R-2012- /6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ISSUING REVISED DEVELOPMENT ORDER NO. 337.2 AND GRANTING MAJOR REVISED SITE PLAN APPROVAL WITH CONDITIONS TO ALLOW FOR THE DEVELOPMENT OF THE SABAL PALM NORTH PROPERTY THROUGH STRUCTURAL AND ARCHITECTURAL MODIFICATIONS AND LANDSCAPING IMPROVEMENTS FOR THE PROPOSED USE OF TWO HUNDRED AND FIFTY-FIVE (255) COACH HOMES, REPLACING THE PREVIOUSLY APPROVED TWO HUNDRED AND EIGHTY-EIGHT (288) TOWNHOMES AND THIRTY-FOUR (34) SINGLE FAMILY HOMES, FOR THE PROPERTY LOCATED NORTH OF COMMERCIAL BOULEVARD, JUST WEST OF THE FLORIDA TURNPIKE, (PARCEL A: A PORTION OF TRACTS 4 AND 5 OF THE "FORT LAUDERDALE TRUCK FARMS SUBDIVISION" OF SECTION 13, TOWNSHIP 49 SOUTH, RANGE 41 EAST, BROWARD COUNTY, FLORIDA, AS RECORDED IN PLAT BOOK 4, PAGE 31, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA- PARCEL B: A PORTION OF TRACTS 2, 3, 4, 5, 6, AND 12 OF THE "FORT LAUDERDALE TRUCK FARMS SUBDIVISION" OF SECTION 13, TOWNSHIP 49 SOUTH, RANGE 41 EAST, BROWARD COUNTY, FLORIDA, AS RECORDED IN PLAT BOOK 4, PAGE 31, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; PARCEL C: A PORTION OF TRACTS 13, 14, AND 15 OF SECTION 12, TOWNSHIP 49 SOUTH, RANGE 41 EAST, AND A PORTION OF TRACTS 2 AND 3 OF SECTION 13, TOWNSHIP 49 SOUTH, RANGE 41 EAST, ACCORDING TO THE PLAT THEREOF OF THE "FORT LAUDERDALE TRUCK FARMS SUBDIVISION' , AS RECORDED IN PLAT BOOK 4, PAGE 31, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA) (CASE NO. 21-SP-11); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Commission of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a Revised Development Order and Major Revised Site Plan for development approval, and WHEREAS, the Director of Community Development recommends approval; and Temp Reso. No. 12148 January 11, 2012 Page 2 WHEREAS, the Planning Board recommended approval on January 4, 2012, and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to issue Revised Development Order No. 337.2 (hereto attached as Exhibit 111 ", incorporated herein and made a specific part thereof) and grant Major Revised Site Plan approval with conditions to allow for the development of the Sabal Palm North property through structural and architectural modifications and landscaping improvements for the proposed use of two hundred and fifty-five (255) coach homes, replacing the previously approved two hundred and eighty-eight (288) townhomes and thirty-four (34) single family homes, for the property located north of Commercial Boulevard, just west of the Florida Turnpike, (Parcel A: A portion of Tracts 4 and 5 of the "Fort Lauderdale Truck Farms Subdivision" of Section 13, Township 49 South, Range 41 East, Broward County, Florida, as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida; Parcel B: A portion of Tracts 2, 3, 4, 5, 6, and 12 of the "Fort Lauderdale Truck Farms Subdivision" of Section 13, Township 49 South, Range 41 East, Broward County, Florida, as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida; Parcel C: A portion of Tracts 13, 14, and 15 of Section 12, Township 49 South, Range 41 East, and a portion of Tracts 2 and 3 of Section 13, Township 49 South, Range 41 East, according to the plat thereof of the "Fort Lauderdale Truck Farms Subdivision", as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida) NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Temp Reso. No. 12148 January 11, 2012 Page 3 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: That the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to issue Revised Development Order No. 337.2 and grant Major Revised Site Plan approval with conditions to allow for the development of the Sabal Palm North property through structural and architectural modifications and landscaping improvements for the proposed use of two hundred and fifty-five (255) coach homes, replacing the previously approved two hundred and eighty-eight (288) townhomes and thirty-four (34) single family homes, for the property located north of Commercial Boulevard, just west of the Florida Turnpike, (Parcel A: A portion of Tracts 4 and 5 of the "Fort Lauderdale Truck Farms Subdivision" of Section 13, Township 49 South, Range 41 East, Broward County, Florida, as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida; Parcel B: A portion of Tracts 2, 3, 4, 5, 6, and 12 of the "Fort Lauderdale Truck Farms Subdivision" of Section 13, Township 49 South, Range 41 East, Broward County, Florida, as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida; Parcel C: A portion of Tracts 13, 14, and 15 of Section 12, Township 49 South, Range 41 East, and a portion of Tracts 2 and 3 of Section 13, Township 49 South, Range 41 East, according to the plat thereof of the "Fort Lauderdale Truck Farms Subdivision", as recorded in Plat Book 4, Page 31, of the public records of Broward County, Florida), is hereby granted; subject to the following condition: Temp Reso. No. 12148 January 11, 2012 Page 4 1. That the non -lot landscaping, excluding the street trees, be planted within six (6) months of initial development at the same time to ensure a consistent growth pattern. All trees will be code minimum with regards to size prior to the issuance of the final Certificate of Occupancy within Sabal Palm North. The proposed street trees shall be installed at code minimum size after the second lift of asphalt is installed and approved. 2. That the northern area buffer be adjusted by using proposed common area trees to fill in existing gaps to provide for a consistent tree line within this area. This will be evaluated on a lot by lot basis and must be addressed prior to the issuance of a Certificate of Occupancy for each lot. 3. That the five (5) foot reciprocal agreements will be finalized prior to the first Certificate of Occupancy within Sabal Palm North. 4. That identical elevations and elevation colors may not be constructed on adjacent lots. 5. That the ten (10) foot buffer wall along the Florida Turnpike will be completed prior to the issuance of a building permit of the forty (40) easternmost homes as shown on the proposed site plan. 6. That all required traffic improvements will be completed and improved prior to the issuance of the first Certificate of Occupancy. 7. That the approval of the Plat note amendment and amendment to the Restrictive Covenants be finalized through the City of Tamarac and Broward County prior to the issuance of the first building permit. 8. That the amended mitigation agreement between the Broward County School Board and the owners be fully executed prior to the issuance of a building permit. Temp Reso. That a cross access agreement granting public access to Tract G, Sabal Palm by Prestige Plat (P.B. 178, Page 79 B.C.R.) be executed and recorded prior to the issuance of the first building permit. 10. That a draft Homeowner Association document be submitted to the City for review to ensure that homeowners will utilize their garages for vehicular parking. 11. That a draft Homeowner Association document be submitted to the City for review to ensure that the rental of coach homes will not be permitted within the first year of occupancy and that the rental period be a minimum of six (6) months after the initial year. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: adoption. This Resolution shall become effective immediately upon its PASSED, ADOPTED AND APPROVED this ATTEST: CITY CLERK.
