RESOLUTION NO. R-2012-Oq
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING
A VACATION OF EASEMENT APPROVAL TO
VACATE TWELVE (12) EASEMENTS TO ALLOW
FOR THE FUTURE DEVELOPMENT OF THE
SUBJECT PROPERTY, FOR THE PROPERTY
LOCATED ON THE SOUTHWEST CORNER OF
HIATUS ROAD AND MCNAB ROAD;(CASE NO.
3-P-10) PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Ronald A. Fritz of Schwebke-Shisken & Associates, Inc., Designated
Agent for the property owner, Advanced Business Associates, LLP has determined that
twelve (12) easements specifically being a part of the "Tee Plat" and the "Ash Plat", (A
replat of a portion of Tract 10 in the Northwest'/4 of Section 7, Township 49 South, Range
41 East, according to the Plat of "Florida Fruit Lands Company's Subdivision No. 2, as
recorded in Plat Book 1, Page 102, of the Public Records of Palm Beach County, Florida;
together with: Parcel "A", a portion of the right-of-way of McNab Road and the 50 foot canal
right-of-way, according to the Plat of "Tee Plat No. 1 ", as recorded in Plat Book 151, Page
32, of the Public Records of Broward County, Florida; also together with Parcel "A", a
portion of the rights -of -way of McNab Road and Hiatus Road, the 50 foot canal right-of-way
and the 100 foot utility, access, maintenance and drainage easement, according to the Plat
of, "Ash Plat No. 1 ", as recorded in Plat Book 166, Page 50, of the Public Records of
Broward County, Florida), for the property located on the southwest corner of Hiatus Road
and McNab Road, are no longer necessary and is requesting approval to vacate the
easements and rights -of -way to allow the future development of this property; and

WHEREAS, the City Engineer and franchised Utility Companies have been
contacted and all have stated no objection to the vacation of the subject easements and
rights -of -way to facilitate any future improvements; and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the Planning Board recommended approval on December 7, 2011; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to grant a Vacation of
Easement of twelve (12) easements specifically being a part of the "Tee Plat" and the "Ash
Plat", for the property located on the southwest corner of Hiatus Road and McNab Road,
specifically (A replat of a portion of Tract 10 in the Northwest % of Section 7, Township 49
South, Range 41 East, according to the Plat of "Florida Fruit Lands Company's Subdivision
No. 2, as recorded in Plat Book 1, Page 102, of the Public Records of Palm Beach County,
Florida; together with: Parcel "A", a portion of the right-of-way of McNab Road and the 50
foot canal right-of-way, according to the Plat of "Tee Plat No. 1 ", as recorded in Plat Book
151, Page 32, of the Public Records of Broward County, Florida; also together with Parcel
"A", a portion of the rights -of -way of McNab Road and Hiatus Road, the 50 foot canal right-
of-way and the 100 foot utility, access, maintenance and drainage easement, according to
the Plat of, "Ash Plat No. 1 ", as recorded in Plat Book 166, Page 50, of the Public Records
of Broward County, Florida).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:

The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
All exhibits attached hereto are incorporated herein and made a specific part of this
resolution.
SECTION 2: That the Vacation of Easement of twelve (12) subject
easements located on the southwest corner of Hiatus Road and McNab Road, specifically:
a. Vacations of Tee Plat Easements
1. 12' utility easement PB 151, PG 32 (2 separate easements)
2. 20' canal maintenance easement PB 151, PG 32
3. 20' Tamarac utilities west exclusive utility easement PB 151, PG 32
4. 50' canal right-of-way PB 151, PG 32
5. Right-of-way along McNab Road (both Ash and Tee Plat)
b. Vacations of Ash Plat Easements
1. 15' utility easement PB 166, PG 5 (2 separate easements)
2. 20' canal maintenance easement PB 166, PG 50
3. 50' canal right-of-way PB 166, PG 50
4. 20' Tamarac utilities west exclusive utility easement PB 166, PG 50
5. 50' x 100' utility access maintenance and drainage easement PB 166, PG 50
6. 50' (shared) ingress/egress easement PB 166, PG 50

SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
