R-2012- - l 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THAT THE CITY COMMISSION APPROVES TASK AUTHORIZATION NO. 12-03E AND AUTHORIZES THE APPROPRIATE CITY OFFICIALS TO EXECUTE TASK AUTHORIZATION NO. 12-03E WITH ECKLER ENGINEERING, INC., TO PROVIDE PROFESSIONAL SERVICES TO PREPARE A SFWMD WATER USE PERMIT MODIFICATION IN ACCORDANCE WITH THE CITY'S CONSULTING ENGINEERING AGREEMENT AS AUTHORIZED BY RESOLUTION NO. R-2011-87, FOR AN AMOUNT NOT TO EXCEED $147,000.00; APPROVING FUNDING FROM THE APPROPRIATE ADOPTED UTILITIES CONTINGENCY BUDGET; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ADMINISTER THE CONTRACT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac owns, operates and maintains a Water Treatment Plant with a 20-year Water Use Permit (WUP) issued by the South Florida Water Management District (SFWMD) on February 12, 2004; and WHEREAS, this WUP permitted the Water Treatment Plant to withdraw 7.55 MGD for a 5-year period from February 12, 2004 until February 12, 2009 and 7.19 MGD from February 12, 2009 until February 12, 2024; and WHEREAS, the SFWMD adopted a Regional Water Availability Rule in 2007 which limits cities in SE Florida to water withdrawals from the Biscayne Aquifer to the highest 12- month consecutive average for a 5-year period ending in April 2006; and WHEREAS, the Regional Water Availability Rule will limit Tamarac to 6.90 MGD withdrawal from the Biscayne Aquifer on February 12, 2024 which is insufficient to meet 20-year water usage projections; and Temp. Reso. #12180 February 29, 2012 Page 2 of 4 WHEREAS, the Reverse Osmosis Alternative Water Supply Project as listed in the Tamarac Capital Improvement Plan (CIP) and included in the 2012 Lower East Coast Water Supply Plan for completion in 2024 is presently required to meet 20-year water demands and is projected to cost $19,000,000; and WHEREAS, the City requires the service of a consulting firm knowledgeable in this area and capable of providing professional services to prepare a SFWMD Water Use Permit Modification for the City of Tamarac; and WHEREAS, Eckler Engineering, Inc., prepared the Water Use Permit Application to the SFWMD that was granted on February 12, 2004 and prepared the 10-Year Water Supply Facilities Work Plan for the City in May 2008; and WHEREAS, Eckler Engineering, Inc., possesses the required knowledge and experience to provide professional services needed to prepare a SFWMD Water Use Permit Modification for the City of Tamarac that will provide population and water usage projections through 2032 along with the development of complex analytical and numerical geologic modeling of the Biscayne Aquifer; and WHEREAS, the SFWMD Water Use Permit Modification, if granted by the SFWMD will result in a new Water Use Permit issued for 20 years with the City Water Treatment Plant permitted to withdraw up to 7.55 MGD from the Biscayne Aquifer; and WHEREAS, Eckler Engineering, Inc., has been pre -qualified as an approved consultant for engineering services by the City of Tamarac as authorized by Resolution No. R-2011-87; and WHEREAS, it is the recommendation of the Director of Public Services and Assistant Director of Utilities that Task Authorization No. 12-03E from Eckler Engineering, Inc., be approved, executed and funded; and Temp. Reso. #12180 February 29, 2012 Page 3 of 4 WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept and execute Task Authorization No. 12-03E (a copy of which is attached hereto as "Exhibit A") with Eckler Engineering, Inc., to provide professional services to prepare a SFWMD Water Use Permit Modification for the City of Tamarac for an amount not to exceed $147,000.00 and to provide funding from the appropriate adopted Utilities Contingency budget. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. The exhibit attached hereto is incorporated herein and made a specific part of this resolution. SECTION 2: The City Commission approves Task Authorization No. 12-03E and authorizes the appropriate City Officials to execute Task Authorization No. 12-03E with Eckler Engineering Inc., to provide engineering services to prepare a SFWMD Water Use Permit Modification for the City of Tamarac, in accordance with the City's Consulting Engineering Agreement as authorized by Resolution No. R-2011-87, for an amount not to exceed $147,000.00. SECTION 3: Funds are available in the adopted FY 2012 Utilities Contingency budget. SECTION 4: The City Manager, or his designee, are hereby authorized to make changes, issue change orders not to exceed $30, 000.00 per Section 6-156 (b) of the City Code, and close the contract award including, but not limited to making final payment within the terms and conditions of the contract and within the contract price. