RESOLUTION NO. R-2012--Q20
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, AUTHORIZING THE PURCHASE AND
INSTALLATION OF GUARDRAILS AT VARIOUS LOCATIONS
THROUGHOUT THE CITY UTILIZING THE SOUTHEAST FLORIDA
GOVERNMENTAL PURCHASING COOPERATIVE CONTRACT 08-
09-001; AUTHORIZING PURCHASE AND INSTALLATION OF
GUARDRAILS IN THE QUANTITIES NEEDED PER CONTRACT 08-
09-001 NOT TO EXCEED $50,000; AUTHORIZING AN
EXPENDITURE FROM THE APPROPRIATE ACCOUNTS;
AUTHORIZING BUDGET AMENDMENTS FOR PROPER
ACCOUNTING PURPOSES; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, City Code Section 10-189(a) requires the installation of guardrail where
pavement lies within twenty-five (25) feet of a canal, lake, or ditch for the protection of the
public; and
WHEREAS, sufficient funding exists for the purchase and installation of guardrail
in the amount not to exceed $50,000.00 and
WHEREAS, the City of Miami Gardens, acting as lead agency for the Southeast
Florida Governmental Cooperative ("CO-OP") awarded Contract 08-09-001 to lowest
responsive bidder, Southeast Attenuators, Inc., and was subsequently renewed through
October 31, 2011, copies of the original Contract and extension are incorporated herein by
reference and on file in the office of the City Clerk; and;
WHEREAS, the City Commission of the City of Tamarac approved the use of said
Agreement via Resolution R-2011-02, dated January 12, 2011, a copy of said Resolution is
incorporated herein by reference and on file in the office of the City Clerk; and

WHEREAS, CO-OP Agreement 08-09-001 was extended with the original terms,
conditions, and pricing through October 30, 2012, copy of said extension is hereto attached
as Exhibit 1; and
WHEREAS, City Code Section 6-155 allows the Purchasing/Contracts Manager the
authority to procure supplies, material and equipment, which are the subject of contracts
with other governmental agencies; and
WHEREAS, it is the recommendation of the Director of Public Works and
Purchasing and Contracts Manager to approve the purchase and installation of guardrail
from Southeast Attenuators, Inc., at a cost not to exceed $50,000.00, utilizing the CO-OP
Agreement 08-09-001 for guardrail replacement and installation; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to approve said
purchase and installation of guardrail utilizing CO-OP Agreement 08-09-001 for guardrail
replacement and installation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and
confirmed as being true and correct and are HEREBY made a specific part of this
Resolution upon adoption hereof. All exhibits attached hereto are incorporated herein and
made a specific part of this resolution.
SECTION 2: The purchase and installation of guardrails in quantities needed

based on the Southeast Florida Governmental Purchasing Cooperative Contract 08-09-001
is hereby authorized.
SECTION 3: Funding for the guardrail replacement and installation, in an
amount not to exceed $50,000.00, is available in the Public Works — General Fund FY
2012 Budget.
SECTION 4: The appropriate City Officials are hereby authorized to expend
an amount not to exceed $50,000.00 for said purpose.
SECTION 5: All budget amendments for proper accounting purposes are
hereby authorized.
SECTION 6: The appropriate City Officials are hereby authorized to accept
and execute future renewals provided for in Southeast Governmental Purchasing
Cooperative Contract 08-09-001 assuming all terms, conditions, and pricing of the
Agreement remain equal, and to take all steps necessary to effectuate the intent of this
resolution.
SECTION 7: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 8: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 9: This Resolution shall become effective immediately upon its
passage and adoption.
