RESOLUTION NO. R-2014-93
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, APPROVING A SIGN
VARIANCE PETITION FROM CERTAIN
REQUIREMENTS OF CHAPTER 18, SIGNS AND
ADVERTISING, TAMARAC CODE OF ORDINANCES
FOR THE PUBLIX SUPERMARKET PROJECT;
SPECIFICALLY LOCATED AT 4121 WEST
COMMERCIAL BOULEVARD IN THE SUNSHINE PLAZA
(A PORTION OF TRACTS 7 AND 8 OF FORT
LAUDERDALE TRUCK FARMS SUBDIVISION OF
SECTION 13, TOWNSHIP 49 SOUTH, RANGE 41 EAST,
AS RECORDED IN PLAT BOOK 4, PAGE 31 OF THE
PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA)
(CASE NO. 1-B-14); PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Section of 18-65(b)(1) of Chapter 18, Signs and Advertising of the
Code of Ordinances of the City of Tamarac, Florida provides for the granting of a Sign
Variance petition; and
WHEREAS, Gregory T. Davis, Thomas Sign & Awning, Designated Agent for the
property owner, GMM Sunshine, LLC., is requesting approval of a Sign Variance petition to
allow for the installation of three (3) facade signs located on the front facade of Publix
where only one (1) sign is permitted and to allow the facade signs to display the ancillary
uses of the occupant where only the primary use of the occupant is permitted; for the
property specifically located at 4121 West Commercial Boulevard in the Sunshine Plaza (A
portion of Tracts 7 and 8 of Fort Lauderdale Truck Farms Subdivision of Section 13,
Township 49 South, Range 41 East, as recorded in Plat Book 4, Page 31 of the public
records of Broward County, Florida); and

WHEREAS, the proposed Sign Variance is in compliance with the City's
Comprehensive Plan as it supports the City's Goals, Objectives and Policies regarding
neighborhoods (residential and non-residential) that are attractive, well maintained, and
that contribute to the health, safety, and welfare of their residents and users; and
WHEREAS, the Planning Board recommended approval of this application at its
February 5, 2014 public hearing; and
WHEREAS, the City Commission of the City of Tamarac finds that approving the
petition for a Sign Variance would be in keeping with the public health, safety and general
welfare of the City of Tamarac; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac, Florida to approve
this Sign Variance petition to allow for the installation of three (3) facade signs located on
the front facade of Publix where only one (1) sign is permitted and to allow the facade signs
to display the ancillary uses of the occupant where only the primary use of the occupant is
permitted; for the property specifically located at 4121 West Commercial Boulevard in the
Sunshine Plaza (A portion of Tracts 7 and 8 of Fort Lauderdale Truck Farms Subdivision of
Section 13, Township 49 South, Range 41 East, as recorded in Plat Book 4, Page 31 of
the public records of Broward County, Florida).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION L
The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.

SECTION 2: That this Sign Variance petition to approve various facade signs
and to provide relief from the following requirements of Chapter 18, Signs and Advertising,
of Tamarac Code of -Ordinances, as shown below:
• Section 18-65(b)(2), to allow for the installation of three (3) facade signs located on
the front facade of Publix Supermarket where only one (1) sign is permitted;
• Section 18-51(18)(b)(4), to allow for the facade signs to display the ancillary uses of
the occupant where only the primary use of the occupant is permitted;
for the Publix Supermarket project; specifically located at 4121 West Commercial
Boulevard in the Sunshine Plaza (A portion of Tracts 7 and 8 of Fort Lauderdale Truck
Farms Subdivision of Section 13, Township 49 South, Range 41 East, as recorded in Plat
Book 4, Page 31 of the public records of Broward County, Florida); and is HEREBY
APPROVED.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4:
If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
