Reso. 12082 Page 1 of 4 August 25, 2011 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 1, A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ACKNOWLEDGING THAT A HOUSEHOLD IN THE CITY'S NEIGHBORHOOD STABILIZATION PROGRAM ('NSP1") RECEIVED MORE THAN THE MAXIMUM ALLOCATION OF FUNDING; CONFIRMING THAT CITY STAFF HAS TAKEN THE NECESSARY ADMINISTRATIVE ACTION TO ADDRESS THIS ISSUE IN ORDER TO ENSURE COMPLIANCE WITH THE CITY'S ACTION PLAN; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac, Florida (hereinafter referred to as the "City"), receives funds from the United States Department of Housing and Urban Development Neighborhood Stabilization Program ("NSP1") to assist homeowners with repairs to their recently purchased foreclosed or abandoned homes; and WHEREAS, the City's administrative staff evaluates households who receive NSP1 funds in order to determine eligibility to receive NSP1 funds for home repair assistance; and WHEREAS, it was recently determined that due to certain households' income status, that NSP1 household was not able to receive funds from non-NSP1 grant funding sources; and WHEREAS, typically the City uses the non-NSP1 grant funding sources to appropriately leverage the cost of home rehabilitation, which reduces the amount of NSP1 funds to be used for any one household, and Temp. WHEREAS, in this instance, due to the inability to utilize any non-NSP1 funds, the household received more than the maximum allowable allocation of funding provided by the NSP1 program guidelines as delineated in the City's Action Plan; and WHEREAS, the City Commission acknowledges that the City's administrative staff made a good faith effort to avoid this situation, and assures and confirms with the United States Department of Housing and Urban Development ("HUD") that no intentional actions were taken that would violate any policies or provisions related to the operation of the City's NSP1 program; and WHEREAS, the City Commission deems it to be in the best interests of the citizens and residents of the City to acknowledge the NSP1 program funding overage, and inform HUD that this was an isolated, unavoidable situation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1. The foregoing 'WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. 1 Temp. The City Commission of the City of Tamarac, Florida hereby acknowledges that as a result of a good faith effort of the City's administrative staff that the household of Mr. Richard Hayward and Andrea King, received more than the maximum allowable allocation of funding provided by the NSP1 program pursuant to the City's FY 2008-2009 Substantial Amendment to the Annual Action Plan. In addition, the City Commission confirms that appropriate measures have been taken to ensure that this type of funding issue can be avoided in the future. Section 3. All resolutions or parts of resolutions in conflict herewith be, and the same are hereby repealed to the extent of such conflict. Section 4. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
