R-2012 - 58 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE THE PURCHASE OF THREE (3) HOLMATRO EXTRICATION TOOL SETS AND UPDATE THREE (3) EXISTING HOLMATRO EXTRICATION TOOL SETS TO CURRENT TECHNOLOGY, FROM SOUTH FLORIDA EMERGENCY VEHICLES, LLC, AN AUTHORIZED DEALER OF HOLMATRO, INC., A SOLE SOURCE PROVIDER NOT TO EXCEED A TOTAL AMOUNT OF $99,930.90; AUTHORIZING THE DISPOSAL OF OBSOLETE EXTRICATION TOOL SETS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has provided high quality Fire Rescue operations to the community since 1975; and WHEREAS, Tamarac Fire Rescue desires to improve the quality of Fire and EMS operations to the residents, citizens and visitors of the City; and WHEREAS, Tamarac Fire Rescue operated Holmatro brand extrication tools for the past 16 years; and WHEREAS, the Department requests to continue and maintain the Department's extrication equipment standard through its successful partnership for the quality of service, tool performance and life -time warranty; and WHEREAS, funding for the three (3) complete Holmatro extrication tool sets and upgrade three (3) existing Holmatro extrication tool sets in the amount of $99,930.90 (quotes attached hereto as Exhibit A) has been provided for in the FY12 budget; and WHEREAS, as a result of standardization and the lack of dealers, South Florida Emergency Vehicles, LLC, an authorized dealer of Holmatro extrication tools is a sole source provider (letter attached hereto as Exhibit B); and WHEREAS, the City of Tamarac will have obsolete extrication tools available for disposal, and City Code §6-153 permits the disposal of Surplus Stock; and TR12199 April 3, 2012 Page 2 WHEREAS, the Fire Chief and the Purchasing and Contracts Manager recommend purchasing three (3) complete Holmatro extrication tool sets and upgrade three (3) existing Holmatro extrication tool sets in an amount not to exceed $99,930.90 (quotes attached hereto as Exhibit A); and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve and execute funding for the purchase of three (3) complete Holmatro extrication tool sets and upgrade three (3) existing Holmatro extrication tool sets in the amount of $99,930.90 from the Fire -Rescue FY12 budget. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All Exhibits attached hereto are expressly incorporated herein and made a part hereof. SECTION 2: The appropriate City Officials are hereby authorized to purchase Holmatro extrication equipment from South Florida Emergency Vehicles, LLC. in the amount not to exceed $99,930.90, (quotes attached hereto as Exhibit A). SECTION 3: The appropriate City Officials are hereby authorized to dispose of obsolete extrication tools as permitted by City Code §6-153. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
