 YEARS FOLLOWING THE
DECENNIAL CENSUS, OR SOONER IF MANDATED BY LAW;
ORDINANCE NO. 0-2016-08 ARTICLE X ENTITLED "CITY CLERK"
AMENDING SECTION 10.01 ENTITLED "APPOINTMENT AND
COMPENSATION" AMENDING SECTION 10.03 ENTITLED "SUSPENSION
OR REMOVAL" TO PROVIDE FOR CONSISTENCY BETWEEN THE CITY
CLERK POSITION AND THE POSITION OF OTHER CITY DEPARTMENT
HEADS; ORDINANCE NO. 0-2016-09 ARTICLE V ENTITLED "CITY
MANAGER" AND IN PARTICULAR AMENDING SECTION 5.04 ENTITLED
"POWERS AND DUTIES OF THE CITY MANAGER" DELETING THE
REFERENCE TO THE CITY'S BUILDING OFFICIAL TO PROVIDE FOR
CONSISTENCY WITH THE BUILDING OFFICIAL POSITION AND THE
POSITION OF OTHER CITY DEPARTMENT HEADS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, a Referendum Election was held on November 8, 2016, wherein the
electorate was asked to vote on amendments to the Charter of the City of Tamarac; and
WHEREAS, the Broward County Canvassing Board has canvassed the results of
the machine voting and absentee ballots and has certified such results to the City Clerk of
the City of Tamarac; and
WHEREAS, the City Clerk has reviewed the certification from the Broward County
Canvassing Board and has presented their findings to the City Commission for a formal
Certification and Declaration of the results; and

WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interests of the citizens and residents of the City of Tamarac to declare the results
of the Referendum Election voting at the November 8, 2016 election on amendments to the
City Charter: Ordinance No. 0-2016-06 Article XII, deleting Section 12.06 entitled
"Residential Growth Control" to eliminate redundancy since the City's Residential Growth
Control Regulation is otherwise contemplated by the City's Comprehensive Plan,
Ordinance No. 0-2016-07 amending Article VI, Section 6.03 entitled "Redistricting"
requiring the engagement of a 4-year university to conduct a redistricting analysis and
provide for redistricting every 10 years following the decennial census, or sooner if
mandated by law; Ordinance No. 0-2016-08 Article X entitled "City Clerk" amending
Section 10.01 entitled "Appointment and Compensation" amending Section 10.03 entitled
"Suspension or Removal" to provide for consistency between the City Clerk position and
the position of other City Department Heads; Ordinance No-2016-09 Article V entitled "City
Manager" and in particular amending Section 5.04 entitled "Powers and Duties of the City
Manager" deleting the reference to the City's Building Official to provide for consistency
with the Building Official position and the position of other City Department Heads.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the following is hereby certified and declared as the official results
of the public vote at the Referendum Election of November 8, 2016, for the proposed
Charter Amendments:

ORDINANCE NO. 0-2016-06: Article XII, deleting Section 12.06 entitled "Residential
Growth Control" to eliminate redundancy since the City's Residential Growth Control
Regulation is otherwise contemplated by the City's Comprehensive Plan:

SECTION 2: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 3: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 4: This Resolution shall become effective immediately upon its passage
and adoption.
