RESOLUTION NO. R-2013-Ids
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, APPROVING (WITH
CONDITION) A SIGN VARIANCE PETITION FROM
CERTAIN REQUIREMENTS OF CHAPTER 18, SIGNS
AND ADVERTISING, TAMARAC CODE OF
ORDINANCES FOR THE WAL-MART NEIGHBORHOOD
MARKET STORE PROJECT; SPECIFICALLY LOCATED
AT 6921 NW 88 AVENUE IN THE FORMER BABY LOVE
PLAZA (A PORTION OF THE FLORIDA FRUIT LAND
COMPANY'S SUBDIVISION NO. 21 OF SECTION 5,
TOWNSHIP 49 SOUTH, RANGE 41 EAST, AS
RECORDED IN PLAT BOOK 1, PAGE 102 OF THE
PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA); PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section of 18-65(b)(1) of Chapter 18, Signs and Advertising of the
Code of Ordinances of the City of Tamarac, Florida provides for the granting of a Sign
Variance petition; and
WHEREAS, Gregory Johnson, Cuhaci & Peterson Architects, designated agent as
attorney for the property owner, Misala, Inc., is requesting approval of a Sign Variance
petition to allow for the installation of various wall signs for the Wal-Mart Neighborhood
Market Store project; specifically located at 6921 NW 88 Avenue in the former Baby Love
Plaza (A portion of the Florida Fruit Land Company's Subdivision No. 2, of Section 5, , -`
Township 49 South, Range 41 East, as recorded in Plat Book 1, Page 102 of the public
records of Palm Beach County, Florida); and

WHEREAS, the proposed Sign Variance is in compliance with the City's
Comprehensive Plan as it supports the City's Goals, Objectives and Policies regarding
neighborhoods (residential and non-residential) that are attractive, well maintained, and
that contribute to the health, safety, and welfare of their residents and users; and
WHEREAS, the Planning Board recommended approval of this application at its
September 4, 2013 public hearing; and
WHEREAS, the City Commission of the City of Tamarac finds that approving the
petition for a Sign Variance would be in keeping with the public health, safety and general
welfare of the City of Tamarac; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac, Florida to approve
(with condition) this Sign Variance petition to allow for the installation of various wall signs
for the Wal-Mart Neighborhood Market Store project; specifically located at 6921 NW 88
Avenue in the former Baby Love Plaza (A portion of the Florida Fruit Land Company's
Subdivision No. 2, of Section 5, Township 49 South, Range 41 East, as recorded in Plat
Book 1, Page 102 of the public records of Palm Beach County, Florida).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:

SECTION L The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That this Sign Variance petition to approve of various wall signs
and to provide relief from the following requirements of Chapter 18, Signs and Advertising,
of Tamarac Code of Ordinances, as shown below:
• Section 18-65(b)(1), to allow two (2) facade signs per street frontage for a total of
four (4) facade signs, and to allow two (2) facade signs per facade;
• Section 18-51(18)a., to allow for a maximum graphic height of twenty-seven (27)
inches for the logo displayed on the Walmart Neighborhood Market fagade sign on
the W McNab Road fagade;
• Section 18-51(18)b.1.(a), to allow for an increased graphic height of one (1) inch for
every rounded increment of twenty-two (22) feet the building to receive a facade
sign is from the property line of the primary street right-of-way for the logo displayed
on the Walmart Neighborhood Market fagade sign;
• Section 18-51(18)b.4., to allow the non-residential fagade sign to display the
secondary use of the- occupant as "Pharmacy Drive-Thru";
for the Wal-Mart Neighborhood Market Store project; specifically located at 6921. NW 88
Avenue in the former Baby Love Plaza (A portion of the Florida Fruit Land Company's
Subdivision No. 2, of Section 5, Township 49 South, Range 41 East, as recorded in Plat
Book 1, Page 102 of the public records of Palm Beach County, Florida); and is HEREBY
APPROVED subject to the following condition:

1. Provide a fagade sign displaying "Walmart Neighborhood Market" on the
West McNab Road frontage in the location on the south elevation shown on
the Exterior Elevations, Sheet A2, of the Site Development Plans for Major
Revised Site Plan for Case #32-SP-12 approved by the City Commission on
April 24, 2012, at a maximum letter height of eighteen (18) inches and a
maximum graphic height of twenty-seven (27) inches for the logo displayed
on the Walmart Neighborhood Market fagade sign, in the same design, color,
illumination method and method of construction as the fagade sign displaying
"Walmart Neighborhood Market" on the NW 88 Avenue (Pine island Road)
frontage.
SECTION I
All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4:
If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
