Reso. # 12255 October 9, 2012 Page 1 of 3 CITY OF TAMARAC, FLORID RESOLUTION NO.2012- // 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE CITY COMMISSION TO WAIVE A PORTION OF THE APPOINTMENT PROCESS SPECIFIED IN CHAPTER II, ARTICLE III (SECTION 2-58) OF THE CITY OF TAMARAC CODE OF ORDINANCES AS IT PERTAINS TO APPOINTMENTS TO THE AFFORDABLE HOUSING ADVISORY COMMITTEE ("AHAC") AS PROVIDED IN SECTION 9-134, OF THE CITY OF TAMARAC CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac ("City") has established a local housing assistance program in order to provide affordable housing pursuant to authorized federal and state programs; and WHEREAS, the City Commission, pursuant to Section 9-134 of the City's Code of Ordinances, established an Affordable Housing Advisory Committee ("AHAC") to review the local housing assistance program and make recommendations to the City Commission; and WHEREAS, in order -to ensure that appointments to the AHAC can occur on a timely basis, and to ensure that the AHAC is comprised of individuals who meet the AHAC membership requirements, City staff is recommending that the City Commission waive a portion of the provisions contained in Chapter II, Article III of the City's Code of Ordinances regarding the appointment of individuals to City Committees; and Temp. Reso. # 12255 October 9, 2012 Page 2 of 3 WHEREAS, the City Commission finds that the waiver of the appointment process will permit the City to comply with the local housing assistance program, and is in the best interest of the residents and citizens of the City of Tamarac. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct, and are hereby incorporated herein and made a part hereof. Section 2. The City Commission finds that in order to comply with the State Housing Initiative Partnership Program requirements, the provisions of Chapter ll, Article III of the City's Code of Ordinances shall be waived with respect to the process for identifying individuals, with the necessary qualifications, -who are interested and able to serve on the City's Affordable Housing Advisory Committee ("AHAC"). Section 3. The City Commission hereby authorizes and directs the appropriate City Officials to do all things necessary and expedient to effectuate the intent of this Resolution. Section 4. All resolutions inconsistent or in conflict herewith shall be and are hereby repealed insofar as there is conflict or inconsistency. Section 5. If any section, sentence, clause, or phrase of this resolution is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this resolution.
