CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2014-�
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, ENCOURAGING INSTALLATION
OF A BUS STOP AT NW 95T" AVENUE AT THE ENTRANCE
TO THE WILLIAM "BILL" KLING VA CLINIC; ENCOURAGING
REINSTATEMENT OF THE BUS STOP AND INSTALLATION
OF A CROSSWALK AND ON DEMAND TRAFFIC SIGNAL ON
THE NORTH SIDE OF COMMERCIAL BOULEVARD
IMMEDIATELY ACROSS FROM THE WILLIAM "BILL" KLING
VA CLINIC; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, The William "Bill" Kling VA Clinic (VA Clinic) is located on the south
side of Commercial Boulevard at 9800 West Commercial Boulevard, Sunrise Florida,
33351; and
WHEREAS, our veterans who access the VA Clinic have made innumerable
sacrifices to protect our freedom and our entire nation owes them a debt of gratitude
and holds them in the highest regard; and
WHEREAS, there was a bus stop located immediately across from the VA Clinic
on the north side of Commercial Boulevard; and
WHEREAS, those seeking to access the VA Clinic via that bus stop on the
County bus system were forced to cross Commercial Boulevard, a six lane highway,

with posted speeds of 45 miles per hour; and
WHEREAS, in an attempt to ensure safe passage for those who attempted to
access the VA Clinic, multiple requests were made to Broward County to fund and
install an on demand traffic light and crosswalk, or alternately, to consider revising the
bus route so that Veterans seeking to utilize the VA Clinic were not tasked with crossing
Commercial Boulevard; and
WHEREAS, Broward Traffic Engineering performed a traffic
determined that a light and crosswalk was not warranted at this location; and
study and
WHEREAS, on October 2, 2014 the dangerous conditions surrounding use of the
stop had not yet been resolved and a veteran seeking to access the VA Clinic was
struck and killed while trying to cross Commercial Boulevard from the bus stop on the
north side of Commercial Boulevard; and
WHEREAS; on October 6, 2014 a meeting took place at the VA Clinic attended
by Federal, County and Municipal officials to seek solutions to this dangerous condition;
and

WHEREAS, the Broward County Transit Authority subsequently removed the stop
on the north side of Commercial Boulevard, across from the VA Clinic, encouraging
those seeking to access the VA Clinic to utilize the bus stop closest to Nob Hill Road
and the existing crosswalk at Nob Hill Road and Commercial Boulevard; and
WHEREAS, this solution requires our military veterans to walk a quarter mile to
Nob Hill Road to access. the existing cross walk and then walk another two tenths of a
mile to the VA Clinic; and
WHEREAS, it is not reasonable to expect our elderly and physically challenged
veterans utilizing the bus system to walk such a distance to access the VA Clinic; and
WHEREAS, the City Commission of the City of Tamarac feels strongly that our
veterans who have sacrificed their safety to ensure the safety of all of us should not
have to face further hardship nor be placed in jeopardy accessing the services of the VA
Clinic.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and

confirmed as being true and correct and are hereby made a specific part of this
resolution.
SECTION
2: The City of
Tamarac hereby urges
our United States Senators,
Congressional
Representatives,
and the Broward .
County Board of County
Commissioners to install a bus stop on 95t" avenue at the entry to the VA Clinic so that
those accessing the VA Clinic can be assured safe access.
SECTION 3: Alternatively, or in addition, the Broward County Board of County
Commissioners is urged to consider reestablishment of the bus stop immediately across
from the VA Clinic on the north side of Commercial Boulevard and installation of a cross
walk and on demand traffic light.
SECTION 4: The City Clerk is hereby directed to distribute a copy of this
resolution to the Mayor and elected officials of each municipality in Broward County, the
Broward County Board of County Commissioners, the Broward County Transit
Authority, the Broward County Traffic Engineering Department, The Broward League of
Cities and those United States Senators and Congressional Representatives who
represent Broward County.
SECTION 5: All resolutions or parts of resolution in conflict herewith are hereby
repealed to the extent of such conflict.

SECTION 6: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 7: This Resolution shall become effective upon its passage and
adoption.
