R-2013- d F A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A SPECIAL EXCEPTION PETITION WITH CONDITIONS TO ALLOW FOR A NIGHTCLUB WITH THE SALE AND ON -SITE CONSUMPTION OF ALCOHOLIC BEVERAGES FOR THE PROPOSED VINTAGE WINE AND SPORTS BAR PROJECT WITHIN A B-2 (PLANNED COMMUNITY BUSINESS) ZONING DISTRICT PURSUANT TO THE PERMITTED USES MASTER LIST, SECTION 24-434, TAMARAC CODE OF ORDINANCES; FOR THE PROPERTY LOCATED AT 5303 NORTH STATE ROAD 7 (ALL OF COMMERCIAL PLAZA, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN THE PLAT BOOK 82, PAGE 50, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA) (CASE NO. 1-Z-13); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR _ SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE nATF WHEREAS, the Code of Ordinances of the City of Tamarac, Florida provides for the granting of a Special Exception with conditions to allow for a nightclub with the sale and on - site consumption of alcoholic beverages for the proposed Vintage Wine and Sports Bar within a B-2 (Planned Community Business) zoning district pursuant to the Permitted Uses Master List, Section 24-434, Tamarac Code of Ordinances to be located 5303 North State Road 7 (all of Commercial Plaza, according to the Plat thereof, as recorded in the Plat Book 82, Page 50, of the public records of Broward County, Florida); and WHEREAS, the proposed Special Exception is in compliance with the City's Comprehensive Plan as it supports the City's Goals, Objectives and Policies regarding neighborhoods (residential and nonresidential) that are attractive, well maintained, and that contribute to the health, safety, and welfare of their residents and users; and Temp Reso #12318 March 27, 2013 Page 2 WHEREAS, the proposed Special Exception is consistent with the adjacent residential neighborhoods relative to the proposed intensity, building mass, and aesthetic impact of the requested use; and WHEREAS, the Planning Board recommended approval of this application at its March 6, 2013 public hearing; and WHEREAS, the City Commission of the City of Tamarac finds that granting the petition for Special Exception would be in keeping with the public health, safety and general welfare of the City of Tamarac; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this Special Exception petition with conditions to allow for a nightclub with the sale and on -site consumption of alcoholic beverages for the proposed Vintage Wine and Sports Bar within a B-2 (Planned Community Business) zoning district pursuant to the Permitted Uses Master List, Section 24-434, Tamarac Code of Ordinances to be located 5303 North State Road 7 (all of Commercial Plaza, according to the Plat thereof, as recorded in the Plat Book 82, Page 50, of the public records of Broward County, Florida) NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That this Special Exception petition to allow for a nightclub with the sale and on -site consumption of alcoholic beverages for the proposed Vintage Wine and Sports Bar within a B-2 (Planned Community Business) zoning district pursuant to the Temp Reso #12318 March 27, 2013 Page 3 Permitted Uses Master List, Section 24-434, Tamarac Code of Ordinances to be located 5303 North State Road 7 (all of Commercial Plaza, according to the Plat thereof, as recorded in the Plat Book 82, Page 50, of the public records of Broward County, Florida) is HEREBY APPROVED subject to the following conditions: 1. The special exception is transferable administratively pursuant to compliance with City Codes, the submittal of all required documentation and the payment of all related fees. 2. The hours of operation shall be Sunday through Thursday from 10:00 a.m. until Midnight, and Friday and Saturday from 10:00 a.m. until 2:00 a.m. 3. Adequate security, including Broward Sheriff's Office details, when required shall be provided during entertainment offerings and evening hours. 4. The sale of alcohol shall be limited to beer and wine only and shall be subject to Chapter 3, Tamarac Code of Ordinances. 5. All improvements approved pursuant to Case No. 22-SP-08, for the related Minor Revised Site Plan, through the City's Development Review Committee, including Phase 4; to be completed within one (1) year of the special exception approval from the City Commission. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