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. DRESSLER SCOPE OF SERVICES "EXHIBIT A" SFWMD WATER USE PERMIT MODIFICATION TR #12180 TASK AUTHORIZATION NO. 12-03E INTRODUCTION The City of Tamarac has the desire to modify their current Water Use Permit from the South Florida Water Management District (SFWMD), 06-00071-W, issued on February 12, 2004. This Water Use Permit allows for the City to withdraw 2,754 million gallons of water a year from the Biscayne Aquifer until February 12, 2009. At that point, the annual allocation was reduced to 2,625 million gallons per year. The maximum monthly allocation is not to exceed 249.2 million gallons. The City would like to have this permit modified to at least maintain the 2,754 million gallons annual allocation. This scope of services will provide the engineering and hydrogeological work necessary to complete the SFWMD application for modification of the City's Water Use Permit for the corresponding annual groundwater withdrawal allocation. This work cannot guarantee that the allocation will be maintained at the 2,754 million gallons per year, but every effort will be made to seek that level of withdrawal. Eckler Engineering will gather all necessary information relating to current demand, projected growth and all of the other necessary information required to complete the SFWMD Application for Water Use Permit modification. Based on the information gathered, Eckler Engineering will make a determination of the quantity of water to be requested by the City of Tamarac as part of this Water Use Permit modification. We will gather current population information and projections through at least the year 2032. We will project water use through that same time period and will determine what the annual allocation could be. We will also collect data on the current water supply wells within the City of Tamarac, irrigation wells within the utility service area and other private and municipal wells surrounding the City of Tamarac service area. This data will go into an analytical model to determine if it will be possible to obtain the requested amount of water without adversely impacting the resource. The resource is defined as the conservation areas to the west and major SFWMD canals such as the C-14 on the north of your utility service area. Any increase in allocation could not impact any of the other legal users in the area. Eckler Engineering will prepare all applications, report information and graphics required for the application for modification in accordance with the applicable rules and regulations of the SFWMD. The tasks associated with these services are presented below: ARTICLE 1 - SCOPE OF SERVICES Task 1 - Project Administration/Management This task focuses on the administration of the project including project setup, client interface and general project management and administration. Task 2 - Preliminary Coordination and Data Gathering This task focuses on obtaining the necessary information required to complete the project. A. Meet with appropriate City staff to discuss and finalize project requirements. Page 1 of 8 B. Develop the current number of Units and Corresponding Water Demands. C. Determine the projected new units and population growth within the City of Tamarac Utility Service Area utilizing the most recent census data. D. Gather information on the location, size, and pumpage of any wells within the utility service area and the adjacent utilities. E. Gather information necessary to show the location of all existing and proposed raw water supply wells, their size, depth, and original and current pumping rates. F. Gather the existing raw water quality information. G. Gather information with respect to xeriscape ordinances, low flow plumbing fixture ordinances, and other water conservation ordinances and/or rate structures utilized by the City. H. Gather information relative to the location of potential pollution sources in order to identify these areas within the analytical and numerical models. I. Gather information regarding wellfield protection requirements currently in place with Broward County Department of Environmental Protection and Growth Management. Task 3 - Data Evaluation This task consists of undertaking an appropriate level of engineering to organize and analyze the data gathered under Task 2. The analysis of data shall focus on the organization and evaluation for incorporation into the application for Water Use Permit renewal to be submitted to the South Florida Water Improvement District. This task shall also include the review of the previous application for renewal and the City's current Water Use Permit. Applicable data from these items will be extracted for use in the preparation of the permit renewal application. Task 4 - Analytical Wellfie/d Modeling This task will involve the development of an analytical model of the aquifer to see if it is possible to accomplish the intended purpose of this Task Authorization. At this point in the project, we will know if it is prudent to move forward with the numerical modeling phase. Task 5 - Preparation of Water Use Permit Modification Application This task shall consist of the preparation of the Water Use Permit Application for Modification documents. This work shall be inclusive of the following: A. Preparation of all permit application forms in accordance with the current rules and requirements of the South Florida Water Management District. B. Preparation of exhibits to the permit application to address all of the requirements of the application in accordance with the current rules and regulations of the South Florida Water Management District. Page 2 of 8 C. Preparation of all project