R-2016- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING A REFUND OF $2,000.00 SUBMITTED BY LAZARO ALVAREZ, OWNER OF LEADERS OF TOMORROW LEARNING CENTER, AS A RESULT OF THE WITHDRAWAL OF A SPECIAL EXCEPTION APPLICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 28, 2016, Lazaro Alvarez, owner of Leaders of Tomorrow Learning Center ("Applicant"), submitted a Special Exception application fee to the Community Development Department in the amount of $2,000.00 for the Leaders of Tomorrow Learning Center Special Exception project, and WHEREAS, after the submittal of the Special Exception application and justification letter, (attached hereto as Exhibit 1 ", incorporated herein and made a specific part thereof) the Community Development Department staff determined that the subject business cannot be expanded as it is currently a legal nonconforming use; and WHEREAS, the Community Development Department staff has determined that the Special Exception application fee of $2,000.00 submitted by Lazaro Alvarez, owner of Leaders of Tomorrow Learning Center should be refunded as minimal resources were used to review the application; and WHEREAS, the Director of Community Development recommends approval of the application fee refund; and 1 Temp Reso. No. 12777 April 27, 2016 Page 2 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac, Florida to authorize a refund in the amount of $2,000.00 submitted by Lazaro Alvarez, owner of Leaders of Tomorrow Learning Center, for the Special Exception application fee, collected for the Leaders of Tomorrow Learning Center project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: That the City Commission hereby authorizes the appropriate City Officials to refund the Special Exception application fee for the Leaders of Tomorrow Learning Center project in the amount of $2,000.00 made payable to Leaders of Tomorrow Learning Center, Inc., 8747 NW 57th Street, Tamarac, Florida 33351. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. n 1 Temp Reso. Notary Public State of Florida Type or Print Name of Notary My Commission Expires: March 22, 2016 Application for Approval to Expand Existing Special Exemption Leaders of Tomorrow Learning Center 8747 NW 57 Street Tamarac, FL 33351 Project Description Lazaro Alvarez, Designated Agent for the property owner, Fred Sultan, is requesting approval to expand the existing Special Exemption for 8747 NW 57 Street to include 8741 NW 57 Street. These locations are situated within Casa Linda a Tamarac Plaza on the corner of Pine Island Blvd and 57th Street. The property is zoned an MXD (Mixed Use). The purpose of this request is to allow the existing school to expand their facility, thereby allowing them to better serve their community. Background The property is zoned MXD (Mixed Use District) and has a Future Land Use Designation of "Commercial." Casa Linda Plaza was initially built in 1977. Casa Linda is approximate 1.5 acres and is currently developed as a strip retail commercial facility containing 16, 800 square feet of retail, restaurant and commercial uses. The property was rezoned from a B-1 (Neighborhood Business District) commercial zoning district to MXD in 2005 as a part of the Towncenter corridor project, Phase 2. The playground tVill remain at the rear of the property and the drop-off spaces for parents will continue to be the same three (3) adjacent to this commercial bay. General Information • The facility will operate as a private school. They will service children from the ages 12months — 12 years old. We currently have a capacity for 79 children during the hours of 6:30am to 6:30pm Monday through Friday • Children will be dropped off/picked up by a parent or guardian in the designated parking spaces adjacent to the bay to avoid any traffic. • The facility is currently staffed by seven (7) employees and all are currently fulltime. Criteria for Granting Special Exception • Leader of Tomorrow is an established school operating under the existing special exemption granted by the City of Tamarac, Florida that wishes to expand their current premises. Since we have opened in September of 2012 there has been no occasion with the public health, safety or general welfare. We do not anticipate that the expansion will cause any impact to the public's health safety or general welfare. • Expanding the existing Special Exception would have no noticeable impact on the character of the immediate neighborhood, as a portion as a portion of the school has operated as a school since 2009. The expansion of the school is a natural progression in order to better serve the needs of the community. • Casa Linda can be accessed from multiple entry points, one along Pine Island Blvd and another on NW 57th Street. • No exterior changes are planned and the building will continue to conform to the established criteria.
