RESOLUTION NO. R-2013- 5a
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING AN
APPROPRIATION OF $29,875-00 FROM THE STATE LAW
ENFORCEMENT TRUST FUND FOR THE PROVISION OF
FUNDING THE TAMARAC EXPLORER POST
SPECIALIZED TRAINING; AUTHORIZING
DISTRIBUTION OF FUNDS To THE RRn
SHERIFF'S OFFICE;
AND
THE
WARD
PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY, AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac currently contracts for police services with the
Broward Sheriff's Office; and
WHEREAS, the City Commission of the City of Tamarac approved a five (5) year
Agreement with the Broward Sheriff's Office as Resolution R-2010-146, a copy of which
is available in the City Clerk's Office; and
WHEREAS, the Broward Sheriff's Office has requested funding for various
expenses the Tamarac Explorer Post, and Specialized Training for Tamarac District
Deputy Sheriffs as detailed in the funding request attached as Exhibit A; and
WHEREAS, said funds shall be and shall always remain in the ownership of -the
City and may be earmarked for the Tamarac District's use within the confines of the Ci •
WHEREAS, in accordance with the requirements of Section 3.18 of the Broward
Sheriff's Office Policy Manual, the request shown as Exhibit A has been determined to
be in legal compliance and is accompanied by a written certification to that effect as
provided in Exhibit B; and
WHEREAS, the City Manager, the BSO Chief of the Tamarac District, and the
Director of Financial Services recommend the acceptance of the application by BSO to
authorize the use of $29,875.00 provide funding for the Tamarac Explorer Post and
specialized training for the Tamarac District Deputy Sheriff's; and
WHEREAS, the City Commission of the City of Tamarac, pursuant to the BSO
Policy Manual, desires to appropriate an amount not to exceed Twenty Nine Thousand
Eight Hundred and Seventy Five and 00/100 ($29,875.00) Dollars from the State Law
Enforcement Trust Fund;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AS FOLLOWS:

ratified
and
confirmed as
being true
and correct and are hereby made a
specific
part of
this
Resolution upon adoption hereof. All Exhibits referenced in this Resolution are hereby
incorporated herein and made a specific part hereof.

Section 2. The City of Tamarac hereby appropriates Twenty Nine Thousand
Eight Hundred and Seventy Five and 00/100 ($29.875.00) Dollars from the State Law
Enforcement Trust fund for the purpose of providing funding for the Tamarac Explorers
Post and Specialized Training for the Tamarac District Deputy Sheriffs.
Section 3. The City of Tamarac authorizes the distribution of the funds
($29,875) to the Broward Sheriff's Office for Tamarac Explorer Post, and Specialized
Training.
Section 4. All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section 5. If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remain portions or applications of the
Resolution.
Section 6. This Resolution shall become effective immediately
passage and adoption.

Tamarac Deputies. The following is a request for both of these items for approval by BS4
command staff, as well as the Tamarac city attorney to ensure that they meet the statutory
requirements of F SS 932.7055.
FamaraS Ex Iorers Post- 19 874.83.
The Law Enforcement Explorer Program is a career -oriented program that affords our youth
the opportunity to explore a career in law enforcement by working with local law
enforcement agencies. Tamarac District Explorers receive training in accident investigation,
traffic control, crime prevention, crime scene investigation, patrol procedures, firearm safety,
and drill and ceremony.
The structure of the post instills a sense of responsibility, leadership, discipline, and self-
confidence in participating youth members. The primary goal of the explorers program is to -
prepare these youth for a career in law enforcement.
Explorers assist Tamarac District Deputies in a variety of functions. They have been utilized
at a multitude of events such as the July 4th celebration, the Tamarac Turkey Trot, city
concerts, etc.
In late 2009 the Broward Sheriff's Office in partnership with the city of Tamarac established
the Tamarac Explorers Post with an initial $20,000 LETF expenditure which paid for
uniforms, and advisor compensation. Since that time the explorer post has relied upon
donated funds, as well as conducting various fundraising endeavors in order to cover the
costs of their activities.
As the size of the Tamarac Explorers Post has increased in size so have the costs. During
the current fiscal year the explorers are scheduled for several events. The first is a team
building exercise in Tennessee, which will cost approximately $7840.00. This includes a
cost of $225 per explorer for 28 explorers as well as 30 meals, and miscellaneous expenses
such as snacks, ammunition, targets, photos, etc.
The other event is the September delegates conference which will cost a total of $2700.
This includes a fee of $250 per explorer for a total of 6, as well as range fees and
ammunition for 4 explorers at $300 each.

The total LETF expenditure for the Tamarac Explorers will be $19, 874.83

The Florida Department of Law Enforcement (FDLE) mandates that law enforcement
officers receive 40 hours of training every four years to maintain their certification.
The Broward Sheriff's Office goes beyond the state mandate by providing In -Service training
to BSO sworn personnel in three, eight hour blocks of instruction each year. The training
usually covers topics that reinforce officer safety and street survival skills.
In the past BSO has offered specialized training courses through outside vendors and other
agencies whose costs were covered through countywide resources. With the economic
downturn and budget cuts in the last several years, the specialized courses that are offered
to BSO deputies have been drastically reduced.
am requesting to utilize Law Enforcement Trust Fund resources not to exceed $10,000 to
ensure that Tamarac staff has access to specialized training in 2013.
As of February 28, 2013 the account balance in the Tamarac LETF account was $265,
620.57. This is broken down between $47, 685.20 in the Federal Trust Fund and $217,
935.37 in the State LETF.
With command and city attorney approval I will forward this request to the city manager for
him to present same to the Tamarac city commission for their approval.

Please be advised that our office is in receipt of the April 5, 2013, Broward Sheriffs Office
(BSO) allocation request from the City's Law Enforcement Trust Fund for the above -referenced
projects. Amer reviewing the request, we have determined that the Tamarac Explorers Post to
fund the Tamarac Explorers post is legally sufficient and a legally appropriate destination of the
funds; pursuant to Section 932.7055, Florida Statutes.
The request for Specialized Training is also legally sufficient and a legally appropriate manner
by which the City may expend its law enforcement trust fund, pursuant to Section 932.7055,
Florida Statutes, so long as the training develops additional law enforcement expertise beyond
the training normally required for current law enforcement qualifications. We recommend that
the specific training programs to be funded be included in the request for approval by the City
Commission.
It is our understanding that this request will be presented to the City Commission at an upcoming
meeting for the CityCommission's consideration and approval. If you have an questions or