information and data spreadsheets per the requirements of the South Florida Water Management District renewal application. D. Preparation of all maps and graphics required to complete the permit application. Task 6 - Project Meetings The Engineer will arrange for and attend the following meetings in order to properly complete this project: A. A project kick-off meeting with the City of Tamarac to discuss information and data to be gathered in order for Eckler Engineering to complete this project. B. An initial coordination meeting with the South Florida Water Management District to discuss the purpose of this proposed application and the process to be used to obtain the modification. C. A meeting with the South Florida Water Management District to discuss their comments following the initial submittal of the application for modification of the Water Use Permit. This application will include all population and demand projections, well data, and the results of the analytical model. This meeting will also develop parameters for the numerical model, if required. D. A third meeting will be held with the South Florida Water Management District to discuss modifications made to the permit application based on the District's review of the numerical model results. E. A fourth meeting is planned with the South Florida Water Management District for the purpose of finalizing the application for modification and final review of the numerical model results. Task 7 - Submit and Review (Quality Control) The ENGINEER will make the following submittals at various completion levels of this project for the purpose of CITY's review and comment for coordination and quality control. A review meeting will be requested following each submittal to discuss and receive comments from the CITY. The CITY's comments shall be incorporated into revisions prior to the next subsequent quality control submittal. Quality control submittals for this project are anticipated at the following completion levels: A. Submittal Number 1 to the SFWMD with all of the population data, water use projections, well data, and results of the analytical model. B. Submittal Number 2 to SFWMD based on the numerical model results. C. Submittal Number 3 to SFWMD based on the comments received from the review of the numerical model. The ENGINEER will incorporate the agreed -upon revisions made by the CITY. A total of three (3) meetings with the CITY is the level of effort for this Task. Page 3 of 8 Task 8 - Numerical Modeling If the SFWMD requires numerical groundwater modeling (MODFLOW) to determine the potential impacts to existing permitted users and on existing wetlands at the requested allocation rate, then this modeling will be completed under this task. The MODFLOW model will be based on the SFWMD Broward County model and will be comprised of a five layer model with grid spacings no greater than 500 feet and including one, 90 day scenario with no recharge. This work will only be performed if the analytical model fails to provide sufficient information for the SFWMD to support the requested allocation. Project Deliverables Project deliverables shall be in accordance with Table 2, attached. ARTICLE 2 - DATA OR ASSISTANCE TO BE PROVIDED BY CITY A. Provide access to existing City data, information and facilities for the proper completion of this project. B. Assist Engineer in the gathering of data as discussed previously in this Exhibit and other data as may be necessary for the proper completion of this project. C. Provide general project review, where required. D. Provide access to City staff after reasonable notice. E. Attend meetings as requested by Engineer with permitting agencies when necessary. F. Pay all required permit fees. ARTICLE 3 - TIME OF COMPLETION Table 1 shows the preliminary project schedule based on days from receipt of the Notice of Commencement. ARTICLE 4 - PAYMENT AND COMPENSATION As consideration for providing the services enumerated, the CITY shall pay the ENGINEER fees as described below: A. For services enumerated in Tasks 1 through 8, the hourly rate plus direct expenses for personnel working directly on the project in accordance with the hourly rates attached to the Agreement dated August 24, 2011, not to exceed $147,000 without City approval. The above fees have been determined in accordance with the scope of work breakdown attached as Table 3. This Table is provided in three parts: The Overall Project, The Analytical Modeling, and the Numerical Modeling. The first phase of the project will include meeting with the SFWMD, gathering all well data from the City, private users and surrounding users, development of population and anticipated usage forthe City, and the development of an analytical model which should tell us if we should proceed to the Page 4 of 8 more expensive numerical model. This portion of the project is estimated to cost about $38,000 of the total. If it doesn't look positive for a permit modification at this point in the project, then this is the place to stop work. This proposal does not include the provision of the following items: Preparation of bid specifications, drawings and contract documents. Any expert witness or testimony services.
