RESOLUTION NO. R-2013- 37
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING A REFUND OF $1,500.00
SUBMITTED BY HOWARD JABLOW, P.E., OF
AJ HYDRO ENGINEERING, INC. DESIGNATED
AGENT FOR THE PROPERTY OWNER, LAGO
TAMARAC, LLC., FOR A DELEGATION
REQUEST APPLICATION FEE, COLLECTED IN
CONJUNCTION WITH THE PARK PLACE AT
WOODMONT PROJECT (CASE NO. 7-MI-13);
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on February 19, 2013, Howard Jablow, P.E., of AJ Hydro Engineering,
Inc., designated agent for the property owner, Lago Tamarac, LLC., submitted a Delegation
Request development application to the Community Development Department with a check
in the amount of $1,500.00 for the Park Place at Woodmont project; and
WHEREAS, after the submittal of the Delegation Request application and the
submittal of the revised justification letter, (attached hereto as Exhibit 1", incorporated
herein and made a specific part thereof) the Community Development Department staff
determined that this application was not needed for the project; and
WHEREAS, the Community Development Department staff has determined that the
Delegation Request application fee of $1,500.00 submitted by Howard Jablow, P.E., of AJ
Hydro Engineering, Inc., designated agent for the property owner, Lago Tamarac, LLC.,
should be refunded as minimal resources were used to process this application; and
WHEREAS, the Director of Community Development recommends approval of the
application fee refund; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac, Florida to authorize
a refund in the amount of $1,500.00 submitted by Howard Jablow, P.E., of AJ Hydro
Engineering, Inc., designated agent for the property owner, Lago Tamarac, LLC., for the
Delegation request application fee, collected for the Park Place at Woodmont project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution;
all exhibits attached hereto are incorporated herein and made a specific part of this
Resolution.
SECTION 2: That the City Commission hereby authorizes the appropriate
City Officials to refund the Delegation Request application fee for the Park Place at
Woodmont project in the amount of $1,500.00 made payable to Klemow, Inc., 6950 Griffin
Road, Suite C8, Davie, Florida 33314.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in
part or in application, it shall not affect the validity of the remaining portions or applications
of this Resolution.

We will remove the Delegation Request from the City Commission agenda. I believe the fee of $1500 has been
deposited which means we will have to get CC approval to refund that amount which we will process (using your below
email as request to do this). The item with the fence will not hold up your public hearing path, it was simply restated to
make sure it will be dealt with which has been communicated by yourself and the petitioner adequately.

I have a couple of comments for your consideration. First, item 1 under Community Development of
the DRC comments indicate that the City wants the developer to obtain a letter from the single family
property owner that he will remove the portion of his fence that encroaches onto the site. Howard
Jablon has been told that this item will not move forward until that letter is received. The removal of
the fence will occur prior to the development of the property and the developer does not need the
property owner's permission to remove an encroachment. We have no reason to believe that the
single family property owner will have any objections to the removal of this portion of the fence but it
will be handled one way or the other. Please remove the requirement that we get consent from this
property owner. It makes it seem like he has a choice and puts us at his mercy when this is not
case. Again, there is no reason to believe that he won't be cooperative but he does not really have a
choice and I don't want to give him one.
Second, Howard has been informed that the County no longer requires plat note amendments for
plats that do not have plat notes. They changed this policy a few years ago and rightfully so since the
County never had the right to require an amendment to a note that did not exist nor does the land
development code require anyone to place a note on the plat in this circumstance. The County now
just collects the correct impact fees at the time of building permit. I know that an application to amend
the plat has been submitted but it is now no longer needed. Please contact Evy Kalus at the County
if there are any questions on this.
