R-2012 / ;� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO APPROVE AMENDMENT NUMBER 1 TO THE AGREEMENT WITH PRESTIGE PROPERTY MANAGEMENT AND MAINTENANCE, INC. FOR LANDSCAPE MAINTENANCE SERVICES OF CERTAIN PUBLIC RIGHTS -OF -WAY AND CITY PARKS; AUTHORIZING A TWO-YEAR RENEWAL TO THE AGREEMENT; AND AUTHORIZING AN ANNUAL CONTRACT AMOUNT OF $976,504.75 FOR FIXED -COST SERVICES; AUTHORIZING AN AMOUNT NOT TO EXCEED $25,195.25 TO BE ADDED TO THE CONTRACT FOR VARIABLE COST SERVICES FOR A TOTAL ANNUAL COST OF $1,001,700; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Mayor and City Commission deem it to be in the best interest of the citizens, residents, and businesses of the City of Tamarac to maintain City Rights -of -Way, Public Parks, and other green spaces around City Facilities through proper landscape maintenance services provided in a cost-effective and efficient manner; and WHEREAS, via Resolution R-2010-154, dated December 8, 2010, the City Commission of the City of Tamarac authorized an Agreement with Prestige Property Management and Maintenance, Inc. for the provision of grounds maintenance and irrigation repair services for City -owned property, a copy of the Agreement is hereto attached as Exhibit 1; and Temp. Reso. # 12265 November 28, 2012 Page 2 WHEREAS, the Agreement with Prestige Property Management and Maintenance, Inc. is eligible for one two (2) year renewal; and WHEREAS, Public Services staff has determined the performance by Prestige Property Management and Maintenance, Inc. to be satisfactory and in compliance with the Agreement; and WHEREAS, the City has identified additional City -owned property which would be cost-effective to be maintained by Property Management and Maintenance, Inc.; and WHEREAS, it is the recommendation of the Public Services Director and the Purchasing and Contracts Manager that the appropriate City Officials execute the Amendment Number 1 to the Agreement with Prestige Property Management and Maintenance, Inc., for the landscape maintenance services, a copy of said Amendment to the Agreement is hereto attached as "Exhibit 2"; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interest of the citizens and residents of the City of Tamarac to execute the Amendment to the Agreement for landscape services with Prestige Property Management and Maintenance, Inc., at a annual cost not to exceed $976,504-75 for fixed cost services plus Temp. Reso. # 12265 November 28, 2012 Page 3 $25,195.25 for variable cost services for an annual cost not to exceed $1,001,700. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are hereby incorporated herein and made a specific part of this resolution. SECTION 2: The City Commission hereby approves Amendment Number 1 to the Agreement with Prestige Property Management and Maintenance, Inc., ("the Agreement") and the appropriate City Officials are hereby authorized to execute the Agreement hereto attached as "Exhibit 2", to provide landscape maintenance services. SECTION 3: 0 An annual expenditure in an amount of $976,504.75 for fixed - cost services and an amount of $25,195-25 for variable -cost services for an annual cost not to exceed $1,001,700 is hereby approved for the term of the Agreement. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Those observations will be reported in summary fashion on this form and submitted monthly to the Project Manager or designee. Critical issues requiring immediate attention will be reported to the Project Manager or designee upon discovery. Performance ratings are intended to assess the contractor's conformance to contract requirements, specifications, and standards of good workmanship.
