R-2013- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPOINTING HARRY DRESSLER TO FILL THE VACANCY IN THE POSITION OF VICE MAYOR, PURSUANT TO SECTION 4.03 OF THE CITY CHARTER; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on November 28, 2012, Commissioner Michelle Gomez was elected to serve as Vice Mayor of the City of Tamarac ("City") pursuant to Section 4.03 of the City Charter; and WHEREAS, Commissioner Gomez was "bumped" from office as a result of Commissioner Patricia Atkins-Grad's reinstatement to the City Commission as the District 2 representative, thereby creating a vacancy in the position of Vice Mayor; and WHEREAS, Section 4.03 of the City Charter provides that, "in the event of a vice -mayoral vacancy, a majority of the commission shall elect a new vice -mayor who shall serve the remainder of the unexpired term"; and WHEREAS, the City Commission seeks to appoint Harry Dressler to serve as Vice Mayor for the balance of the term vacated by Commissioner Gomez, until November 2013; and Temp Reso #12296 December 27, 2012 Page 2 WHEREAS, the City Commission finds that appointing Harry Dressler to serve as Vice Mayor is in best interest of the health, safety, and welfare of the residents and citizens of the City of Tamarac. NOW, THEREFORE, be it resolved by the City Commission of the City of Tamarac, Florida: Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2. The City Commission of the City of Tamarac, Florida, hereby appoints Harry Dressler to fill the vacancy in the position of Vice Mayor pursuant to Section 4.03 of the City Charter. Section 3. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Section 5. This Resolution shall become effective immediately upon its passage and adoption.
