R-2014- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING NEW DEVELOPMENT SITE PLAN APPROVAL (WITH CONDITIONS) FOR THE CHELSEA PLACE TOWNHOUSE DEVELOPMENT PROJECT, TO ALLOW FOR THE CONSTRUCTION OF A SIXTY-EIGHT (68) UNIT TOWNHOUSE DEVELOPMENT, FOR THE SUBJECT PROPERTIES LOCATED ON THE NORTH SIDE OF WEST COMMERCIAL BOULEVARD AND ON THE EAST AND WEST SIDES OF NW 59 AVENUE, AT 5931 AND 5981 WEST COMMERCIAL BOULEVARD (SPECIFICALLY A PORTION OF TRACT 14, OF FORT LAUDERDALE TRUCK FARMS OF SECTION 11, TOWNSHIP 49 SOUTH, RANGE 41 EAST, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 4, PAGE 31, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA) (CASE NO. 9-SP-14); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVI-DING FOR AN EFFECTIVE DATE. WHEREAS, Scott Backman, Esq., of Dunay, Miskel, Backman & Blattner, LLP, and Jonathan Keith, P.E., designated agents for the property owner, Woodlands THJV; LLC, c/o Perry Ventures, LLC, are requesting approval of a New Development Site Plan petition to allow for the construction of sixty-eight (68) unit townhouse development; and WHEREAS, pursuant to the instructions of the City Commission of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the petition for New Development Site Plan approval; and WHEREAS, Director of Community Development recommends approval (with conditions); and Temp. No. 12554 September 24, 2014 Page 2 WHEREAS, the Planning Board recommended approval (with conditions) on September 3, 2014; and WHEREAS, the City Commission has examined the application, the staff and Planning Board recommendations; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance with all elements of the Comprehensive Plan prior to the issuance of a Certificate of Occupancy for the development; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac, Florida to grant New Development Site Plan approval (with conditions) for the Chelsea Place Townhouse Development project, to allow for the construction of a sixty-eight (68) unit townhouse development, for the property located on the north side of West Commercial Boulevard, on the east and west sides of NW 59 Avenue, at 5931 and 5981 W Commercial Boulevard (specifically a portion of Tract 14, of Fort Lauderdale Truck Farms of Section 11, Township 49 South, Range 41 East, according to the Plat thereof as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION L The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part of this resolution. No. 12554 September 24, 2014 Page 3 SECTION 2: That the application for the New Development Site Plan approval (with conditions) for the Chelsea Place Townhouse Development project, to allow for the construction of a sixty-eight (68) unit townhouse development, for the property located on the north side of West. Commercial Boulevard, on the east and west sides of NW 59 Avenue, at 5931 and 5981 W Commercial Boulevard (specifically a portion of Tract 14, of Fort Lauderdale Truck Farms of Section 11, Township -49 South, Range 41 East, according to the Plat thereof as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida) is HEREBY APPROVED subject to the following conditions: 1. New Development Site Plan approval is contingent upon the approval of a local Small Scale Land Use Plan Amendment to change the City of Tamarac Future Land Use designation on a portion of the subject properties from "Recreation" to "Low Density Residential." 2. New Development Site Plan approval 1s contingent upon approval of the rezoning to change the zoning classification of the subject properties from R-1 C (Single Family Residential) to R-3 (Low Density Multifamily District). 3. New Development Site Plan approval is contingent upon the granting of twenty-six (26) reserve units to increase the residential density permitted on the subject properties from forty-two (42) to sixty-eight (68) dwelling units. 4. New Development Site Plan approval is contingent upon approval of the proposed Chelsea Place plat by the City of Tamarac and Broward County, and recordation of the approved plat in the Public Records of Broward County at the applicant's expense. 5. New Development Site Plan approval is contingent upon approval of a limited parking waiver to allow parking spaces for the townhouse driveways at eight (8) feet in width where a minimum width of nine (9) feet is required and to allow the NW 58 Temp. Reso. No. 12554 September 24, 2014 Page 4 Lane cul-de-sac at a distance of fifteen (15) from the W Commercial Boulevard right-of-way where a minimum distance of twenty-five (25) feet is required. 6. Homeowners association documents shall be approved by the City of Tamarac, recorded in the Public Records of Broward County at the applicant's expense, and a recorded copy provided to the City of Tamarac prior to the issuance of building permit for construction of townhouses. 7. Following plat recordation and prior to the issuance of any permit for development, a Unity of Title to unify Parcel A and Parcel B of the proposed Chelsea Place plat shall be completed by the applicant, approved by the City of Tamarac, executed by the property owner, and recorded in the Public Records of Broward County at the applicant's expense. 8. The ornamental fence proposed along the W Commercial Boulevard frontage shall match the design of the "Custom 6 FT Masonry Column with 6 FT Fence" within the City of Tamarac Major Arterial Corridor Study. 9. New Development Site Plan approval does not authorize approval of the proposed entrance wall signage. 10. Water shall be provided within the proposed lake and maintained in an acceptable condition at a minimum level of twelve (12) feet in depth at all times. 11. Satisfaction of outstanding Development Review Committee comments from the review of the New Development Site Plan for Chelsea Place, Case #9-SP-14. SECTION I All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Temp. Reso. No. 12554 September 24, 2014 Page 5 Resolution. SECTION 5: adoption.
