R-2015- _ 0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING APPROVAL OF THE SPECIAL EXTENDED HOURS PERMIT REQUESTED BY COLONY WEST GOLF MANAGEMENT. (dba: COLONY WEST GOLF CLUB), MANAGER OF THE COLONY WEST GOLF COURSE ON BEHALF OF THE OWNER, THE CITY OF TAMARAC, TO EXTEND THE HOURS OF THE ON -PREMISE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES AND TO OPEN FOR BUSINESS AT 7:00 A.M. ON WEEKDAYS INCLUDING SUNDAYS, PURSUANT TO CHAPTER 3, SECTION 3-5 OF TO THE CITY OF TAMARAC CODE OF ORDINANCES., FOR THE COLONY WEST GOLF MANAGEMENT, LLC (DBA: COLONY WEST GOLF CLUB) LOCATED AT 6800 NW 88 AVENUE; PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac, Florida, has found that neighboring cities have legislated extended hours for the on -premise sale and consumption of alcoholic beverages; and WHEREAS, the City of Tamarac Code of Ordinance Chapter 3, Section 3-5 provides for the granting of a Special Extended Hours Permit for the on -premise sale and consumption of alcoholic beverages and establishes a Special Extended Hours Permit fee and all conditions for City Commission approval; and WHEREAS, on June 15, 2015, Colony West Golf Management, LLC (dba: Colony West Golf Club), Manager of the Colony West Golf Course on behalf of the Owner, the City of Tamarac, requested a Special Extended Hours Permit to extend the hours of the on - premise sale and consumption of alcoholic beverages and to open for business at 7:00 Temp. No. 12658 June 15, 2015 Page 1 a.m. on weekday, including Sundays attached hereto as Exhibit I"); and WHEREAS, the Director of Community Development recommends approval of the Special Extended Hours Permit for the on -premise sale and consumption of alcoholic beverages and to open for business at 7:00 a.m. on weekdays, including Sundays for the Colony West Golf Management, LLC. (dba: Colony West Golf Club); and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to grant approval of the Special Extended Hours Permit, requested by Colony West Golf Management, LLC (dba: Colony West Golf Club), to extend the hours of the on -premise sale and consumption of alcoholic beverages and to open for business at 7:00 a.m. on weekdays including Sundays for a period of three (3) years, pursuant to the City of Tamarac Code of Ordinances, Chapter 3, Section 3-5 , for the Colony West Golf Management, LLC (dba: Colony West Golf Club) located at 6800 NW 88 Avenue, Tamarac, Florida, subject to the following findings; • That there is no adverse impact on the surrounding area that is attributed to an increased parking demand. • That there is no adverse impact on the surrounding area that would warrant an increase in law enforcement demands. • That there is no increased environmental and aesthetic impact, including generation of noise. Light and odors on the surrounding area. • The City and Colony West Golf Management, LLC has the ability to minimize any of the above listed effects. 1 Temp. Reso. No. 12658 June 15, 2015 Page 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the granting of approval for the Colony West Golf Management, LLC (dba: Colony West Golf Club) located at 6800 NW 88 Avenue, Tamarac, Florida, to extend the hours of on -premise sale and consumption of alcoholic beverages and to open for business at 7:00 a.m. on weekdays including Sundays for a period of three (3) years from the date of this approval is contingent upon the City of Tamarac receiving a current State of Florida Department of Business Regulation Division of Alcoholic Beverages and Tobacco License (attached hereto as Exhibit "2"). SECTION 3: That proper insurance coverage is provided to the City of Tamarac in connection with the Special Extended Hours Permit for the on -premise sale and consumption of alcoholic beverages and to open for business at 7:00 a.m. on weekdays including Sundays (attached hereto as Exhibit "3") SECTION 4: That pursuant to the City of Tamarac Code of Ordinances, Chapter 3, Section 3-5 , approval of the Special Extended Hours Permit for the on -premise sale and consumption of alcoholic beverages is approved for the following extended hours and conditions: Temp. Reso. No. 12658 June 15, 2015 Page 1 1. On weekdays, including Sundays, the hours of sale may be extended to 7:00 a.m. (i.e., one (1) hour earlier than the standard 8:00 a.m. opening); 2. For New Year's Eve (December 31), the hours of sale maybe extended to 4:00 a.m. on New Year's Day (January 1); 3. For St. Patrick's Day (March 17), the hours of sale maybe extended to 4:00 a.m. (March 18), 4. The Special Extended Hours Permit is for a three (3) year period only and must be renewed every three (3) years by City Commission approval; 5. The Special Extended Hours Permit is not transferable to any other party without approval of the City Commission of the City of Tamarac, Florida. 6. That the above listed findings for granting of an extended hours special permit shall also be grounds for revocation if the impact of such extended hours is injurious to the health, safety and welfare of City residents. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
