R-2014 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO APPROVE CHANGE ORDER NUMBER 1 TO THE AGREEMENT WITH PRESTIGE PROPERTY MANAGEMENTAND MAINTENANCE, INC. FOR LANDSCAPE MAINTENANCE SERVICES OF CERTAIN PUBLIC RIGHTS -OF -WAY AND CITY PARKS, - AUTHORIZING AN AMOUNT NOT TO EXCEED $82,500 TO BE ADDED TO THE CONTRACT FOR VARIABLE COST SERVICES FOR A TOTAL ANNUAL COST OF $1,084,200; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Mayor and City Commission deem it to be in the best interest of the citizens, residents, and businesses of the City of Tamarac to maintain City Rights -of -Way, Public Parks, and other green spaces around City Facilities through proper landscape maintenance services provided in a cost-effective and efficient manner; and WHEREAS, via Resolution R-2010-154, dated December 8, 2010, the City Commission of the City of Tamarac authorized an Agreement with Prestige Property Management and Maintenance, Inc. for the provision of grounds maintenance and irrigation repair services for City -owned property, a copy of the Agreement is incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, via Resolution R-2012-132, dated November 28, 2012, the City Commission approved Amendment Number 1 to the Agreement with Prestige Property Temp. Reso. # 12536 September 24, 2014 Page 2 Management and Maintenance, Inc., for the landscape maintenance services, a copy of the Amendment No. 1 is incorporated herein by reference and on file in the office of the City Clerk, and WHEREAS, the City has identified additional propertywhich would be cost-effective to be maintained by Prestige Property Management and Maintenance, Inc.; and WHEREAS, it is the recommendation of the Public Services Director and the Purchasing and Contracts Manager that the appropriate City Officials execute Change Order Number 1 to the Agreement with Prestige Property Management and Maintenance, Inc., for the landscape maintenance services; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interest of the citizens and residents of the City of Tamarac to execute the Change Order No. 1 to the Agreement for landscape services with Prestige Property Management and Maintenance, Inc., at a cost not to exceed $82,500.00 for variable cost services for an annual cost not to exceed $1,084,200. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Temp. Reso. # 12536 September 24, 2014 Page 3 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are hereby incorporated herein and made a specific part of this resolution. SECTION 2: The City Commission hereby approves Change Order Number 1 to the Agreement with Prestige Property Management and Maintenance, Inc., ("the Agreement") and the appropriate City Officials are hereby authorized to execute Change Order Number 1 hereto attached as "Exhibit 1", to provide landscape maintenance services. SECTION 3: An additional expenditure in an amount not to exceed of $82,500.00 for variable cost services for an annual cost not to exceed $1,084,200 is hereby approved for the term of the Agreement. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
