R- 2012 30 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO SELECT, APPROVE AND AWARD THE PURCHASE OF NEW AND REPLACEMENT VEHICLES TO CONTRACTORS UTILIZING CURRENT AGREEMENTS AT THE TIME OF PURCHASE AWARDED BY THE STATE OF FLORIDA DEPARTMENT OF MANAGEMENT SERVICES, THE FLORIDA SHERIFF'S ASSOCIATION, AND BROWARD COUNTY IN THE BEST INTEREST OF THE CITY; DECLARING CERTAIN EQUIPMENT AS SURPLUS AND DIRECTING THAT EQUIPMENT BE DISPOSED VIA TRADE-IN WITH THE VENDOR OR VIA SALE THROUGH ESTABLISHED INTERNET MARKETS TO BE SELECTED; PLACING ALL PROCEEDS INTO THE APPROPRIATE FUNDS FROM WHICH THE ASSETS WERE ORIGINALLY PURCHASED; AUTHORIZING AN EXPENDITURE IN AN AMOUNT NOT TO EXCEED $992,800; APPROVING FUNDING FROM THE APPROPRIATE ACCOUNT; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, funds were appropriated in the Adopted Fiscal Year 2012 Budget for replacement of vehicles and heavy equipment; and WHEREAS, the timely replacement of City vehicles and equipment is necessary in order to ensure the effective and efficient delivery of services by City departments; and WHEREAS, funds were appropriated in the Adopted Fiscal Year 2012 Budget for purchase of a new Code Enforcement Officer Vehicle; and Temp. Reso. # 12150 February 22, 2012 Page 2 of 7 WHEREAS, funds were appropriated in the Adopted Fiscal Year 2012 Budget for purchase of a new Battalion Chief Response Vehicle; and WHEREAS, City of Tamarac Code, §6-155 allows the Purchasing Officer the authority to waive purchasing procedures and purchase equipment which is the subject of contracts with other governmental agencies; and WHEREAS, the State of Florida Department of Management Services, the Florida Sheriff's Association, and Broward County issue and award formal competitive bids for vehicles, heavy equipment, and buses; and WHEREAS, it has been proven in the marketplace that these bids provide the lowest prices as well as the most efficient method for purchasing vehicles and heavy equipment; and WHEREAS, the Director of Public Services, Director of Financial Services, and Purchasing and Contracts Manager have determined that it is in the City's economic interests to purchase new and replacement vehicles and equipment as identified in Exhibit 1", attached hereto, utilizing a current State of Florida Agreement, a Florida Sheriff's Association Agreement, or a Broward County Agreement, whichever is in the best interest of the City; and WHEREAS, it is in the best interest of the City to authorize the appropriate City officials to select, approve and award the most cost effective utilizing the current Temp. Reso. # 12150 February 22, 2012 Page 3 of 7 agreements at the time of purchase awarded by the State of Florida Department of Management Services, the Florida Sheriff's Association, or Broward County whichever is in the best interest of City; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac that the appropriate City Officials be authorized to select, approve and award the cost effective choice for new and replacement vehicles and equipment as identified in Exhibit I" be purchased utilizing a current State of Florida Agreement, a Florida Sheriff's Association Agreement, or a Broward County Agreement; and WHEREAS, pursuant to §6-155 of the Code of Ordinances, the City Commission may by Resolution direct the City Manager to dispose of surplus property by the method or methods deemed to be most advantageous, convenient, and economical to the City; and WHEREAS, the City Manager may dispose of surplus stock by utilizing competitive sealed bids, public auction, established markets, sales at posted price, donation, or trade- in as may be prescribed for the individual situation; and WHEREAS, the City Manager has delegated the responsibility for Property Disposal to the Purchasing and Contracts Manager, through the Director of Financial Services; and WHEREAS, the Director of Financial Services and Purchasing and Contracts Manager recommend that disposal of surplus and obsolete property be accommodated via Temp. Reso. # 12150 February 22, 2012 Page 4 of 7 an electronic established market available to all buyers via an Internet auction service to be selected; and WHEREAS, pursuant to §6-153, the asset available for disposal, upon receipt and deployment of replacement equipment, is identified in "Exhibit 2", hereto attached; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve and authorize appropriate City officials to dispose of said surplus vehicles and equipment per the Code of Ordinances. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof and all exhibits referenced and attached hereto are incorporated herein and made a specific part of this resolution. SECTION 2: The appropriate City Officials are authorized to select, approve and award the purchase of replacement vehicles and equipment utilizing a current agreement at the time of purchase awarded by the State of Florida, Florida Sheriff's Association, or Broward County which is in the best interest of the City. Reso. # 12150 February 22, 2012 Page 5 of 6 SECTION 3: Funds totaling $992,800 were appropriated in the Adopted Fiscal Year 2012 Budget for the purchase of new and replacement vehicles and equipment as identified in "Exhibit 1", of which, $657,800 was provided for in the Capital Equipment Fund — General Government, $40,000 in the Capital Equipment Fund — Public Safety, $36,000 in the Stormwater Fund, and $259,000 in the Utilities Fund for a total appropriation of $992,800 for new and replacement. SECTION 4: An expenditure in the amount of $992,800 for said purpose is hereby authorized. SECTION 5: The City Commission hereby declares as surplus existing property in Exhibit "2", upon replacement, and direct that property be disposed via trade-in or via established internet markets. SECTION 6: In the event that the sale through established Internet markets is not successful, the City Manager is authorized to dispose of such surplus property in the means deemed most practicable as authorized pursuant to §6-153 of the City Code. SECTION 7: All proceeds from the auction or disposal shall be placed in the appropriate fund from which the assets were originally purchased to be used for public purposes. SECTION 8: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp. Reso. # 12150 February 22, 2012 Page 6 of 6 SECTION 9: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are declared to be severable.
