R-2011- / 0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, TO ACKNOWLEDGE AND APPROVE A COMMUNITY FARMERS MARKET WITHIN AN S-1 (RECREATIONAL DISTRICT) ZONING DISTRICT IN KEEPING WITH SECTION 24-308 OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC, FLORIDA (CASE NO. 21-MI-11); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Parks and Recreation Advisory Board recommends that the City of Tamarac facilitate a community farmers market; and WHEREAS, the intent of the of the S-1 (Recreational District) zoning district and the Goals, Objectives and Policies of the Comprehensive Plan support the establishment of a community farmers market at the Tamarac Park, located at 7501 North University Drive, which is zoned S-1 (Recreational District); and WHEREAS, the Director of Community Development recommends approval of the Farmers Market within an S-1 (Recreational District) zoning district; and WHEREAS, the City Commission finds it to be in the best interests of the residents and business community within the City of Tamarac to provide the goods and services associated with a community farmers market. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Temp Reso #12098 September 15, 2011 Page 2 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: That the City Commission hereby authorizes the establishment of a community farmers market within an S-1 (Recreational District) zoning district to be located at Tamarac Park, 7501 North University Drive, Tamarac, Florida. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
