CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2011- X-
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO APPROVE THE
PURCHASE AND INSTALLATION OF GUARDRAIL
FROM SOUTHEAST ATTENUATORS, INC., AT A
COST NOT TO EXCEED $50,000.00, UTILIZING THE
CITY OF MIAMI GARDENS BID NUMBER 08-09-001;
APPROVING FUNDING FROM THE APPROPRIATE
CAPITAL IMPROVEMENT ACCOUNT; AUTHORIZING
BUDGET AMENDMENTS FOR PROPER ACCOUNTING
PURPOSES; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, City Code Section 10-189(a) requires the installation of guardrail where
pavement lies within twenty-five (25) feet of a canal, lake, or ditch for the protection of the
public; and
WHEREAS, sufficient funding exists for the purchase and installation of guardrail
in the amount not to exceed $50,000.00 and
WHEREAS, a contract currently exists for the purchase and installation of guardrail
between Southeast Attenuators, Inc., and the City of Miami Gardens, Florida, Bid No. 08-
09-001 for guardrail replacement and installation, a copy of said bid and price agreement is
incorporated herein by reference and on file in the office of the City Clerk; and
WHEREAS, the City of Miami Gardens has extended the Agreement with
Southeast Attenuators, Inc. effective October 31, 2010 through October 31, 2011, a
copy of said extension is incorporated herein by reference on file in the Office of the
City Clerk; and
WHEREAS, City Code Section 6-155 allows the Purchasing/Contracts Manager the

authority to procure supplies, material and equipment, which are the subject of contracts
with other governmental agencies; and
WHEREAS, it is the recommendation of the Director of Public Works and
Purchasing and Contracts Manager to approve the purchase and installation of guardrail
from Southeast Attenuators, Inc., at a cost not to exceed $50,000.00, utilizing the City of
Miami Gardens, Florida Bid No. 08-09-001 for guardrail replacement and installation; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to approve said
purchase and installation of guardrail utilizing the City of Miami Gardens, Florida
Agreement Bid No. 08-09-001 for guardrail replacement and installation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS' clauses are HEREBY ratified and
confirmed as being true and correct and are HEREBY made a specific part of this
Resolution upon adoption hereof. All exhibits attached hereto are incorporated herein and
made a specific park of this resolution.
SECTION 2: The purchase and installation of guardrail from Southeast
Attenuators, Inc., at a cost not to exceed $50,000.00, utilizing the City of Miami Gardens,
Florida Agreement Bid No. 08-09-001 for the Repair, Maintenance, and Installation of
Guardrails, is hereby approved.
SECTION 3: Funding for the purchase and installation of guardrail in the
amount not to exceed $50,000.00 is available in the Capital Improvement Program.
SECTION 4: The appropriate City Officials are hereby authorized to expend
an amount not to exceed $50,000.00 for the purchase and installation of guardrail; and
SECTION 5: All budget amendments for proper accounting purposes are
hereby authorized.

SECTION 6: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 7: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 8: This Resolution shall become effective immediately upon its
passage and adoption.
