RESOLUTION NO. R-2012,/J�
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, APPROVING THE MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF TAMARAC AND
THE BROWARD SHERIFF'S OFFICE FOR THE 2012 EDWARD
BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG);
AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO
EXECUTE THE MEMORANDUM OF UNDERSTANDING;
AUTHORIZING THE BROWARD SHERIFF'S OFFICE TO
CONTINUE TO SERVE AS THE LEAD AGENCY PROVIDING
FOR THE ADMINISTRATION OF THE 2012 EDWARD BYRNE
MEMORIAL JUSTICE ASSISTANCE GRANT (JAG); PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac desires to enhance its crime
prevention and law enforcement programs; and
WHEREAS, the U.S. Department of Justice, Bureau of Justice Assistance provides
grants for projects that will reduce crime and improve public safety: and
WHEREAS, the U.S. Department of Justice requires that one party serve as the lead
agency for cities throughout Broward County for the purposes of filing the application and
administering the grant funds as indicated in the FY2012 Edward Byrne Memorial Justice
Assistance Grant (JAG) Local Solicitation attached hereto as Exhibit A and incorporated
herein by this reference; and
WHEREAS, the City of Tamarac agrees to have the Broward Sheriff's Office serve as
the lead agency to file a joint application on behalf of the City and provide for the
administration of the FY2012 JAG funds; and
WHEREAS, the Broward Sheriff's Office agreed to serve as lead agency and
received notification that the City of Tamarac is eligible to receive $15,288 in JAG funds for

FY2012 as indicated on the FY2012 JAG Funds Allocation list attached hereto as Exhibit B
and incorporated herein by this reference; and
WHEREAS, up to 10% of the award may be used for costs associated with
administering JAG funds and BSO requests 7.23% resulting in a net award of $14,183; and
WHEREAS, the Director of Financial Services and Broward Sheriff's Office Tamarac
District Chief recommend acceptance of the FY2012 JAG award and approval of the
Memorandum of Understanding (MOU) between the Broward Sheriff's Office and the City
of Tamarac attached hereto as Exhibit C and incorporated herein by this reference; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to approve and execute an MOU for the FY2012 JAG program
between the City of Tamarac and the Broward Sheriff's Office effective from the date of full
execution through September 30, 2015 and authorizes the Broward Sheriff's Office to
continue to serve as the lead agency providing for the administration of the FY2012
Edward Byrne Justice Assistance Grant (JAG) funds.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing 'WHEREAS" clauses are HEREBY ratified and
confirmed as being true and correct and are HEREBY made a specific part of this
Resolution. All exhibits attached hereto are incorporated herein and made a specific part of '
this Resolution.

SECTION 2: The City Commission of the City of Tamarac HEREBY approves the
Memorandum of Understanding (MOU) between the City of Tamarac and the Broward
Sheriff's Office for the FY2012 Edward Byrne Memorial Justice Assistance Grant (JAG)
effective from the date of full execution through September 30, 2015. The appropriate
officials are further authorized to execute the MOU and do all things necessary to
effectuate the intent of the agreement.
SECTION 3: The Broward Sheriff's Office is hereby authorized to continue to serve
as the lead agency and provide for the administration of the FY2012 JAG grant.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are HEREBY
repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or application,
it shall not affect the validity of the remaining portions or applications of this Resolution.
SECTION 6: This Resolution shall become effective immediately upon adoption.

PROGRAM ANNOUNCEMENT
FEDERAL FISCAL YEAR 2012
Edward Byrne Memorial Justice Assistance Grant (JAG) Program
Countywide State Solicitation
The State of Florida, Department of Law Enforcement (FDLE), anticipates an award
from the United States Department of Justice (USDOJ) for $7,386,640 in Justice
Assistance Grant (JAG) funds. FDLE will .distribute these funds in accordance with the
JAG Countywide distribution provisions of Chapter 11 D-9, Florida Administrative Code.
This announcement is to notify eligible applicants of program requirements. Please
note this Program Announcement includes information from the USDOJ relating several
areas of national focus and its priorities to help maximize the effectiveness of the
Byrne/JAG funding.
Elloible Applicants
Units of local government are eligible to receive subgrants from FDLE. "Units of local
government' means any city, county, town, township, borough, parish, village, or other
general-purpose political subdivision of a State and includes Native American Tribes
that perform law enforcement functions as determined by the Secretary of the Interior.
Program Strateny and Purposes
JAG blends the previous Byrne Formula and Local Law Enforcement Block Grant
(LLEBG) Programs to provide agencies with the flexibility to prioritize and to support a
broad range of activities to prevent and control crime based on their own local needs
and conditions. JAG funds can be used for state and local initiatives, technical
assistance, training, personnel, equipment, supplies, contractual support, and
information systems for criminal justice. Local units of government receiving JAG
funding have the flexibility to implement projects in any of the seven federally approved
purpose areas, listed below.
1) Law enforcement programs
2) Prosecution and court programs
3) Prevention and education programs
4) Corrections and community corrections programs
5) Drug treatment and enforcement programs
6) Planning, evaluation, and technology improvement programs
7) Crime victim and witness programs
Any law enforcement or justice initiative previously eligible for funding under Byrne or
LLEBG is eligible for JAG funding.
Coordination Efforts
Each county is allocated a sum of money for use by all local governments within the
county. This amount is determined through a funding algorithm established in the
administrative rule.

