HomeMy WebLinkAboutCity of Tamarac Resolution R-2011-0091 TR11982 Page 1 of 3 January 14, 2011 Revision 2 - January 20, 2011 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 2011- 0- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING RESOLUTION R-2010-69; AMENDING THE BROWARD COUNTY AND CITY OF TAMARAC EMERGENCY MEDICAL SERVICES COUNTY GRANT AND AGREEMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac, Florida adopted Resolution No. R-2010-69 on May 26, 2010 for the purchase of Bariatric Stretchers and Ramp Systems under a non -matching EMS grant; and WHEREAS, the original grant 10-OMETS-8271-01(14)(15) and equipment purchase would outfit the City of Tamarac and Miramar ALS fire -rescue vehicles with bariatric patient equipment; and WHEREAS, Miramar Fire -Rescue prepared a formal written request to be removed as a participating agency from the original grant and it was accepted by the Broward County and Tamarac Fire Rescue; and WHEREAS, a written request was presented to all EMS agencies within Broward County to replace Miramar Fire -Rescue on the grant and the Sheriff of Broward County was accepted; and WHEREAS, it is necessary for the City to amend its Agreement to authorize the Sheriff of Broward County to participate as a sub -grantee; and TR11982 Page 2 of 3 January 14, 2011 Revision 2 - January 20, 2011 WHEREAS, the Fire Chief and the EMS Division Chief recommend the adoption of the grant amendment (attached hereto as Attachment A); and WHEREAS, the City Commission of the City of Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend the EMS Broward County grant. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All Exhibits attached hereto are incorporated into this Resolution by this reference. SECTION 2: The City Commission of the City of Tamarac, Florida, hereby amends Resolution No. R-2010-69 to accept the Sheriff of Broward County as a sub - grantee participant, approves the amended Grant Agreement attached hereto as Attachment A and authorizes the appropriate City Officials to execute the Agreement. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or 1 TR 11982 Page 3 of 3 January 14, 2011 Revision 2 - January 20, 2011 application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. DRESSLER";7- FIRST AMENDMENT TO AGREEMENT Between BROWARD COUNTY and CITY OF TAMARAC for STATE EMS COUNTY GRANT FUNDING Contract Number — 10-OMETS-8271-01(14)(15) Project: Therapeutic Hypothermia Induction Case — ALS Transport (14) Bariatric Patient Rescue — Retrofit (15) FIRST AMENDMENT TO AGREEMENT Between BROWARD COUNTY and CITY OF TAMARAC for STATE EMS COUNTY GRANT FUNDING This is a First Amendment to Agreement between BROWARD COUNTY, a political subdivision of the State of Florida, hereinafter referred to as "COUNTY" CITY OF TAMARAC, a municipal corporation of the State of Florida, its successors in interest, hereinafter referred to as "SUB -GRANTEE." WHEREAS, the Parties entered into an Agreement dated August 3, 2010, providing for funding and administration of State EMS County Grant Funding for two (2) projects totaling Sixty-nine Thousand Eight Hundred Fifty-five Dollars ($69,855.00); and WHEREAS, the Parties desire to enter into this First Amendment to Agreement, by replacing Exhibit "D," Scope of Project(s), with a revised Exhibit "D-Al," Scope of Project(s), to include additional participating agencies not included in the original agreement and to exclude a participating agency that was included and no longer desires to participate; and WHEREAS, Exhibit "D," Scope of Project(s), shall be amended as provided for herein; NOW, THEREFORE, IN CONSIDERATION of the mutual covenants set forth herein, the Parties agree to amend the Agreement as follows: The above recitals are true and correct and are incorporated herein as if set forth in full hereunder. 10-OMET5-8271-01(14)(15) 1st Amendment— Tamarac - 2 - 2. Exhibit "D," Scope of Project(s), of the Agreement, is hereby deleted in its entirety and a new Exhibit "D-Ai ", Scope of Project(s), attached hereto is substituted therefore. 3. Except as provided for herein this First Amendment to Agreement, the terms and conditions set forth in the original Agreement shall remain in force and effect. 4. This First Amendment to Agreement shall be deemed effective when fully executed by both parties. 5. This First Amendment to Agreement may be fully executed in multiple copies by both parties, each of which, bearing original signatures, shall have the force and effect of an original document. Based on future protocol the cooling process can be used for hyperthermia (heat stroke), brain injuries (CVA) and spinal cord injuries. Participating agencies: Cities of Coral Springs, Dania Beach, Fort Lauderdale, Lauderhill and Town of Davie. Bariatric Patient Rescue — Retrofit Project (15): This project will develop the capacity to respond to bariatric patient medical emergencies with the proper resources and unique skill set of a specialized transport rescue for patient weighing over 600 pounds based on EMS best practices in the industry. Participating agencies: Sheriff of Broward County. SUB -GRANTEE will be reimbursed for line items and in the amounts reflected in Exhibit "D-2," Projects' Budgets. SUB -GRANTEE is required to submit Exhibit "F," Department of Health EMS Grant Program Expenditure Report disclosing funds expended for the categories set forth in the line item budget, with copies of supporting documentation and bill of lading(s) when the all commodities are secured and the project is complete. II. Amount for Term of Agreement: $ 69,855.00 Therapeutic Hypothermia Induction Case — ALS Transport (14) is $43,855.00 Bariatric Patient Rescue — Retrofit Project (15) is $26,000.00 III.
