RESOLUTION NO. R-2012-`
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, GRANTING MAJOR REVISED SITE PLAN
APPROVAL WITH CONDITIONS TO ALLOW FOR THE MODIFICATION
OF THE HOME MODELS, ENTRYWAY LANDSCAPING AND
BERMING, FOR THE SABAL PALM NORTH PROPERTY
(SPECIFICALLY LOTS 1 THROUGH 16, BLOCK 1, LOTS 1 THROUGH
5, BLOCK 2, LOTS 1 THROUGH 9, BLOCK 3, LOTS 1 THROUGH 4,
BLOCK 14, TRACTS B-6, B-7, B-8, B-9, B-10, B-13, C, C-3, C-4, D, E, F,
F-1, F-21 F-3, F-4, AND R-4, SABAL PALM BY PRESTIGE, ACCORDING
TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 178, PAGES
71 THROUGH 87 OF THE PUBLIC RECORDS OF BROWARD
COUNTY, FLORIDA); AS WELL AS LANDSCAPE MODIFICATIONS TO
A PORTION OF THE SABAL PALM SOUTH PROPERTY
(SPECIFICALLY LOTS 1 THROUGH 26, BLOCK 4, LOTS 1 THROUGH
6, BLOCK 5, LOTS 1 THROUGH 15, BLOCK 6, LOTS 1 THROUGH 20,
BLOCK 7, LOTS 1 THROUGH 11, BLOCK 8, LOTS 1 THROUGH 31,
BLOCK 9, LOTS 1 THROUGH 14, BLOCK 10, LOTS 1 THROUGH 6,
BLOCK 11, LOTS 1 THROUGH 4, BLOCK 12, LOTS 1 THROUGH 26,
BLOCK 13, LOTS 1 THROUGH 15, BLOCK 15, TRACTS A, B, B-1, B-2,
B-3, B-4, B-5, B-11, B-12, B-14, C-1, C-2, R-1, R-2, AND R-3, SABAL
PALM BY PRESTIGE, ACCORDING TO THE PLAT THEREOF, AS
RECORDED IN PLAT BOOK 178, PAGES 71 THROUGH 87 OF THE
PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA); (CASE NO.
14-SP-12); PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City Commission of the City of
Tamarac, Florida, a public meeting has been advertised in accordance with applicable law
of the date, time and place of the meeting regarding the review of the application for a
Revised Development Order and Major Revised Site Plan for development approval; and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the Planning Board forwarded a favorable recommendation on

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac, Florida to grant
Major Revised Site Plan approval with conditions to allow for the modification of the home
models, entryway landscaping and berming, for the Sabal Palm North property (specifically
Lots 1 through 16, Block 1, Lots 1 through 5, Block 2, Lots 1 through 9, Block 3, Lots 1
through 4, Block 14, Tracts B-6, B-7) B-8, B-9, B-10, Bb-13, C, C-3, C-4, D, E, F, F-1, F-2,
F-3, F-4, and R-4, Sabal Palm by Prestige, according to the Plat thereof, as recorded in
Plat Book 178, pages 71 through 87 of the public records of Broward County, Florida); as
well as landscape modifications to a portion of the Sabal Palm South property (specifically
Lots 1 through 26, Block 4,Lots 1 through 6, Block 5, Lots 1 through 15, Block 6, Lots 1
through 20, Block 7, Lots 1 through 11, Block 8, Lots 1 through 31, Block 9, Lots 1 through
14, Block 10, Lots 1 through 6, Block 11, Lots 1 through 4, Block 12, Lots 1 through 26,
Block 13, Lots 1 through 15, Block 15, Tracts A, B) B-1, B-2, B-3, B-4, B-5, B-11, B-12, B-
14, C-1, C-2, R-1, R-2, and R-3, Sabal Palm by Prestige, according to the Plat thereof, as
recorded in Plat Book 178, Pages 71 through 87 of the public records of Broward County,
Florida);
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution;
all exhibits attached hereto are incorporated herein and made a specific part of this
Resolution.

SECTION 2: That the City Commission of the City of Tamarac, Florida
deems it to be in the best interests of the citizens and residents of the City of Tamarac to

F-1, F-2, F-3, F-4, and R-4, Sabal Palm by Prestige, according to the Plat thereof, as
recorded in Plat Book 178, pages 71 through 87 of the public records of Broward County,
Florida); as well as landscape modifications to a portion of the Sabal Palm South property
(specifically Lots 1 through 26, Block 4,Lots 1 through 6, Block 5, Lots 1 through 15, Block
6, Lots 1 through 20, Block 7, Lots 1 through 11, Block 8, Lots 1 through 31, Block 9, Lots
1 through 14, Block 10, Lots 1 through 6, Block 11, Lots 1 through 4, Block 12, Lots 1
through 26, Block 13, Lots 1 through 15, Block 15, Tracts A, B, B-1, B-2, B-3, B-4, B-5, B-
11, B-129 B-14, C-1, C-2, R-1, R-2, and R-3, Sabal Palm by Prestige, according to the Plat
thereof, as recorded in Plat Book 178, Pages 71 through 87 of the public records of
Broward County, Florida), is hereby granted; subject to the following condition:
1. That the non -lot landscaping be planted within six (6) months of initial development
at the same time to ensure a consistent growth pattern. All trees will be code
minimum with regards to size prior to the issuance of the final certificate of
occupancy within Sabal Palm North.
2. That the five (5) foot reciprocal agreements will be finalized prior to the first
certificate of occupancy within Sabal Palm North.
3. That no identical available model will be constructed next to each other throughout
Sabal Palm North.

4. That the buffer wall along the Florida Turnpike will be completed prior to the
issuance of a building permit of the forty (40) easternmost homes as shown on the
proposed site plan.
5. That the approval of the amendment to the restrictive covenants be finalized
through the City of Tamarac and Broward County prior to the issuance of the first
building permit.
6. That the mitigation agreement with the Broward County School Board be fully
executed prior to the issuance of a building permit.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
adoption.