Chapter 11 D-9.005, Florida Administrative Code, requires that units of government in
each county reach consensus concerning the expenditure of these funds, including the
projects to be implemented and the agency responsible for such implementation.
Maximum coordination is required to meet this program requirement, and the
Department requests the county board of commissioners to serve as the coordinating
unit for all local governments within the county. The Chairman, Board of County
Commissioners, in each county so notified is requested to return to the Department a
statement of certification indicating the county's willingness to serve. This certification
must be returned within 30 days from the date of receipt of notification. In the event the
county declines to serve in this capacity, the Department will request the governing
body of each municipality in the county, in descending order of population, to serve as
the coordinating unit of government.
Each county or coordinating unit of government is encouraged to form a criminal justice
coordinating/planning group to identify and implement criminal justice priorities for the
county, to plan strategies to address those priorities, to identify areas of greatest need,
and to review all possible sources of revenue to make sure that funds go to the
programs or issues that need them most.
Furthermore, FDLE requires that units of government in each county reach consensus
concerning the expenditure of the JAG funds, including the projects to be implemented
and the agency responsible for such implementation. Each county must document this
consensus by submitting letters from at least 51 percent of the units of government
which also represent at least 51 percent of the population located in said county.
Match Requirements
There is no match requirement under the guidelines of the JAG program.
DOJ/Bureau of Justice Assistance (BJA) Priorities
BJA wishes to ensure that recipients are aware of several areas of national focus and
priority and to encourage recipients to maximize the effective use of JAG funds. The
following is a brief list of key priorities:
1) Funding Evidence -Based Programs
2) Statewide Criminal Justice Planning
3) Recidivism Reduction and Community Corrections
4) Indigent Defense
5) Evidence -Based "Smart Policing" Programs
6) Officer Safety and Wellness

Application Requirements and Deadlines
Once the Certificate of Participation form designating the coordinator for your county is
received, the Office of Criminal Justice Grants will send this individual further
information regarding the application process.
Applicants must apply on-line using FDLE's grant management system. The deadline
for the on-line submission is 5:00 P.M., Friday, July 13, 2012. In addition, applicants
must print out the completed application and submit two (2) hard copies (both with
original signatures) no later than 6:00 P.M., Friday, July 20, 2012. A separate
application must be submitted for each proposed project. Applications should be
mailed or hand delivered to the Florida Department of Law Enforcement, Office of
Criminal Justice Grants, 2331 Phillips Road, Tallahassee, Florida 32308, Attention:
Clayton H. Wilder, Administrator.
Applications must be accompanied by letters of approval representing agreement
among at least 51 percent of all units of local government representing at least 51
percent of the county population as to the allocation of dollars to each project in the
county.

2012 FLORIDA JAG ALLOCATIONS
Listed below are all jurisdictions in the state that are eligible for FY 2012 JAG funding, as determined
by the JAG formula. If your jurisdiction is listed with another city or county government in a shaded
area, you are in a funding disparity. In this case, the units of local government must develop a
Memorandum of Understanding (MOU) and apply for an award with a single, joint application.
Finding your jurisdiction:(1) Disparate jurisdictions are listed In shaded groups below, In alphabetic
order by county.(2) Eligible individual allocations are listed alphabetically below the shaded,
disparate groupings.
Counties that have an asterisk (*) under the "Eligible Individual Allocation" column did not submit
the level of violent crime data to qualify for a direct award from BJA, but are in the disparate grouping
Indicated by the shaded area. The JAG legislation requires these counties to remain a partner with
the local jurisdictions receiving funds and must be a signatory on the required Memorandum of

Enclosed please find a corrected copy of the Edward Byrne Justice Assistance
Local Solicitation Grant Memorandum of Understanding for Fiscal Year 2012.
A correction was made to the Grant amounts quoted for the Cities of Coral
Springs, Pompano Beach and Plantation. Additionally, the language in the Term
and Termination Section of the MOU was revised to remove ambiguity regarding
the terms of the project.

