HomeMy WebLinkAboutCity of Tamarac Resolution R-2013-078Temp Reso # 12376 June 26, 2013 Page 1 of 3 CITY OF TAMARAC, FLORIDA RESOLUTION R2013 - 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE SETTLEMENT IN THE AMOUNT OF $49552.00 TO PARTIALLY RELEASE THE CODE ENFORCEMENT LIENS RECORDED AGAINST SHAKER VILLAGE CONDOMINIUM ASSOCIATION AND FEDERAL NATION. ASSOCIATION ATTACHING PROPERTY LOCATED AT 13 MORTGAGE TO TH E PLEASANT LANE, TAMARAC, FLORIDA; PROVIDING REAL HILL FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Federal National Mortgage Association currently owns the property located at 13 Pleasant Hill Lane, Tamarac, FL (the "Property"); and WHEREAS, the Property is located in Shaker Village Condominium; and WHEREAS, the City has recorded 35 Code Enforcement Liens Village Condominium Association, and 2 Code Enforcement Liens National Mortgage Association, which attach to the Property; and against Shaker against Federal WHEREAS, the Property is currently under contract for sale for $40, 199-00; and WHEREAS, in order to convey clear title to the Property, the property owner must obtain partial releases of lien from the City; and WHEREAS, the City's building fee schedule establishes a partial release fee of $492.00 per release; and WHEREAS, in accordance with the fee schedule, the City's lien settlement letter requires payment in the amount of $18,696.00 to satisfy the City's partial release fees; and Temp Reso # 12376 June 26, 2013 Page 2 of 3 WHEREAS, the buyer has offered to pay the sum of $4,552-00 as settlement in order to obtain the requisite partial releases of lien and obtain clear title to the Property; and WHEREAS, City Staff recommends the City Commission approve the settlement based on the fact that this reduced payoff will cover the City's incurred and administrative costs associated with preparing and recording the requisite partial releases of lien, while facilitating the sale of a vacant bank owned property; and WHEREAS, the City Commission of the City of Tamarac deems it beneficial to approve the reduced payoff for the partial releases of Lien required to convey clear title to the real property located 13 Pleasant Hill Lane. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1. The foregoing "WHEREAS" clause is true and correct and hereby ratified and confirmed by the City Commission. SECTION 2. The City of Tamarac, Florida, hereby approves the settlement in the amount of $4,552.00 to partially release the 37 Code Enforcement Liens recorded against Shaker Village Condominium Association and Federal National Mortgage Association attaching to the real property located at 13 Pleasant Hill Lane, Tamarac, Florida. SECTION 3. All Resolutions or parts of Resolutions in conflict herewith, be and the same are repealed to the extent of such conflict. SECTION 4. If any clause, section or other part of this Resolution shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and in no way effecting the validity of the other provisions of this Resolution.