ASSISTANCE LOCAL SOLICITATION GRANT
MEMORANDUM OF UNDERSTANDING (MOU)
This Memorandum of Understanding (MOU) is being executed by the following
listed participating agencies (hereinafter "participating agencies")":

Nothing in this MOU should be construed as limiting or impeding the basic spirit of
cooperation which exists between the participating agencies, listed above.
WHEREAS, Broward County has been identified as a `disparate" County; and
WHEREAS, the participating agencies have been identified as eligible jurisdictions
able to collectively implement the objectives and goals of the Edward Byrne Justice
Assistance Grant (hereinafter "JAG"); and
WHEREAS, the participating agencies have formed a working committee and
developed a course of action to achieve the goals and objectives of the JAG Program;
and
WHEREAS, the BSO has been selected as through this MOU, to administer the
program and serve as the fiscal agent for the disbursement of all funds received for
the JAG Program.
THEREFORE, in consideration of the mutual terms, conditions, promises, and
covenants hereinafter set forth, the participating agencies agree as follows:
Purpose
This MOU establishes the relationship between the parties for participation in the FY
2012 Edward Byrne Justice Assistance Grant (JAG) Local Solicitation Grant Program
(Award Number 2012-DJ-BX-0035).
Procedures
1. The Broward Sheriffs Office (BSO) will serve as the lead agency and grant
administrator for the agencies in Broward County, Florida participating in the
JAG Program. Pursuant to the JAG Program guidelines, funding for the JAG
Program will be provided to BSO.

2. The BSO shall then disperse the funds to the parties in the amounts
determined by the JAG Program. For municipalities that currently contract
with BSO for law enforcement services, the BSO shall retain the funds for use
in the appropriate BSO Districts pursuant to the contracts for law enforcement
services.
3. Each party shall be responsible for submitting its own application for their

Term and Termination
1. This MOU shall remain in effect from the date of execution through September
30, 2015 and its continuation shall be subject to the availability of necessary
funding from the JAG Program.
2. A participating agency may withdraw from this agreement at any time by
providing thirty (30) days written notice of its intent to withdraw to all other
participating agencies.
3. This MOU may be terminated upon the written consent of all parties to this
MOU.
Amendments
This MOU may be modified at any time upon the written agreement of all of
the participating agencies.
Insurance and indemnification
1. Each party agrees to maintain its own comprehensive general liability
insurance, professional liability insurance, automobile liability insurance and
workers compensation insurance policy or maintain aself-insuring fund for
the term of the Agreement in the amounts determined by each party to
adequately insure said parry's liability assumed herein, but in no event shall
such coverage be less than the amount of statutory waiver of sovereign
immunity. The participating agencies agree to provide BSO within thirty (30)
days of entering this Agreement with proof of insurance if requested.
2. Each party shall be responsible for the negligent act or omissions of their
respective employees in accordance with Ch. 768.28, Fla. Stat. and nothing
herein shall be deemed a waiver of those protections.
Guidelines
In performing its duties, responsibilities and obligations pursuant to this
Agreement, each party agrees to adhere to the requirement standards set forth
in the Office of Justice Programs' Financial Guide, as amended and Federal
OMB Circular A-133, as applicable.
Records
a. Each party understands that any and all records created as a result of
participating in this Program may be subject to public disclosure pursuant to
the Public Records Statute, Fla. Stat. Section 119.07 and shall be responsible
for compliance with any public records request served upon it and any
resultant award of attorneys fees for noncompliance.
b. Each party shall maintain its own respective records and documents
associated with MOU sufficient to demonstrate compliance with the terms of
this Agreement for a period of five (5) years from the date of execution of the
MOU and shall allow BSO access to such records upon request.

c. Each party, its employees or agents, shall allow access to its records
concerning this MOU at reasonable times to BSO, its employees, and agents.
The term "agents" shall include, but is not limited to, auditors retained or
employed by BSO. The term "reasonable" shall be construed according to the
individual party circumstances but ordinarily shall mean during normal
business hours of 8:00 am to 5:00 pm, local time, Monday through Friday.
d. Upon reasonable notice, the participating agency shall provide BSO with any
additional documentation, information, or reports as may be required by BSO.
Execution
This agreement may be executed in counterparts each of which shall be
deemed an original and all of which together shall be considered one and the
same agreement.

DISPARATE JURISDICTIQN APPLICATION
Broward County and eighteen jurisdictions within the county's boarders are eligible to
apply for $605,089.00 from the U. S. Department of Justice, Bureau of Justice Assistance
(BJA) "Edward Byrne Memorial Justice Assistance Local Solicitation Program funding
for 2012. Broward County has been identified as a "disparate" county; therefore a
working committee of all the eligible jurisdictions discussed the JAG requirements and
decided upon a mutual course of action. It was agreed the Broward Sheriff s Office
(BSO) would serve as the lead applicant and fiscal agent for the 2012 JAG Local
Solicitation program. The Broward Sheriff's Office has decided with the support of the
majority of disparate jurisdictions to exercise the administration fimds option and will use
its DOJ-approved indirect cost allocation of 7.23 percent of the award for costs incurred
in the administration of the 2012 JAG Local Solicitation grant program.
The Broward Sheriff s Office, through MOU, will administer the programs and funds as
the lead administrative and fiscal agent for the following jurisdictions. The MOU with
the disparate jurisdictions will be executed upon official notification from the Bureau of
Justice Assistance of the 2012 JAG Local Solicitation award.
